SB 58 Memorandum dated August 13 from Hilary V. Martin, Revisor of Statutes, was received stating: Under sec. 4, ch. 16, SLA 2023, secs. 1 and 2 take effect "only if, and to the extent that, the United States Department of Health and Human Services approves amendments submitted in accordance with sec. 3 . . . ." Section 3 of ch. 16, SLA 2023, requires the Department of Health to "submit as necessary for approval by the United States Department of Health and Human Services amendments to the state plan under AS 47.07.040 to raise the maximum household income level relative to the federal poverty line for pregnant women to be eligible for 2024-10-09 Senate Journal Page 2981 medical assistance and to allow enrolled individuals to receive postpartum medical assistance for up to 12 months under 42 U.S.C. 1396a(e)(16)." Section 5 provides that if sections 1 and 2 take effect, they take effect on "the day after the date the revisor of statutes receives notice from the commissioner of health" that the United States Department of Health and Human Services approved the amendments to the state plan. I received the required notice from the commissioner of health on February 27, 2024. Therefore, secs. 1 and 2, ch. 16, SLA 2023, took effect February 28, 2024. Please publish this in the journal to provide notice of this effective date. Memorandum dated September 23 from Hilary V. Martin, Revisor of Statutes, was received stating: Under sec. 4(a), ch. 49, SLA 2022, secs. 1 and 2 take effect "only if the United States Department of the Interior, National Park Service, approves the conversion of real property effected by removing Lions Club Park, as described in sec. 2 of this Act, from Chugach State Park and adding state land under sec. 1 of this Act to Chugach State Park before January 1, 2030." Section 3 of ch. 49, SLA 2022, requires the commissioner of natural resources to apply to the United States Department of the Interior, National Park Service, in writing and in the manner provided by 36 C.F.R. 59.3(b), for approval in (1) converting certain real property acquired or developed with assistance from 54 U.S.C. 200301 – 200310 (Land and Water Conservation Fund), subject to this Act; and (2) adding additional state land to Chugach State Park, established under sec. 1 of this Act. Section 4(b) requires the commissioner of natural resources to "notify the revisor of statutes in writing not later than 20 days after receiving notice of the approval" by the United States Department of the Interior, National Park Service. Section 5 provides that if secs. 1 and 2 take effect, they take effect on "January 1 of the calendar year following the date the commissioner of natural resources notifies the 2024-10-09 Senate Journal Page 2982 revisor of statutes" of the approval by the National Park Service. I received notice from the commissioner of natural resources on February 8, 2024. Therefore, secs. 1 and 2, ch. 49, SLA 2022, take effect January 1, 2025.
