Senator Hoffman moved and asked unanimous consent that the prayer be spread. Without objection, it was so ordered. With utmost respect for the religious traditions of all Alaskans, I offer this prayer: Almighty, gracious, good and giving God; we thank you for all the wonders of this life. For the beauty of this day, for the majesty of this Great Land, and for the strength of its people. We celebrate this day the renewal of our common work, and seek also the renewal of our common dedication to the highest ideals of integrity, honesty, cooperation and service. What good work was begun by others, let us inherit with honor, and pursue with humility. As every offer to serve involves some sacrifice, we pray the families of these here chosen and willing to serve may not bear too much the cost of their loved ones' absence. May all be reunited with joy at session's end. We offer thanks for the skills of those who serve in so many ways to support the work of this Legislature; may each receive the appreciation that is their due, and a right sense of pride in difficult tasks well done. For the inspiring example of the men and women of Coast Guard Icebreaker Healy, and merchant vessel Renda, we are thankful. Upon them we pray you will grant protection and safe waters to their journey's end. May we remember the limits of competition, and enjoy new frontiers of cooperation. Upon the whole governance of this state, O Lord, we ask your guidance and direction; may the whole of the good they do in the present grow to be greater each passing year than the sum that was imagined. By your Grace. Amen. 2012-01-17 Senate Journal Page 1215 Certification Senator Meyer moved and asked unanimous consent that the journal for the first legislative day of the Second Special Session, the First Supplement of the First Session and First Special Session, the Second and Final Supplements of the First Session and the First and Second Special Sessions, Senate Journal Supplements No. 3 and 4 and House and Senate Joint Journal Supplement No. 8, be approved as certified by the Secretary. The Office of Administrative Hearings (OAH) was created in 2004 in the Department of Administration to provide greater coordination and expertise in the conduct of administrative hearings. OAH has provided additional confidence to the public that final administrative decisions on appeal are fairly reached, being heard before a neutral decision maker. The Department of Health and Social Services (DHSS) is currently responsible for a large number of the administrative hearings and appeals, and its decisions affect many Alaskans. Moving DHSS hearing and appeal functions to a neutral and independent adjudicatory body such as OAH will benefit the public by adding to the impartiality and professionalism of the decisions issued. This Executive Order is intended to increase public confidence and to consolidate functions to make a more efficient State government. Governor's transmittal letter dated January 13: Dear President Stevens: Under the authority of Article III, Section 18 of the Alaska Constitution, I am transmitting a bill relating to the State's capital budget for Fiscal Year 2013 (FY 2013). 2012-01-17 Senate Journal Page 1229 My budget proposal for FY 2013 continues our efforts to foster opportunity for job growth and economic opportunity for Alaskans. Our budget priorities are established in the State of Alaska's Constitution - resource development, transportation/infrastructure, education, and safe homes and communities for Alaskans. The proposed capital budget totals $1.8 billion and includes resource development and infrastructure projects throughout Alaska such as roads to resources, State and federal highways, airports, the marine highway, ports and harbors, and water and sewer projects. The budget funds renewable energy and weatherization projects and includes two rural school construction projects and 14 school major maintenance projects. Year three of the five-year deferred maintenance program to take care of State assets is also requested. Development of our natural resources is key to economic growth and opportunities for Alaskans. Our budget invests in access to these resources, streamlining permitting, and assessing strategic minerals potential throughout the state. Together with investments in transportation infrastructure, this budget positions Alaska for a future with more opportunity and more prosperity. I look forward to working with the Legislature to finalize the capital budget for the upcoming fiscal year. Thank you for your consideration of this bill. Sincerely, /s/ Sean Parnell Governor SB 161 SENATE BILL NO. 161 BY THE SENATE RULES COMMITTEE BY REQUEST OF THE GOVERNOR, entitled: "An Act making appropriations for the operating and loan program expenses of state government and for certain programs, capitalizing funds, amending appropriations, and making reappropriations; and providing for an effective date." 2012-01-17 Senate Journal Page 1230 was read the first time and referred to the Finance Committee. Governor's transmittal letter dated January 13: Dear President Stevens: Under the authority of Article III, Section 18 of the Alaska Constitution, I am transmitting a bill relating to the State's operating budget for Fiscal Year 2013 (FY 2013). My budget proposal for FY 2013 continues our efforts to foster opportunity for job growth and economic opportunity for Alaskans. Our budget priorities are established in the State of Alaska's Constitution - resource development, transportation/infrastructure, education, and safe homes and communities for Alaskans. I am proposing a reasonable operating budget that holds the line on government spending and looks to provide a more stable and secure future for our families. With budget discipline, targeted spending, and managing our savings, Alaska's cash reserves and excellent bond rating will provide us with economic opportunities for years to come. I look forward to working with the Legislature to finalize the operating budget for the upcoming fiscal year. Thank you for your consideration of this bill. Sincerely, /s/ Sean Parnell Governor SB 162 SENATE BILL NO. 162 BY THE SENATE RULES COMMITTEE BY REQUEST OF THE GOVERNOR, entitled: "An Act making appropriations for the operating and capital expenses of the state's integrated comprehensive mental health program; and providing for an effective date." 2012-01-17 Senate Journal Page 1231 was read the first time and referred to the Finance Committee. In accordance with AS 37.14.003(b) a report of the differences between the Governor's proposed budget and the recommendations of the Alaska Mental Health Trust Authority was transmitted. Governor's transmittal letter dated January 13: Dear President Stevens: Under the authority of Article III, Section 18 of the Alaska Constitution, I am transmitting a bill relating to the State's comprehensive mental health program for Fiscal Year 2013 (FY 2013). As required by statute, it includes both operating and capital appropriations. Also, as required, the enclosed report outlines the differences between the recommendations of the Alaska Mental Health Trust Authority and my proposed budget. The proposed mental health budget represents a cooperative effort between State agencies and the Alaska Mental Health Trust Authority. These productive working relationships make a positive difference for Alaska's mental health beneficiaries. I am proposing a reasonable budget that holds the line on government spending and provides a more stable and secure future for our families. With budget discipline, targeted spending, and managing our savings, Alaska's cash reserves and excellent bond rating will provide us with economic opportunities for years to come. Sincerely, /s/ Sean Parnell Governor 2012-01-17 Senate Journal Page 1232 SB 163 SENATE BILL NO. 163 BY THE SENATE RULES COMMITTEE BY REQUEST OF THE GOVERNOR, entitled: "An Act providing for and relating to the issuance of general obligation bonds for the purpose of paying the cost of municipal port projects; and providing for an effective date." was read the first time and referred to the Transportation and Finance Committees. Governor's transmittal letter dated January 13: Dear President Stevens: Under the authority of Article III, Section 18 of the Alaska Constitution, I am transmitting a bill providing for and relating to the issuance of $350 million in general obligation bonds for the purpose of paying the cost of certain municipal port projects. The bill would provide for the issuance of general obligation bonds to finance design and construction costs for these port projects. These projects are important to their respective municipalities and would also improve transportation infrastructure in the state.
