Full Journal pdf1993-01-11 Senate Journal Page 0001 SENATE JOURNAL ALASKA STATE LEGISLATURE EIGHTEENTH LEGISLATURE - FIRST SESSION Juneau, Alaska Monday January 11, 1993 First Day Pursuant to the provisions of the Constitution of the State of Alaska, the Uniform Rules of the Alaska State Legislature, and AS 24.05.160, the Senate of the State of Alaska assembled in the Senate Chamber for the first regular session of the Eighteenth Legislature. The Senate was called to order at 10:06 a.m. by the Honorable John B. "Jack" Coghill, Lieutenant Governor. Members of the Downtown Juneau Boy Scout Troop No. 11, J. R. Wilcox, Kevin Nault and Leif Leegard, presented the colors and led the Senate in the Pledge of Allegiance. The prayer was offered by the Chaplain, Rev. Larry Olson of the Resurrection Lutheran Church. Senator Taylor moved and asked unanimous consent that the prayer be spread. Without objection, it was so ordered. Our Lord and Creator, We come to the beginning of another legislative session. We thank You that all have arrived in Juneau safe and sound. We pray that these Senators and people on their staffs have found suitable housing. Lord, these Senators come together with the highest of intentions. There's just a chance that all these intentions do not run in the same direction. PRESIDENT President pro tempore Kelly announced that nominations for permanent President of the Senate were open. Senator Taylor moved that Senator Halford be nominated President of the Senate for the Eighteenth Legislature. Senator Adams objected. The question being: "Shall Senator Halford be elected President of the Senate for the Eighteenth Legislature?" The roll was called with the following result: Shall Senator Halford be elected as President of the Senate? EO 81 Letter dated January 11, 1993 was received from the Governor transmitting EXECUTIVE ORDER NO. 81: Under the authority of art. III, sec. 23, of the Alaska Constitution, I am transmitting an Executive Order relating to the Alaska Science and Technology Foundation (ASTF) and the science and engineering advisory commission. The Order transfers the ASTF from the Department of Revenue to the Department of Commerce and Economic Development. The purpose of this transfer is to integrate the state's science and technology activities within the state agency responsible for the comprehensive economic development of the State of Alaska. The Order also eliminates the science and engineering advisory commission (located in the Office of the Governor) and consolidates its functions and duties with those of the ASTF. The ASTF has the knowledge and the resources to serve in an advisory capacity to the Governor and the Legislature as well as to perform the original functions of the foundation. These two transfers will serve to streamline the state's commitment to the development of resources through the application of science and technology. III, sec. 23, of the Alaska Constitution, I am transmitting an Executive Order transferring from the Department of Commerce and Economic Development to the Department of Revenue the functions relating to the regulation of games of chance and skill under AS 05.15. These activities require close supervision, including auditing of financial records. I believe that the transfer accomplished by this Executive Order will increase the efficiency and effectiveness of that supervision. EO 83 Letter dated January 11, 1993 was received from the Governor transmitting EXECUTIVE ORDER NO. 83: Under the authority of art. III, sec. 23, of the Alaska Constitution, I am transmitting an Executive Order merging the State Geographic Board (AS 44.19.054 - 44.19.062) and the Historic Sites Advisory Committee (AS 41.35.110 - 41.35.190) into the Alaska Historical Commission (AS 41.35.300 - 41.35.380). The commission will remain in the Department of Natural Resources, where the Historic Sites Advisory Committee is also located. 1993-01-11 Senate Journal Page 0029 EO 83 I believe that this change will have several benefits to the state. First, it will place in one entity, instead of three, the closely related functions of recognizing and presenting Alaska's history, evaluating and approving historical sites in the state, and naming geographic places, which often involves names of historical figures, places, and events. Second, it will increase public access because the public will know that any historical concerns can be addressed to the merged entity; the public will not have to figure out which of three entities is the appropriate one for a specific matter. Finally, the consolidation will save money because the single resulting entity will have far fewer members than do the three existing ones combined. Sec. 8 of the Order repeals and reenacts AS41.35.310(5) which is identical in substance to existing AS41.35.320. EXECUTIVE ORDER NO. 83 was referred to the Resources Committee and the Finance Committee. EO 84 Letter dated January 11, 1993 was received from the Governor transmitting EXECUTIVE ORDER NO. 84: Under the authority of art. III, sec. 23 of the Alaska Constitution, I am transmitting an Executive Order merging the Alaska Women's Commission and the Alaska Commission on Children and Youth into a new Alaska Human Relations Commission. The consolidated commission will consist of seven public members and two executive-branch members, appointed by the Governor. The unification of duties and functions of the Alaska Women's Commission and Alaska Commission on Children and Youth into an Alaska Human Relations Commission will result in coordinated programs related to the welfare of children, youth, women, and families, and will maximize the effectiveness of available federal and state funds. This action does not require any budgetary increase, and has a zero fiscal note. However, I believe an increased budget is warranted. EO 85 Letter dated January 11, 1993 was received from the Governor transmitting EXECUTIVE ORDER NO. 85: Under the authority of art. III, sec. 23, of the Alaska constitution, I am transmitting an Executive Order transferring the fish bonding program from the Department of Labor to the Department of Revenue. Under that program, fish processors and primary fish buyers are required to post a bond to ensure that money is in place for the payment of wage claims, claims from commercial fishermen selling their catch, and unemployment insurance contributions. This program would be more efficiently run under the Department of Revenue because the enforcement mechanism is under that department and that department already operates a similar bonding program for fishery business licenses to ensure payment of fish taxes. EXECUTIVE ORDER NO. 85 was referred to the Labor and Commerce Committee and the Finance Committee. 1993-01-11 Senate Journal Page 0031 EO 86 Letter dated January 11, 1993 was received from the Governor transmitting EXECUTIVE ORDER NO. 86: Under the authority of art. III, sec. 23, of the Alaska Constitution, I am transmitting an Executive Order relating to the division of fisheries rehabilitation, enhancement and development (FRED), a division of the Department of Fish and Game. In recent years, the role of the FRED division has undergone significant change. The division's main responsibility, at its inception in the early 1970's, was to construct and operate fish hatcheries owned by the state. Today, the operation of most of these hatcheries either has been or is now being transferred to private contractors and to the sport fish division. Other primary duties of the FRED division, such as fisheries planning and technical services to the salmon ocean ranching and emerging mariculture (shellfish) industries, can be performed more efficiently by integrating these duties within other divisions of the department. Recent budget cuts require the department to streamline its operations and eliminate any overlapping functions. This Executive Order, which transfers the duties of the division to the department, will give the department flexibility to accomplish these goals. EO 87 Letter dated January 11, 1993 was received from the Governor transmitting EXECUTIVE ORDER NO. 87: Under the authority of art. III, sec. 23, of the Alaska Constitution, I am transmitting an Executive Order relating primarily to the leasing of space for state agencies and the allocation and maintenance of space in state facilities. 1993-01-11 Senate Journal Page 0032 EO 87 The Order transfers, from the Department of Administration (DOA) to the Department of Transportation and Public Facilities (DOT/PF), the authority to execute leases for state facilities and to allocate space among state agencies. The Order also consolidates facilities management activities of the Department of Corrections (DOC) (related to prison industries) and the Department of Health and Social Services (DHSS) (related to juvenile corrections facilities) in DOT/PF. These transfers of authority are necessary to allow the state to manage its leasing activities consistent with the long-term management of all of its public facilities. Under existing law, DOT/PF has broad authority to plan, construct, and manage state-owned facilities. However, many state agencies are housed in buildings leased from the private sector. Under the Executive Order, the private sector will still play a critical role in providing space for state agencies. What will change is the way the state analyzes leases of space and reaches its leasing conclusions. The result will be "smarter" decisions that better consider the state's long-term needs and ensure that the state gets the best bargain for its money. The Order also transfers to DOT/PF from DNR the disposal authority for lands acquired by DOT/PF under AS35.20.010 - 35.20.070. This transfer is appropriate for consolidated facilities management because it enhances the state's ability, without increased administrative expense, to participate in modern leasing mechanisms. Under the Order, one agency, DOT/PF, will be responsible for land acquisition for public facilities and for procurement of the facilities, either through construction or leasing. Under one common technique for leasing buildings, the lessee conveys land to a developer, who constructs a building that the lessee then occupies under a lease/purchase agreement. Under existing authority, the state could use this technique only if DOT/PF acquired the land, DOA selected the lessor, and DNR conveyed interests in the land to the developer. This process is greatly simplified under the Order and will enable this type of conveyance to occur in a timely fashion at reduced cost, while still protecting the public interest. 1993-01-11 Senate Journal Page 0033 EO 87 The transfers made by this Executive Order will consolidate and streamline the state's facilities management activities. These transfers further the public interest and lead to a more intelligent use of the state's financial resources.
