II, sec. 17, of the Alaska Constitution, I have allowed the following bill to become law without signature: CS FOR HOUSE BILL NO. 117(JUD) "An Act relating to proclamations issued by the governor calling the legislature into special session." Chapter No. 16, SLA 2007 Effective Date: 8/26/07 This bill would amend AS 24.05.100(a)(1) by extending the amount of notice to call the legislature into special session from at least 15 days to at least 30 days, with some exceptions (emergency, disaster, or when the legislature is still in session or just adjourned). The power of the governor to call a special session is set out in art. II, sec. 9 of the Alaska Constitution without any requirement for prior notice. In fact, previous governors have called the legislature into special session with fewer than 15 days prior notice - such as calling for a special session to convene immediately following the adjournment of the regular session. Since the 15-day notice requirement was established in 1959, the general practice for most administrations has been to work cooperatively with the legislature to establish special session dates. I have been advised by the Department of Law that there is a legal question regarding the extent to which the legislature may, by statute, put notice conditions on the governor's constitutional power to call a special session. In general, I think providing at least 30 days notice is reasonable, particularly with respect to the fact that Alaska has a "citizen legislature" comprised of members who have livelihoods and responsibilities in addition to their legislative duties. However, there also may be a necessity for any governor to fully invoke the authority of the Alaska Constitution to call a special session without the prior notice. 2007-06-20 Senate Journal Page 1363 It is important for the governor to have the maximum flexibility to call special sessions when the needs of the state require. While the bill makes some improvements to existing law by providing some exceptions, it does not address other urgent needs, such as an economic crisis in the state. For any special sessions, I intend to work with the legislature in setting dates that work effectively for both branches of government. As a result, the goal of the bill can be met without unnecessarily restricting the governor's power to call special sessions to meet the pressing needs of Alaskans. For these reasons, I have not signed CSHB 117(JUD). While the bill will become law without my signature, the Alaska Constitution will continue to provide the governor the authority to convene a special session whenever it is deemed critical or necessary for Alaska. Legislative Resolve No. 12 I wish to add my voice to the chorus of Alaska legislators who congratulate Alaska Airlines for its 75 years of service to the State and former Territory of Alaska. The company traces its roots to Mac McGee, a rugged, hard-working bush pilot who started McGee Airways in Anchorage in 1932. After several mergers, the company now known as Alaska Airlines was born in 1944, and later joined with airlines founded by aviation legends, Shell Simmons, Bob Ellis, and Mudhole Smith. It grew from a small regional air carrier to the ninth largest airline in the United States. Its fleet of more than 100 jets carries more than 12 million passengers a year. It now offers service that extends beyond Alaska to Russia, Mexico, Washington, D.C. and, later this fall, Hawaii. It even has participated in historical events such as the Berlin Airlift in 1948 and Operation Magic Carpet that carried thousands of Yemenite Jewish refugees to Israel in 1949. Time and time again, Alaska Airlines distinguishes itself as an innovator of technology for flight safety and customer service. In 1996, it became the first airline in the world to integrate the satellite Global Positioning System with the Enhanced Ground Proximity Warning System - a network that uses two dozen satellites to 2007-06-20 Senate Journal Page 1368 triangulate an airplane's position and apply that information to an onboard computer database of contour maps that show a pilot an aircraft's position to nearby terrain. Alaska Airlines also pioneered the use of the Required Navigation Performance system to fly contoured approaches and departures with remarkable accuracy into and out of the rugged landscapes of many Alaska airports. In 1995, the company became the first U.S. air carrier to book flights and sell tickets on the Internet. In 1999, it became the first U.S. airline to offer Web check-in, allowing customers to check in and print boarding passes via the Internet. It even offers special, discounted constituent fares to make it easier for Alaskans to visit their capital. In 2004, it introduced its "Airport of the Future" check-in protocol at Ted Stevens Anchorage International Airport, an innovation that has dramatically sped up checking into the state's largest and busiest airline hub. In an era that has seen the demise of such aviation giants as Pan American World Airways and Eastern Air Lines, Alaska Airlines - through grit, determination, and innovation - the smiling face with the parka hood continues to soar.
