The exceptional success of the corporation means it is now able to pay dividends back to the state as a return of the capital contributed in 1987 when the corporation was created. This bill I transmit today provides for the corporation to issue annual payments to the state in years when the corporate net income is at least $2 million. The payment would be between 10 and 35 percent of the net income, subject to provisions of applicable bond indentures of the corporation. A fitting use for the dividend income would be to fund the Alaska Scholars Program. This scholarship program at the University of Alaska rewards the top high school students in our state and offers them an opportunity to continue their higher education. The program is estimated to reach a cost of about $3.6 million and will need general fund support by fiscal year 2002. Alaska students have reaped great benefits from the state's student loan program. Now that the program can repay some of that investment to the state, we should continue to invest it right back into the education of our young adults. I urge your prompt and favorable action on this measure to receive payments from the Alaska Student Loan Corporation and the intent to use these receipts to fund the Alaska Scholars Program. Alaska has arguably the worlds best spill prevention and response program, but only for vessels that carry oil as cargo (tank vessels), and for land-based oil facilities such as oil wells, pipelines, refineries and large tank farms. That safety net does not exist for any other oil carrier, including larger fishing boats, container and cruise ships, or the Alaska Railroad, regardless of the volumes they may carry and the fact they travel in some of the most pristine and resource-rich areas of the state. Most of Alaska's oil spills come from carriers that are not required to prepare for spill response. Since 1995, 93 spills totaling 5,286 gallons of oil came from regulated vessels and facilities. During this same period, 945 spills totaling 258,000 gallons of oil pollution came from unregulated carriers. This bill strengthens Alaska's safety net by extending the oil discharge prevention and contingency plan requirements and proof of financial responsibility requirements to larger non-tank vessels, and to railroads transporting oil in bulk. Specifically, the non-tank vessels covered by this bill are defined as any watercraft of 300 or greater gross registered tons with an oil storage capacity of more than 6,000 gallons. These vessels include larger cargo and cruise ships, fish processors, and public vessels engaged in commerce, such as the Alaska State Ferries. The bill requires these vessels to plan to respond within 48 hours to an oil spill of 15% of its maximum oil storage capacity, and clean up the 2000-02-16 House Journal Page 2211 HB 377 discharge as quickly as possible with minimal damage to the environment. Vessel operators must also be financially able to respond to damages resulting from a spill. Similarly, a railroad transporting oil as cargo would be required to plan to contain and control 15% of the oil storage capacity of the largest train within 48 hours and to clean up the spill as fast as possible. Railroads must demonstrate the financial ability to respond to damages based on the amount and type of oil transported. The contingency plan requirements of the bill take effect June 1, 2001, allowing time to implement regulations with comments from the public and affected oil carriers. The new financial responsibility requirements take effect September 1, 2000. Alaska is the only state on the West Coast that has not extended its contingency plan and financial responsibility laws to include these vessels. In light of recent spills from these vessels in our waters, and from the railroad on our land, it is time we act to strengthen our laws. Prevention and response preparedness do make a significant difference in the number and consequences of oil spills. Successive budget cuts to the department have threatened the viability of these programs to the point that a takeover of the safety program by the federal government is a distinct possibility. Federal management of our occupational health and safety program is unacceptable to me and to most employers and employees in Alaska. The bill I am introducing changes the way in which these programs are funded to ensure these services to Alaskans are put back on firm footing. These programs are currently paid for with general funds. The costs roughly equate to the amount of money the state collects from the tax on workers' compensation insurance premiums. The programs clearly benefit all employers, but only those employers who purchase workers' compensation insurance are taxed. Larger self- insured employers pay no tax. This bill more equitably spreads the cost/benefit structure of worker safety programs by eliminating the premium tax and replacing it with a fee for all employers based on a percentage of their individual workers' compensation claims. The fees would be accounted for separately and deposited into a worker safety and compensation account. The money in the account 2000-02-16 House Journal Page 2213 HB 378 would be treated as designated program receipts available for appropriation to the workers' compensation and safety programs. The bill provides for a four-year phase-in of the fees to minimize the impact on those self-insured employers who currently pay no tax. The new fee system is designed to raise the same amount of money as the current tax. Because the new system would spread costs among more employers, those employers currently paying the premium tax would realize a decrease in their payments. This bill offers a fair, effective way of ensuring continued funding for vital worker protection programs. I urge your prompt and favorable action on this measure.
