Senator Cowdery was excused from a call of the Senate. The prayer was offered by the Chaplain, Pastor Larry Rorem of the Shepherd of the Valley Lutheran Church. Senator Hoffman moved and asked unanimous consent that the prayer be spread. Without objection, it was so ordered. In deepest respect for the religious beliefs of each person here, I invite you into a time of prayer and reflection. Let us pray. God of compassion and love, we live in an age when compassion and love are too often replaced by the divisive realities of harsh criticism and even hatred. Respect is replaced by disrespect. People in leadership positions are under such scrutiny that the pressure can be very intense. Today we give thanks for these leaders who serve. We give thanks for the time and energy they devote to public service. May we together live in appreciation for the gift of people, ability and cooperation that we experience together as a state. Certification Senator Leman moved and asked unanimous consent that the journal for the thirty-eighth legislative day be approved as certified by the Secretary. Without objection, it was so ordered. Messages from the Governor Letter dated February 9 was received, stating: Dear President Halford and Speaker Porter: It has been the practice for some time that annual legislative appropriations to the Department of Natural Resources have been insufficient to cover wildland fire suppression costs. The appropriated funds for fire suppression have already been fully expended or obligated; the Disaster Relief Fund balance is also totally obligated. Since a disaster declaration may not remain in effect longer than 30 days, this additional declaration is needed for continued wildland fire suppression operations. The estimated amount of disaster relief needed for fixed costs and fire suppression activities for the fall season remains at $4,768,400 in general funds and $5,981,700 in federal receipts. Through this Disaster Declaration, authorization will be made available to cover these costs. 2001-02-15 Senate Journal Page 0383 This funding mechanism will have to be used again when additional fire suppression authorization is needed for the remainder of fiscal year 2001. As this disaster declaration is due to fire, a special session to authorize the general funds is not necessary. We will forward a supplemental appropriation request in the next legislative session to cover all amounts subsequent to the regular appropriations. Sincerely, /s/ Tony Knowles Governor DECLARATION OF A DISASTER EMERGENCY WHEREAS, the Department of Natural Resources must provide fire suppression activities (AS 41.15.010 - 41.15.170) to prevent continuing and new fires from threatening life and property; and, WHEREAS, the appropriation to the Department of Natural Resources, Statewide Fire Suppression Program by sec. 1, ch. 133, SLA 2000, page 24, line 12, for fiscal year 2001 is totally obligated and not sufficient to cover fire suppression costs for fiscal year 2001; and, WHEREAS, the disasters declared on September 22, 2000, October 20, 2000, November 17, 2000, December 15, 2000, and January 12, 2001, were limited to 30 days under AS 26.23.020(c); however, continued fire suppression operations are needed. NOW, THEREFORE, on this 9th day of February 2001, I find insufficient funds were regularly appropriated for fiscal year 2001 fire suppression operations and activities, and find it necessary to implement funding via the disaster declaration process. Because money from the disaster relief fund is not available to cope with the disaster, I authorize under AS 26.23.020(j), and AS 26.23.050, that additional funds be made available to the Department of Natural Resources for continued wildland fire fighting needs for fiscal year 2001. To the extent that additional fire suppression authorization is needed for the remainder of fiscal 2001, this funding mechanism will be used again. 2001-02-15 Senate Journal Page 0384 FURTHER, the commissioner of the Department of Natural Resources is hereby authorized to utilize funds made available for these purposes, in the amounts considered necessary for fire protection and suppression.
