Senator Ellis was excused from a call of the Senate. Senators Adams, Leman, Salo, Taylor were absent. The prayer was offered by the Chaplain Kevin Trick of the Baha'i Faith. Senator Hoffman moved and asked unanimous consent that the prayer be spread. Without objection, it was so ordered. O Thou kind Lord! This gathering is turning to Thee. The presence of Senator Adams was noted. 1995-02-21 Senate Journal Page 0343 RECESS Senator Halford moved and asked unanimous consent that the Senate stand in recess to the Joint Session at 11:00 a.m. Without objection, the Senate recessed at 10:52 a.m. AFTER RECESS JOINT SESSION IN THE HOUSE Speaker Phillips called the House to order and in accordance with Uniform Rule 51 turned the gavel over to President Pearce at 11:00 a.m. The purpose of the Joint Session was to hear an address by the Honorable Frank H. Murkowski, United States Senator. Senator Halford moved and asked unanimous consent that the roll call of the Senate be waived and all members be shown as present. Without objection, it was so ordered. Representative Vezey moved and asked unanimous consent that the roll call of the House be waived and all members be shown as present. Without objection, it was so ordered. President Pearce appointed Representative Martin and Senator Miller to escort United States Senator Murkowski to the Joint Session. The Senate Sergeant at Arms, Will Arthur, announced Senator Murkowski's entrance to the House Chamber. The Honorable Frank Murkowski was escorted to the rostrum and introduced by President Pearce. President Pearce introduced Nancy Murkowski, wife of Senator Frank Murkowski. Senator Murkowski requested the Joint Session observe a moment of silence in memory of Bishop Kenney. United States Senator Murkowski delivered his address. This address appears in Senate and House Joint Journal Supplement No. 8. 1995-02-21 Senate Journal Page 0344 Following his address, there was a question and answer period. United States Senator Murkowski received a standing ovation and was escorted from the chamber by Senator Miller and Representative Martin. Senator Halford moved and asked unanimous consent that the Joint Session stand in adjournment. Without objection, President Pearce adjourned the Joint Session at 12:02 p.m. AFTER RECESS IN THE SENATE The Senate reconvened at 12:18 p.m. MESSAGES FROM THE GOVERNOR Letter of February 20 was read, stating: Dear President Pearce: In the spirit of change which our constituents demanded in last fall's election, let's be bold enough to do away with business as usual. With this letter, I invite you to join with me in moving forward in a cooperative manner on confirmations. The Legislature's action regarding appointments to boards and commissions taken during a joint session on February 15, 1995, underscores the importance of clarifying the law regarding gubernatorial appointments and the Legislature's delegated powers of confirmation. Alaskans are not well served by unnecessary confrontations between the legislative and executive branches of government. This dispute does a disservice to the Alaskans who have volunteered their time on various boards and commissions and casts a legal cloud on actions taken by the quasi-judicial and regulatory bodies involved. Nor is it fair or reasonable to ask these citizens to resolve this dispute in court. 1995-02-21 Senate Journal Page 0345 As the sitting governor, I have the authority to transmit to the Legislature the names of appointments to boards and commissions. This authority exists regardless of actions made by my predecessor in office. I understand that you disagree with this view of the law. However, I am confident that you agree that a final determination by the Alaska Supreme Court would avoid a repeat of this dispute, which invariably occurs during the initial term of every governor. For these reasons, I request your cooperation in immediately bringing before our courts a test of the validity of the confirmations allegedly approved by the Legislature. I am told that only through legal action can this matter be resolved with finality. Only in this way can the affected boards and commissions proceed with their work with a minimum of disruption. By clarifying the rules, we all win. Senator Leman offered Amendment No. 1 : Page 1, lines 10-13: Delete all material and insert: (1) recent developments in molecular biology and genetics have important applications for forensic science; except for identical twins, the DNA of every person is unique. DNA typing methods can be used to characterize the DNA of an individual; Page 2, lines 1-4: Delete all material and insert: (2) the discriminating power of DNA typing is far superior to non-DNA genetic marker testing methods and DNA typing methods have proven to be a reliable and scientifically accepted tool for the investigation and prosecution of sex offenses and other crimes.
