"* Sec. 9. SALARY AND BENEFIT ADJUSTMENTS. (a) The                                                                            
operating budget appropriations made in sec. 1 of this Act include                                                              
amounts for rate adjustments for the public employees' retirement                                                               
system and the judicial retirement system for public officials, officers,                                                       
and employees of the executive branch, judicial officers, Alaska Court                                                          
System employees, employees of the legislature, and legislators.                                                                
Appropriations made in sec. 1 of this Act for rate adjustments as                                                               
described in this subsection are for the benefit of the state's integrated                                                      
comprehensive mental health program only and do not necessarily                                                                 
affect every group of noncovered employees.                                                                                     
      (b)  The operating budget appropriations made in sec. 1 of this Act                                                       
do not include health insurance adjustments for public officials,                                                               
officers, and employees of the executive branch, judicial officers,                                                             
Alaska Court System employees, employees of the legislature, and                                                                
legislators.                                                                                                                    
   * Sec. 10. MONETARY TERMS OF COLLECTIVE

BARGAINING AGREEMENTS. The monetary terms for the fiscal                                                                        
year ending June 30, 2027, of each of the collective bargaining                                                                 
agreements listed in this section are rejected under AS 23.40.215                                                               
unless separate legislation is enacted that contains explicit language                                                          
approving the monetary terms of that agreement. Money appropriated                                                              
in sec. 1 of this Act may not be used to implement the monetary terms                                                           
for the fiscal year ending June 30, 2027, of any of the collective                                                              
bargaining agreements listed in this section unless separate legislation                                                        
is enacted that contains explicit language approving the monetary                                                               
terms of the collective bargaining agreement. This section applies to                                                           
the collective bargaining agreements negotiated between the state and                                                           
the following bargaining organizations:                                                                                         
            (1)  Public Employees Local 71, for the labor, trades, and                                                          
crafts unit;                                                                                                                    
            (2)  Alaska Public Employees Association, for the supervisory                                                       
unit;                                                                                                                           
            (3)  Teachers' Education Association of Mt. Edgecumbe,                                                              
representing the teachers of Mt. Edgecumbe High School;                                                                         
            (4)  Alaska Vocational Technical Center Teachers'                                                                   
Association, National Education Association, representing the                                                                   
employees of the Alaska Vocational Technical Center;                                                                            
            (5)  International Organization of Masters, Mates, and Pilots,                                                      
representing the masters, mates, and pilots unit;                                                                               
            (6)  Alaska State Employees Association, for the general                                                            
government unit;                                                                                                                
            (7)  Marine Engineers' Beneficial Association, representing                                                         
licensed engineers employed by the Alaska marine highway system;                                                                
            (8)  Confidential Employees Association, representing the

unfilled positions be used only for the payment of overtime or bonuses                                                          
for employees, or for salary and benefits for seasonal employee                                                                 
positions, that are within the same division or section of the                                                                  
department, agency, or commission funded by the appropriation.                                                                  
Appropriations made in this Act for the payment of salary and benefits                                                          
for unfilled positions may not be used for any other purpose, including                                                         
contracting for services, purchasing supplies or equipment, or

transferring money to any other line item or fund. Notwithstanding                                                              
any other provision of law, any unexpended and unobligated balance                                                              
of an appropriation restricted under this section at the end of the fiscal                                                      
year shall lapse into the fund from which the appropriation originated.                                                         
This restriction applies to all appropriations made in this Act to any                                                          
department, agency, or commission.                                                                                              
      (b) It is the intent of the legislature that, if a department, agency,                                                    
or commission uses appropriations made to the department, agency, or                                                            
commission in a fiscal year for overtime or bonuses for employees, or                                                           
for seasonal employee salary or benefits, the department, agency, or                                                            
commission prepare a report for the legislature that describes the use                                                          
of the funds, including a list of the specific positions funded by the                                                          
appropriation and a description of how the department, agency, or                                                               
commission plans to recruit and fill the vacant positions, and, not later                                                       
than December 15 following the close of that fiscal year, submit the                                                            
report to the senate secretary and the chief clerk of the house of                                                              
representatives and notify the legislature that the report is available."
