CALL TO ORDER
The meeting was called to order at 10:06 a.m. by Chairman
Donahue via teleconference.
INVESTIGATION 1 CONTRACT AMENDMENT
Senator Kerttula moved to extend the contract as directed by
the chairman.
Member MacNeille moved to amend the motion to read: to
authorize the chairman, as the designated project director,
under section 150(b) of the Procurement Procedures to
negotiate and sign on behalf of the committee an extension
for the Zaruba and Associates. The contract is increased an
additional $9,500 and extended through December 31, 1993.
Motion to increase and extend INV 1 contract passed with no
objections.
LEGAL COUNSEL CONTRACT AMENDMENT
Member MacNeille moved to authorize the chairman, as the
designated project director, under section 150(b) of the
Procurement Procedures to negotiate and sign on behalf of
the committee an increase to the Bogle and Gates contract.
The contract is increased an additional $15,000.
Motion to increase the Bogle and Gates contract passed with
no objection.
AUTHORITY TO SECURE SERVICES FOR PUBLIC HEARING
Member MacNeille moved to authorize the chairman to sign on
behalf of the committee and to enter into the appropriate
agreements to secure the services of a hearing officer,
court reporter, security personnel and any other personnel
required to conduct the public hearing on the charges issued
to Senator Jacko.
Senator Kerttula expressed his concern at the total cost
involved in conducting a public hearing.
Motion to authorize the chairman to secure services for the
public hearing passed without objection.
Chairman Donahue announced that David Stewart is the
preferred candidate for the hearing officer position and if
the subcommittee adopts the interim hearing procedures, Mr.
Stewart would be offered the position.
AMENDMENT AND ADOPTION OF HEARING PROCEDURES
The subcommittee reviewed the DRAFT procedures.
Member MacNeille recommended that the word [CHAIRMAN] on the
last line of page 13 be deleted, for the purpose of
clarifying that the subcommittee itself may overrule a
determination by the hearing officer.
Member MacNeille recommended that on page 13, Conduct of
Hearing Section f.1., the word selection be added to the
sentence containing: . . .and may submit recommendations to
the Chairman for selection or disqualification. . .
Member McCoy recommended that on page 13, Conduct of Hearing
Section f., to the last line of subsection 1: following the
word "candidate" add: the committee's decision is final.
Member McCoy recommended that on page 14, section g.,
Post-Hearing, in the second sentence the words [HEARING
OFFICER] be deleted and the sentence is amended to read:
Only subcommittee members will participate in deliberations.
The members discussed the Media Attendance and Conduct
Guidelines and recommended that the Chairman add
restrictions to those guidelines, if necessary.
Member MacNeille moved to adopt the Draft Hearing Procedures
as amended, for the purposes of the Senate Subcommittee
hearing on the charges issued to Senator Jacko. Senator
Kerttula asked unanimous consent to adopt the procedures.
The motion to adopt the hearing procedures passed without
objection.
