Senate Bill 45 sought to create parity amongst tobacco users by expanding an excise tax on tobacco products other than cigarettes (OTP) to include electronic smoking products (ESPs). ESPs are currently not subject to state-level taxes as they are not considered cigarettes or OTP under current law, and this bill would tax them at 35% of wholesale value. There were many conversations about what an appropriate level to tax would be, but ultimately a tax increase on the people of Alaska is not something I can support. While SB 45 would also increase the age in which a person can purchase nicotine products from 19 to 21, it is not possible to separate out components of a bill once it has been passed by the Legislature. Martin, Revisor of Statutes, was received: "Chapter 18, SLA 2020, added professional counseling services to the list of optional medical assistance services if certain conditions specified in secs. 3 and 4 of the Act were satisfied. Section 3 required the Department of Health and Social Services to submit for federal approval the changes in secs. 1 and 2 of the Act. Under sec. 4 of the Act, the commissioner of health and social services was required to: notify the revisor of statutes in writing, on or before October 1, 2021, if the United States Department of Health and Human Services approves the amendments to the state plan for medical assistance coverage under AS 47.07.030(b), as amended by sec. 1 of this Act, and AS 47.07.900(20), enacted by sec. 2 of this Act. Although this notification came after October 1, 2021, I have given effect to secs. 1 and 2 of the Act because the state plan amendments were approved by the federal government on September 20, 2021. The effective date of the changes is October 2, 2021. AS 47.07.900(20), enacted by sec. 2 of ch. 18, SLA 2020, has been renumbered as AS 47.07.900(16) to maintain alphabetical order in that section.
