Senators Davis, French, Hoffman, Kookesh, Olson were absent. The prayer was offered by the Chaplain, Bianca Carpeneti. Senator Bunde moved and asked unanimous consent that the prayer be spread. Without objection, it was so ordered. Dear Lord, In years gone by the early Aleuts called Alaska "the Great Land." Today we still acknowledge this greatness and especially Your vast creative power whenever we look upon the beauty of the land You provided. This land You created comprises more than one half million square miles, is crowned by Denali, the highest peak on the continent, and has more than 5000 gleaming glaciers led by the famous Malaspina. These geographic marvels are a constant reminder that You gave us the responsibility to protect, manage, and use Your gifts wisely. Amen. Senator Guess led the Senate in the Pledge of Allegiance. 2006-06-07 Senate Journal Page 3586 Certification Senator Gary Stevens moved and asked unanimous consent that the journal for the twenty-eighth legislative day be approved as certified by the Secretary. Without objection, it was so ordered. Messages from the House SB 2001 Message dated June 7 was read, stating the House has failed to recede from its amendments to CS FOR SENATE BILL NO. 2001(FIN), namely: HOUSE CS FOR CS FOR SENATE BILL NO. 2001(FIN) am H "An Act relating to the production tax on oil and gas and to conservation surcharges on oil; relating to criminal penalties for violating conditions governing access to and use of confidential information relating to the production tax; amending the definition of 'gas' as that definition applies in the Alaska Stranded Gas Development Act; making conforming amendments; and providing for an effective date." The Speaker has appointed the following members to a Conference Committee to meet with the like committee from the Senate to consider the bills: Representative Samuels, Chair Representative Kelly Representative Kerttula Senate members appointed June 6 (page 3573): Senator Stedman, Chair Senator Huggins Senator French The presence of Senator Davis was noted. 2006-06-07 Senate Journal Page 3587 Message dated June 7 was read, stating the House passed and transmitted for consideration: First Reading and Reference of House Resolutions HCR 201 HOUSE CONCURRENT RESOLUTION NO. 201 BY REPRESENTATIVE GARA, Suspending Rules 24(c), 35, 41(b), and 42(e), Uniform Rules of the Alaska State Legislature, concerning Senate Bill No. 2002, relating to jurisdiction and timing of judicial review of a contract executed under the Alaska Stranded Gas Development Act. was read the first time and held on the Secretary's desk. Concur Messages SB 2002 Message dated June 7 was read, stating the House passed and returned for consideration CS FOR SENATE BILL NO. 2002(JUD) "An Act conferring original jurisdiction on the Alaska Supreme Court for the purpose of providing judicial review of a contract executed under the Alaska Stranded Gas Development Act, and setting the time in which a final agency decision of the commissioner of revenue made under that Act, the constitutionality of a law authorizing a contract enacted under that Act, or the enforceability of a contract executed under a law authorizing a contract enacted under that Act must be legally challenged and by whom; and providing for an effective date" with the following amendments: HOUSE CS FOR CS FOR SENATE BILL NO. 2002(JUD) am H "An Act increasing the time period for legislative and public comment on a proposed contract and preliminary findings and determinations under the Alaska Stranded Gas Development Act, conferring original jurisdiction on the Alaska Supreme Court for the purpose of providing judicial 2006-06-07 Senate Journal Page 3588 review of a contract executed under the Alaska Stranded Gas Development Act, and setting the time in which a final agency decision of the commissioner of revenue made under that Act, the constitutionality of a law authorizing a contract enacted under that Act, or the enforceability of a contract executed under a law authorizing a contract enacted under that Act must be legally challenged and by whom; and providing for an effective date." (Title change HCR 201) Senator Gary Stevens moved that the Senate concur in the House amendments and recommended the body vote no. The question being: "Shall the Senate concur in the House amendments?" YEAS: 4 NAYS: 12 EXCUSED: 0 ABSENT: 4 Yeas: Davis, Ellis, Elton, Guess Nays: Bunde, Cowdery, Dyson, Green, Huggins, Seekins, Stedman, Stevens B, Stevens G, Therriault, Wagoner, Wilken Absent: French, Hoffman, Kookesh, Olson and so, the Senate failed to concur. The Secretary was requested to notify the House of the Senate's action and request the House to recede from its amendments.
