The FY11 adjusted base includes FY10 base funding plus salary adjustments that were known when the Governor submitted his request. In addition to the $170.2 million adjusted base, the Authority recommended appropriating an additional $15.3 million, bringing the FY11 total recommendation to $185.6 million (column 1). The Governor requested $185.7 million (column 2), and the legislature appropriated $185.2 million (column 3). The $185.2 million appropriated includes $1.3 million for bargaining agreements approved after the Governor's request (column 4). The figure also reflects $59,700 in reductions to the travel line in various Mental Health components (column 5). These travel reductions are part of reductions that affected the allocations in most agencies. The Agency Summary report subtracts these broad-based items from the Conference Committee budget, giving a budget of $184.0 million, in order to highlight differences other than bargaining agreements and travel (columns 6 and 7). The enclosed transaction comparison provides details regarding modifications to Authority recommendations. Note that the report shows only differences from Authority recommendations: "MH Rec" in the second column indicates that a transaction recommended by the Authority was denied or modified; "MH adjCC" indicates that a transaction not recommended by the Authority was incorporated in the bill. Highlights include: 1. Health and Social Services programs: · A reduction of $3.6 million in Behavioral Health · A reduction of $760,000 in Children's Services · A reduction of $2.8 million in Senior and Disabilities Services · An increase of $7.0 million in Medicaid Services 2010-07-09 House Journal Page 2609 The net change for the agency is a reduction of $219,800 from the Authority's request (excluding transfers to a new Therapeutic Courts Appropriation in the Court System). 2. Denial of $584,100 in grants to the University of Alaska. 3. Consolidation of various agency efforts associated with therapeutic courts (transferring a total of $874,500 GF/MH) into a new appropriation in the Court System. For the two funds controlled by the Authority, Mental Health Trust Authority Authorized Receipts (MHTAAR) and Mental Health Trust Admin (MHT Admin), legislative appropriations are consistent with the Authority's original recommendation except for a net increase of $177,000 in MHTAAR funding as follows: 1. $100,000 for a sexual assault coordinator position in the Office of the Governor; 2. $100,000 for the traumatic brain injury program and 3. $23,000 for a denied increment request for Mental Health land administration costs. The appropriations of additional MHTAAR funds were made with the consent of the Authority's Executive Director. Capital Appropriations The Authority recommended a $15.0 million capital budget. The Governor's request totaled $15.2 million. The legislature approved the Governor's request as submitted. As shown in the enclosed Project Detail report, the Governor modified the Authority's recommendations as follows: · Reduced Health and Social Services projects by a net of $3.2 million, including elimination of funding for MH Boards- Assistive Technology, MH Boards-Essential Program Equipment Match, MH Deferred Maintenance ADA Improvement Grants to Service Providers and Beneficiaries, and the MH Disability Justice-Construction of Bethel Sobering Center. The Governor added $500,000 for deferred maintenance and accessibility improvements. · Increased the AHFC Homeless Assistance project by $3.35 million 2010-07-09 House Journal Page 2610 Future Reporting We appreciate the good working relationship between the Authority and the legislature. We know the important services that these professionals provide in delivering quality patient care. Overtime limits such as those addressed in this legislation typically get resolved through the collective bargaining process. I support Alaskans' freedom to contract, whether through collective bargaining or other means. In most circumstances I would not support limitations on that freedom. Testimony taken during legislative hearings indicated that the safety of Alaskans is at greater risk without the legislation. For example, I understand that a few health care facilities impose mandatory overtime on their nursing professionals potentially leaving patients at greater risk. In the interest of public safety, similar restrictions currently exist in areas such as mining, truck driving, and for flight crews. I am allowing this bill to become law without my signature for the reasons cited above, and because I want to signal that carve-outs or exceptions to the collective bargaining process receive close scrutiny. In my view, most issues should be left to parties to freely negotiate. The Legislature should continue to monitor the bill's implementation to assure it has the desired outcomes in improving health care quality for Alaskans, and to revisit the matter if unintended consequences arise or the desired outcome does not materialize. I appreciate the careful consideration and support from the legislature of this request. House Bill 300 as passed by the legislature contained appropriations for Fiscal Year 2011 totaling $8.5 billion, of which $5.4 billion is general fund. The budget includes special appropriations for tax credits, revenue sharing, and direct deposits to the retirement system costs, and includes funding for public education, the university, public health and safety, transportation, resource development, and funding for State government programs, services, and grants. The FY2011 operating budget I submitted to you was a responsible, fiscally conservative budget given the current revenue forecast and economic conditions. I appreciate that the legislature shares the administration's concern about the size and growth of the budget and that you made few changes to my request. Through line-item vetoes, I have reduced the appropriations in HB 300 by $35.9 million including deleting fiscal notes for legislation that did not pass this session and for bills that did not become law. I have also vetoed $2,920.4 million relating to the fiscal note for SB 13 that expands Medicaid eligibility. As SB 13 progressed through the 2010-07-09 House Journal Page 2651 legislature, I was not made aware that expansion of Medicaid eligibility included funding abortions through Denali Kid Care. I am opposed to expanding eligibility for publically funded abortions and will not sign SB 13 into law. The capital budget I presented for legislative consideration provided a healthy level of investment while taking the longer term view of spending. As passed, the level of spending in the capital budget is too high. I have made reductions with several key factors in mind - life/health/safety, infrastructure and jobs now, and balance across legislative districts. HCS CSSB 230(FIN) am H as passed by the Legislature contained appropriations for Fiscal Years 2010 and 2011, totaling $3.2 billion, including $1.6 billion in general funds. Through line-item vetoes, I have reduced the appropriations in the capital budget by $300 million of which $293.5 million is general fund. The enclosed spreadsheet contains a summary of the vetoed appropriations including the page and line number, fund source, and the reason for the veto. The capital budget I signed into law includes $1.26 billion for transportation, including highways and aviation projects, $88.5 million for water and sewer projects, $451.6 million for K-12 education and the University, $123.3 million for deferred maintenance projects, and $77.2 million for renewable and other energy projects. Funding for fire stations and emergency services, seniors and elder care facilities, port and harbor development was also approved along with $35 million for the Port MacKenzie Rail Extension, $40 million for the Tanana River Bridge, and $20 million for the Port of Anchorage which are significant economic development projects that will create jobs and economic growth. These new capital dollars, along with over $750 million in projects from previous capital budgets that are going out to bid over the next few months, will put Alaskans to work now. II, Sec. 15, of the Alaska Constitution, I have vetoed the following bill: HOUSE CS FOR CS FOR SENATE BILL NO. 305(FIN) "An Act providing that the tax rate applicable to the production of oil as the average production tax value of oil, gas produced in the 2010-07-09 House Journal Page 2684 Cook Inlet sedimentary basin, and gas produced outside of the Cook Inlet sedimentary basin and used in the state increases above $30 shall be 0.4 percent multiplied by the number that represents the difference between that average monthly production tax value and $30, or the sum of 25 percent and the product of 0.1 percent multiplied by the number that represents the difference between that average monthly production tax value and $92.50, except that the total rate determined in the calculation may not exceed 50 percent; providing for an increase in the rate of tax on the production of gas as the average production tax value on a BTU equivalent barrel basis of gas produced outside of the Cook Inlet sedimentary basin and not used in the state increases above $30; relating to payments of the oil and gas production tax; relating to the lease expenditures that may be deducted when determining production tax value; relating to availability of a portion of the money received from the tax on oil and gas production for appropriation to the community revenue sharing fund; relating to the allocation of lease expenditures and adjustments to lease expenditures; and providing for an effective date." HCS CSSB 305(FIN) would impose a new, complex and costly tax regime on certain categories of Alaska oil and gas production. The legislation would decouple oil and gas production taxes and provide one tax calculation for oil, Cook Inlet gas, and gas used in-state and another, separate tax calculation for non-Cook Inlet gas that is exported out of state. The legislation imposes a significant overall tax increase on these operations which diminishes Alaska investment and job prospects during these globally challenged economic times. Second, the legislation creates more uncertainty and destabilizes Alaska's fiscal environment right at a time when companies are holding multiple open seasons for a large diameter Alaska natural gas pipeline. Changing the tax regime at this time, and potentially doing it all over again after an open season, creates even more uncertainty around company investment decisions. Future Alaska jobs depend upon having more fiscal stability in Alaska's environment, not less. 2010-07-09 House Journal Page 2685 Third, the Department of Law has advised me that this bill is not needed at this time to protect the State's interests in obtaining a fair return for its oil and gas assets because the Legislature retains broad discretion to change tax laws. And, to the extent that the Alaska Gasline Inducement Act (AGIA) locks in the production tax obligation at the start of the open season, it locks in the tax only as to gas for which firm transportation capacity is acquired during the first binding open season. The AGIA tax inducement does not lock in the production tax obligation for oil. For these reasons, I have vetoed the bill. I will continue working with the Legislature to do all the State can to stimulate responsible oil and gas exploration and development so Alaska's resources flow to Alaskans and markets beyond, and so our citizens have good paying jobs into the future.
