Senator Donley was absent. The prayer was offered by the Chaplain, Pastor David Horn of the Faith Lutheran Church. Senator Salo led the Senate in the pledge of allegiance. CERTIFICATION Senator Taylor moved and asked unanimous consent that the journal for the sixty-eighth legislative day, as corrected, and the journal for the seventy-first legislative day be approved as certified by the Secretary. Without objection, it was so ordered. The presence of Senator Donley was noted. Senator Pearce moved and asked unanimous consent for the adoption of the Finance Committee Substitute offered on page 895. Senator Adams objected, then withdrew his objection. UNFINISHED BUSINESS Senator Duncan moved that the Senate rescind its action in failing to confirm Kay Klose to the Select Committee on Legislative Ethics. Senator Duncan called the Senate. The call was satisfied. Senator Halford ruled the rescinding motion out of order, stating there has been subsequent action and that action has been significant before this body in that replacements have been nominated by a third branch of government and that we have received that letter; we have at least vested in those two nominees the expectation of a hearing and action before this body. Senator Duncan appealed the ruling of the Chair. The question being: "Shall the ruling of the Chair be upheld?" The roll was taken with the following result: Shall the ruling of the Chair be upheld?
