The Senate was called to order at 10:15 a.m. by the Honorable Fran Ulmer, Lieutenant Governor. Members of the Juneau Boy Scout Troop No. 21, Brian Fairchild, Leon Bus, Scott Shaub, Richard Smiley, Kevin Almlie and Brian Gilbertson presented the colors and led the Senate in the Pledge of Allegiance. Mr. Mike McDonald of Anchorage sang the United States National Anthem. The prayer was offered by the Chaplain, Associate Pastor Mary Ann Warden of the Northern Light United Church. Senator Zharoff moved and asked unanimous consent that the prayer be spread. Without objection, it was so ordered. And now, O God, make us instruments through whom You stretch forth Your hand of justice. Enable us to see others through the eyes of Christ, who cast his lot with those rejected by society. Refine us in the fire of Your Spirit so we can put aside old ways and embrace new possibilities, refusing to rest until relationships are set right and Your people know the meaning of true peace. Senator Kelly moved and asked unanimous consent that Senator Phillips be nominated. There being no further nominations, Senator Phillips was elected as President pro tempore. Lieutenant Governor Ulmer requested Senator Halford and Senator Duncan escort the President pro tempore to the rostrum. Senator Halford and Senator Duncan escorted the Lieutenant Governor from the chamber. President pro tempore Phillips announced that under provisions of law, AS 24.05.120, the Uniform Rules of the Twelfth Legislature, First Session, as amended in 1985, 1988, 1989 and 1991, will serve as the temporary rules of the current legislature until permanent rules are adopted. Senator Halford moved that nominations be closed. Without objection, it was so ordered. The question being: "Shall Senator Pearce be elected President of the Senate for the Nineteenth Legislature?" EXECUTIVE ORDERS EO 91 Letter dated January 16 was received from the Governor transmitting EXECUTIVE ORDER NO. 91: Under the authority of art. III, sec. 23, of the Alaska Constitution, I am transmitting an Executive Order transferring the office of equal employment opportunity from the Department of Administration to the Office of the Governor. Alaska's strength lies in the rich diversity of its people. By actively recruiting qualified Alaskans from protected groups into public service, state government promotes equality and welcomes a wide range of perspectives and ideas. My Administration is committed to giving all Alaskans an equal opportunity for employment in state government. The transfer of the office of equal employment opportunity to the Office of the Governor ensures that pressing issues in this area will come to my Administration's immediate attention. The transfer also will permit closer coordination of policy between the office and my Administration. 1995-01-16 Senate Journal Page 0024 EO 91 In the process of revising the statutes pertaining to the office of equal employment opportunity, I have added language that provides for the governor's appointment of a director of the office. That language will restore statutory text that existed before the office was transferred to the Department of Administration in 1991, and will enable the office to perform its functions, including the adoption of regulations, once the transfer to the Office of the Governor is complete. Currently, the commissioner of the Department of Administration is required to adopt regulations to carry out the office's duties. Over the last several years, funding and staffing of the office of equal employment opportunity have been reduced dramatically. This has resulted in a greatly reduced scope of work that has adversely impacted the overall objectives of the office. While the transfer of the office would enhance attention to the important functions of the office, I will be reviewing its budget and operations to assess whether further changes and budgetary recommendations are warranted.
