Messages from the Governor A Declaration of Disaster Emergency dated July 22 was received regarding damages from ice jam and snowmelt flooding along the lower Kuskokwim River from May 4 – 12, 2020. The declaration and letter had been copied to the Finance Committee Cochairs. Letters dated July 29, August 4 and August 18 were received stating on February 4, 2020, in accordance with Article III, Sections 26 and 27 of the Alaska Constitution, and Alaska Statute 39.05.080, I submitted a list of appointees for confirmation. The following appointees are withdrawn from consideration, effective immediately: Board of Certified Direct Entry Midwives Amanda Penwell – Fairbanks Violent Crimes Compensation Board Richard “Kay” Payne – Palmer Board of Certified Real Estate Appraisers William Barnes – Palmer Wendy Lawrence – Sitka 2020-10-02 Senate Journal Page 2406 HB 313 Message was received stating the Governor signed the following bill on May 21 and transmitted the engrossed and enrolled copies to the Lieutenant Governor’s Office for permanent filing: HOUSE BILL NO. 313 "An Act approving and ratifying the actions of the governor and executive branch in expending certain federal receipts and of the Legislative Budget and Audit Committee in approving the expenditure of certain federal receipts during fiscal years 2020 and 2021; and providing for an effective date." Chapter 32, SLA 2020 Effective Date: See Chapter SR 2 Message dated May 21 was read stating the Governor read the following resolution and transmitted the engrossed and enrolled copies to the Lieutenant Governor’s Office for permanent filing: SENATE RESOLUTION NO. 2 Expressing support for federal legislation establishing a United States Department of Defense regional center for security studies in the state. Senate Resolve No. 2 Communications Disclosure letters received from the Select Committee on Legislative Ethics, in accordance with AS 24.60, will be published in Senate Journal Supplement No. 11 and House and Senate Joint Journal Supplement No. 17. Letter dated January 28 was received September 28 from Patrick FitzGerald stating he has withdrawn his name from consideration for appointment as alternate public member to the Select Committee on Legislative Ethics. Letter dated May 18 was received from Joel Bolger, Chief Justice of the Alaska Supreme Court, stating in accordance with AS 24.60.131(b)(3), the following alternate public member has been appointed to the Select Committee on Legislative Ethics: Gerald (Jerry) McBeath 2020-10-02 Senate Journal Page 2407 Memorandum dated September 16 from Hilary V. Martin, Revisor of Statutes, Legislative Affairs Agency, Division of Legal Services, was received stating: Under sec. 34, ch. 18, SLA 2016, AS 16.05.100(2), 16.05.B0(e), 16.05.130(f), 16.05.3400); AS 37.15.765, 37.15.770, 37.15.773, 37.15.777, 37.15.780, 37.15.783, 37.15.787, 37.15.790, 37.15.793, and 37.15.799, relating to sport fishing facilities revenue bonds, are repealed. Under secs. 21 and 35(a), ch. 18, SLA 2016, AS 16.05.340(i) is amended. Under sec. 35(b), ch. 18, SLA 2016, the repeals and amendment take effect if the Commissioner of Revenue notifies the revisor of statutes "of the date that the principal amount of bonds issued under AS 37.15.765 - 37.15.799, together with the interest on them and any interest owing on unpaid installments of interest, and all other obligations with respect to the bonds, has been fully met and discharged." On September 3, 2020, the commissioner notified the revisor that all obligations with respect to the bonds had been fully met and discharged as of June 8, 2020. Under sec. 36, ch. 18, SLA 2016, if the notification is made, the repeal of AS 16.05.100(2), 16.05.B0(e), 16.05.B0(f), 16.05.340Q); AS 37.15.765, 37.15.770, 37.15.773, 37.15.777, 37.15.780, 37.15.783, 37.15.787, 37.15.790, 37.15.793, and 37.15.799 and the amendment of AS 16.05.340(i) take effect "January 1 of the calendar year following the year of notice under sec. 35 of this Act." Therefore, the repeal of AS 16.05.100(2), 16.05.130(e), 16.05.130(f), 16.05.3400); AS 37.15.765, 37.15.770, 37.15.773, 37.15.777, 37.15.780, 37.15.783, 37.15.787, 37.15.790, 37.15.793, and 37.15.799 and the amendment to AS 16.05.240(i) take effect January 1, 2021.
