AS 43.98 is amended by adding a new section to read: Article 5. Employment Preferences. Sec. 43.98.100. Employment preferences. (a)To the maximum extent permitted by law, a corporation that receives $100,000 or more in tax credits or deducts $100,000 or more in expenses under this title shall, when recruiting for a position or job opening, provide consideration and an opportunity to interview to an applicant who, if known, (1) is a recipient of state medical assistance under AS 47.07; 2018-05-03 Senate Journal Page 2958 (2) is subject to the work requirement under AS 47.07.036(h); and (3) possesses the necessary qualifications for the position or job opening. (b) A corporation that fails to comply with the requirement under (a) of this section may be subject to a reduction or loss of tax credits or deductions. (c) In this section, "consideration" means reviewing an applicant's entire application to determine whether the applicant should be selected, rejected, or admitted to further steps in the assessment or selection process." The uncodified law of the State of Alaska is amended by adding a new section to read: CONDITIONAL EFFECT; NOTIFICATION. (a) Section 1 of this Act takes effect only if a needs-based analysis on workforce development and employability of certain adults who are receiving medical assistance is conducted jointly by the Department of Health and Social Services and the Department of Labor and Workforce Development, and the commissioner of health and social services notifies the revisor of statutes in writing of the completion of the report as required under (b) of this section. (b) The commissioner of health and social services shall notify the revisor of statutes in writing of the completion of the report prepared under (a) of this section on or before January 1, 2020. * Sec. 3. If sec. 1 of this Act takes effect under sec. 2 of this Act, it takes effect six months after the notification required under sec. 2 of this Act."
