The roll showed sixteen members present.  Senator Pearce was                   
absent.  Senators Green, Lincoln were excused from a call of the               
Senate.                                                                        
                                                                               
Senator Taylor moved and asked unanimous consent that Senator                  
Kelly be excused from a call of the Senate through May 13 because              
of a medical emergency.  Without objection, Senator Kelly was                  
excused.                                                                       
                                                                               
The prayer was offered by the Chaplain, The Reverend A. Gordon                 
Johnson of the Resurrection Lutheran Church.  Senator Leman                    
moved and asked unanimous consent that the prayer be spread.

law for the death penalty for the crime of murder in the first degree,         
or whether the legislature should retain the existing penalty for the          
crime of murder in the first degree.  The question shall appear on
