SB 79 ADJUSTMENTS FOR DEFECTIVE SURVEY
CHAIRMAN TORGERSON called the Senate Community & Regional Affairs
Committee meeting to order at 1:38 p.m.
SENATOR TORGERSON brought SB 79 back before the committee and noted
the committee adopted a committee substitute at the previous
meeting on the legislation.

SENATOR R. PHILLIPS moved that CSSB 79(CRA) be passed out of
committee with individual recommendations. Hearing no objection,
it was so ordered.
CSHB 80(CRA) DNR APPROVAL OF PLATS IN UNORG BOROUGH
SENATOR TORGERSON brought CSHB 80(CRA) (DNR APPROVAL OF PLATS IN
UNORG BOROUGH) before the committee as the next order of business.
WALT WILCOX, staff to Representative Jeannette James, explained
that currently there is no legal authority to review plats in the
unorganized boroughs for compliance with state law. This means
there is no agency review of access to each lot, which results in
landlocked lots being created.
Currently, "paper plats" are allowed to be recorded without being
surveyed, and HB 80 corrects this situation by requiring the
Department of Natural Resources to review plats for compliance with
state law.
Also, there are several definitions of "street" and "subdivisions"
in various statutes and HB 80 defines them as requested by the
Department of Natural Resources.
Mr. Wilcox directed attention to a proposed amendment requested by
the Department of Natural Resources.

PATRICK KALEN, testifying from Fairbanks, said his concern in the
past has been with the definition of "subdivision" and he concurs
with the suggested change made by DNR to its definition.

RON SWANSON, Director, Division of Land, Department of Natural
Resources, speaking to the proposed amendment, said some of the
things in the amendment relate to the definition of "subdivision."
He has discussed the amendment with the Department of
Transportation, Department of Community & Regional Affairs, as well
as the survey community, specifically Mr. Kalen, and they all agree
with the changes made in the amendment.

SENATOR KELLY moved the adoption of the following amendment to CSHB
80(CRA):
Amendment No. 1
Page 7, lines 17 - 18: Delete ",except for land owned by
corporations organized under P.L. 91 - 203,"
Page 7, lines 18 - 19: Delete "or common carrier access" and
insert "access, excluding common carrier and public utility access"
Page 7, line 22: Delete "corporations organized under P.L. 92 -
203" and insert "plats created by or on behalf of the United States
Department of the Interior, Bureau of Land Management,"
Page 7, line 23: Following "dedications" through line 27 delete
all material except the semicolon.
Hearing no objection to the motion, SENATOR TORGERSON stated the
amendment was adopted and would be incorporated into a C&RA SCS.
There being no further testimony on the legislation, SENATOR
TORGERSON asked for the will of the committee.

SENATOR KELLY moved that SCS CSHB 80(CRA) and the accompanying
fiscal notes be passed out of committee with individual
recommendations. Hearing no objection, it was so ordered.
There being no further business to come before the committee,
SENATOR TORGERSON adjourned the meeting at 1:47 p.m.
