Full Journal pdf2024-10-09 Senate Journal Page 2912 SB 147 HOUSE CS FOR CS FOR SENATE BILL NO. 147(L&C) am H "An Act relating to workers' compensation reemployment rights and benefits; establishing a workers' compensation stay-at-work program; relating to the workers' compensation benefits guaranty fund; relating to the presumption of compensability for workers' compensation claims related to post-traumatic stress disorder; relating to the Alaska senior benefits payment program; and providing for an effective date" was enrolled, signed by the President and Secretary, Speaker and Chief Clerk and the engrossed and enrolled copies transmitted to the Office of the Governor at 3:10 p.m., July 3, 2024. 2024-10-09 Senate Journal Page 2913 Memorandum dated June 12 from Hilary V. Martin, Revisor of Statutes, was received stating: In accordance with Rule 43, Uniform Rules of the Alaska State Legislature, I am reporting the following manifest error in HCS CSSB 147(L&C) am H, which has been corrected in enrolling. In addition to more minor technical errors discovered in enrolling the above bill, section 18 has been given an immediate effective date to correct a manifest error. Section 18 extends the sunset of the Alaska senior benefits payment program from June 30, 2024, to June 30, 2034. What is now section 18 was added by amendment 1, which was adopted on the House floor. Amendment 1 did not make any changes to the effective date of the bill. At the time amendment 1 was adopted, the underlying bill, HCS CSSB 147(L&C) had an immediate effective date. Therefore, when amendment 1 was adopted, section 18 had an immediate effective date. Amendment 2 was then adopted on the House floor, which changed the effective date for the entire bill to January 1, 2025. If section 18 were to take effect on January 1, 2025, the Alaska senior benefits payment program would have already expired before that date, thus making the legislature's action in adopting amendment 1 meaningless. For these reasons, and in order to carry out the intent of the legislature in adopting amendment 1, section 18 has been given an immediate effective date in enrolling.
