I appreciate the careful consideration and support from the legislature of this request. House Bill 300 as passed by the legislature contained appropriations for Fiscal Year 2011 totaling $8.5 billion, of which $5.4 billion is general fund. The budget includes special appropriations for tax credits, revenue sharing, and direct deposits to the retirement system costs, and includes funding for public education, the university, public health and safety, transportation, resource development, and funding for State government programs, services, and grants. The FY2011 operating budget I submitted to you was a responsible, fiscally conservative budget given the current revenue forecast and economic conditions. I appreciate that the legislature shares the administration's concern about the size and growth of the budget and that you made few changes to my request. Through line-item vetoes, I have reduced the appropriations in HB 300 by $35.9 million including deleting fiscal notes for legislation that did not pass this session and for bills that did not become law. I have also vetoed $2,920.4 million relating to the fiscal note for SB 13 that expands Medicaid eligibility. As SB 13 progressed through the legislature, I was not made aware that expansion of Medicaid eligibility included funding abortions through Denali Kid Care. I am opposed to expanding eligibility for publically funded abortions and will not sign SB 13 into law. HCS CSSB 230(FIN) am H as passed by the Legislature contained appropriations for Fiscal Years 2010 and 2011, totaling $3.2 billion, including $1.6 billion in general funds. Through line-item vetoes, I have reduced the appropriations in the capital budget by $300 million of which $293.5 million is general fund. Funding for fire stations and emergency services, seniors and elder care facilities, port and harbor development was also approved along with $35 million for the Port MacKenzie Rail Extension, $40 million for the Tanana River Bridge, and $20 million for the Port of Anchorage which are significant economic development projects that will create jobs and economic growth. These new capital dollars, along with over $750 million in projects from previous capital budgets that are going out to bid over the next few months, will put Alaskans to work now. This legislation follows that same philosophical construct of government setting prices in the private sector market. I do not believe it is the government's role to set minimum prices on market commodities. Because this legislation requires me to choose from two options, neither of which reflect my underlying free market principles, I look to which outcome is least burdensome on Alaskans. HCS CSSB 117(L&C) appears to be an improvement over current law in this respect because it removes a layer of administrative burden on private sector businesses and seeks to provide some certainty. Where the benefits of this bill are potentially life-saving; where overwhelming support was demonstrated by constituents, physicians, nonprofits, and the legislature; and where little to no meaningful fiscal impact was demonstrated on the state or to private health care plans, I have signed this bill into law. We know the important services that these professionals provide in delivering quality patient care. 2010-07-09 Senate Journal Page 2618 Overtime limits such as those addressed in this legislation typically get resolved through the collective bargaining process. I support Alaskans' freedom to contract, whether through collective bargaining or other means. In most circumstances I would not support limitations on that freedom. Testimony taken during legislative hearings indicated that the safety of Alaskans is at greater risk without the legislation. For example, I understand that a few health care facilities impose mandatory overtime on their nursing professionals potentially leaving patients at greater risk. In the interest of public safety, similar restrictions currently exist in areas such as mining, truck driving, and for flight crews. I am allowing this bill to become law without my signature for the reasons cited above, and because I want to signal that carve-outs or exceptions to the collective bargaining process receive close scrutiny. In my view, most issues should be left to parties to freely negotiate. The Legislature should continue to monitor the bill's implementation to assure it has the desired outcomes in improving health care quality for Alaskans, and to revisit the matter if unintended consequences arise or the desired outcome does not materialize. HCS CSSB 305(FIN) would impose a new, complex and costly tax regime on certain categories of Alaska oil and gas production. The legislation would decouple oil and gas production taxes and provide one tax calculation for oil, Cook Inlet gas, and gas used in-state and another, separate tax calculation for non-Cook Inlet gas that is exported out of state. The legislation imposes a significant overall tax increase on these operations which diminishes Alaska investment and job prospects during these globally challenged economic times. Second, the legislation creates more uncertainty and destabilizes Alaska's fiscal environment right at a time when companies are holding multiple open seasons for a large diameter Alaska natural gas pipeline. Changing the tax regime at this time, and potentially doing it all over again after an open season, creates even more uncertainty around company investment decisions. Future Alaska jobs depend upon having more fiscal stability in Alaska's environment, not less. 2010-07-09 Senate Journal Page 2620 Third, the Department of Law has advised me that this bill is not needed at this time to protect the State's interests in obtaining a fair return for its oil and gas assets because the Legislature retains broad discretion to change tax laws. And, to the extent that the Alaska Gasline Inducement Act (AGIA) locks in the production tax obligation at the start of the open season, it locks in the tax only as to gas for which firm transportation capacity is acquired during the first binding open season. The AGIA tax inducement does not lock in the production tax obligation for oil. For these reasons, I have vetoed the bill. I will continue working with the Legislature to do all the State can to stimulate responsible oil and gas exploration and development so Alaska's resources flow to Alaskans and markets beyond, and so our citizens have good paying jobs into the future.
