Without objection, the following Legislative Letter of Intent was adopted: In voting on the confirmation of G. Nanette Thompson as commissioner of the Alaska Public Utilities Commission, the Legislature does not intend to approve of the removal of Mr. Tim Cook from the APUC nor in any way retreat from its position in Cook and Alaska State Legislature v. Botelho, Supreme Ct. Nos. S-7253 and S-7263. The Legislature's position in that lawsuit is that Mr. Cook was validly confirmed and therefore his removal was invalid. If the 1996-05-07 House Journal Page 4567 Legislature's position is correct, then there was no vacancy and Ms. Thompson's appointment, and the Legislature's confirmation of it, would be ineffective. However, the Supreme Court may uphold the Superior Court's decision that Mr. Cook was validly removed. To allow for that contingency, and to avoid rejecting Ms. Thompson under AS 39.05.080(3) by simply failing to vote on her confirmation during this session, the Legislature is taking this confirmation vote, without prejudice to its position concerning Mr. Cook's confirmation and removal. A letter dated May 5, 1996, from Attorney General Bruce Botelho to Senator Kelly was read, stating the administration's intent to honor whatever decision is ultimately reached by the Alaska Supreme Court in Cook v.
