The invocation was offered by the Chaplain, Reverend Nancy Campbell of White Fields Church. Representative Vance moved and asked unanimous consent that the invocation be spread on the journal. There being no objection, it was so ordered. MESSAGES FROM THE GOVERNOR A message dated January 11 was read stating under the provision of art. III, sec. 18, Constitution of the State of Alaska, the Governor requests the opportunity to address a joint session of the Thirty-Third Alaska State Legislature on Monday, January 23 at 7:00 p.m. for presentation of the State of the State Address. An amendment dated October 10 to the Declaration of Disaster Emergency dated September 17, 2022, with an accompanying letter were received. The amendment expands the West Coast Storm Disaster to include the Pribilof Islands Regional Education Attendance Area. The letter and declaration were copied to the Finance Committee Co-chairs and are on file in the Chief Clerk's office. A letter dated October 10, 2022, was received requesting concurrence from the Legislature to increase the funding limitation for the September 2022 West Coast Storm disaster to $40 million of Federal Authorization along with the original $10 million from the disaster relief fund in accordance with AS 26.23.020(i) and (k) and per AS 26.23.025(a). The letter and attached finance plan were copied to the Finance Committee Co-chairs and are on file in the Chief Clerk’s office. 2023-01-19 House Journal Page 0019 A letter dated November 1, 2022, requesting Legislative concurrence pursuant to AS 26.23.020(k)(2)(B) for transfer of General Funds from the Disaster Relief Fund was received. A Declaration of Disaster Emergency and accompanying letter dated November 14, 2022, regarding the North Slope Borough severe sea storm were received. An updated finance plan dated November 29, 2022, and accompanying letter dated December 1, 2022, regarding the Village of Tununak Washeteria Fire disaster were received. Martin, Revisor of Statutes, was received: "Under sec. 9, ch. 32, SLA 2021, AS 03.05.077 is repealed. Under sec. 10(a), ch. 32, SLA 2021, sec. 9 takes effect "only if the United States Department of Agriculture approves an industrial hemp program plan submitted by the Department of Natural Resources under AS 03.05.076(i) before January 1, 2030". Section 11, ch. 32, SLA 2021, provides that if sec. 9 takes effect, it "takes effect on the day after the date on which the revisor of statutes receives notice from the commissioner of natural resources" under sec. 10(b), ch. 32, SLA 2021. I received notice on September 9, 2022, from the commissioner of natural resources that the industrial hemp plan had been approved by the United States Department of Agriculture. Therefore, the effective date of sec. 9, ch. 32, SLA 2021, is September 10, 2022. Please publish this in the journal to provide notice of this effective date." The following memorandum dated July 15, 2022, from Hilary V. Martin, Revisor of Statutes, was received: "Section 14, ch. 33, SLA 2018, required notice to the revisor of statutes regarding the status of bonds issued by the Alaska Tax Credit Certificate Bond Corporation. That section reads: NOTICE TO REVISOR OF STATUTES. (a) The commissioner of revenue shall notify the revisor of statutes in writing 2023-01-19 House Journal Page 0026 (1) if bonds (A) are not issued under AS 37.18.010 - 37.18.190 by January 1, 2022; or (B) are issued under AS 37.18.010 - 37.18.190 before January 1, 2022, when the principal amounts of the bonds issued under AS 37.18.010 - 37.18.190, together with the interest on them and any interest owing on unpaid installments of interest, and all other obligations with respect to the bonds, have been fully met and discharged; and (2) when (A) there are no outstanding applications for purchase of tax credit certificates or claims for refunds or payments for which payment has not been made under AS 43.55.028(e); and (B) it has been at least one year since a person has applied for a purchase, refund, or payment under AS 43.55.028. (b) In this section, (1) "claim for refund or payment" means a refund or payment claimed under AS 43.20.046, 43.20.047, or 43.20.053 subject to payment under AS 43.55.028; (2) "tax credit certificate" means a transferable tax credit certificate issued under AS 43.55.023 or a production tax credit certificate issued under AS 43.55.025 subject to purchase under AS 43.55.028. On January 3, 2022, Lucinda Mahoney, commissioner of revenue, gave notice to the revisor of statutes that "[d]ue to the ruling in Forrer v. State of Alaska, this legislation has been struck down and therefore, bonds have not been issued by the January 1, 2022 date provided in the uncodified law and no payments or applications have been made under this law."
