Legislative Resolve No. 5 HB 48 The following letter dated October 11 was received at 11:56 a.m.: "Dear Speaker Edgmon: Under the authority vested in me by Article II, Section 15, Constitution of the State of Alaska, I have vetoed the following bill: CS FOR HOUSE BILL NO. 48(FIN) am "An Act removing from the exempt service of the state persons who are employed in a professional capacity to make a temporary or special inquiry, study, or examination as authorized by the governor and including those persons in the partially exempt service of the state; repealing the authority of the governor or a designee of the governor to authorize higher pay than is otherwise allowable for certain partially exempt employees in the executive branch; requiring the commissioner of administration to submit a report to the legislature; and providing for an effective date." HB 48 proposes to reclassify persons that are employed in a professional capacity to make temporary or special inquiry, as authorized by the Governor, from exempt service to the partially 2019-10-23 House Journal Page 1372 exempt service. This reclassification to partially exempt service requires the use of the statutory salary schedule, PERS, healthcare benefits, and leave accrual. It would also require these employees to be tracked for budgetary and position count purposes. These positions, intended to be temporary, were established and never moved from “temporary” to “permanent” even though they may be open, two, three, or four years. Also, not all agencies account for these temporary positions in their position count or budget. By moving these positions to the partially exempt or classified service, it provides more transparency in hire and equal application of statutory pay schedules and benefits for state employees. The Department of Administration supported this approach and included this same provision in legislation introduced at the request of the Governor pertaining to certain public employees. However, HB 48 also repeals AS 39.27.011(k). This provision grants the Governor the authority to authorize a higher pay step for certain partially exempt employees. The authorization must be based on the determination that the action serves a critical governmental interest of the state, the employee possesses exceptional qualifications, recruitment difficulties existed, or the action is necessary due to competitive salaries in the relevant labor market. The determination must be in writing. AS 39.27.011(k) was enacted into law in 2013, as part of a broader personnel undertaking. It provides agencies with a valuable tool to recruit candidates with specialized skills or senior level experience for positions that are classified as partially exempt. Oftentimes, using this section is the only way the State can offer salaries that compete with the private sector to attract highly qualified individuals. The repeal of AS 39.27.011(k) was proposed through the committee process so that when the temporary exempt positions were reclassified to temporary partially exempt positions, it could not be used to override statutory salary schedules. It was adopted with the intent of closing a potential loophole. However, the unintended consequence of repealing AS 39.27.011(k) is that a valuable tool is removed from state agencies in their ability to 2019-10-23 House Journal Page 1373 recruit and hire individuals with specialized skills or experience. Cuts are difficult and have a real impact on Alaskans, but if expenditures continue to exceed existing revenues, all Alaskans will be faced with taxes or much more dramatic core service impacts once all savings reserves are exhausted. Keeping this in mind, my administration worked to make a number of difficult, but necessary, decisions. This budget was thoroughly evaluated, and my policies were applied consistently across the board. It is critical that we get our fiscal house in order and provide a secure and stable future for Alaskans. House Bill (HB) 2001 as passed by the legislature, added $375 million to the FY 2020 operating budget, which represents an unsustainable level of spending. Through line-item vetoes to HB 2001, I have reduced the spending by $220 million. With these vetoes, the FY 2020 operating and mental health budget, including previously enacted legislation, is $4,193,039,800 Unrestricted General funds (UGF), $883,622,700 Designated General funds (DGF), $702,100,200 Other State funds, and $2,700,205,600 Federal funds. Attached are reports that summarize the line-item vetoes. The line-item vetoes in this bill include: the elimination of unconstitutional commitments of future year funding; the elimination of optional Medicaid services to ensure adequate funding for federally-required Medicaid programs; and the elimination of debt payments on behalf of other entities, which are not a core function of the State. The State's fiscal reality dictates a reduction in expenditures across all agencies. My administration also worked with key stakeholders to identify critical items in HB 2001 to retain including: early learning programs, the senior benefits program, funding to assist victims of sexual assault and domestic violence, and funding to the Department of Fish and Game that is necessary to leverage Federal funds. 2019-10-23 House Journal Page 1375 This budget focuses on the State's basic responsibilities, in light of our fiscal constraints. This is one step in the right direction – setting Alaska on the path to fiscal stability while acknowledging additional actions, over multiple years, are needed. This includes working closely with the University of Alaska and the Board of Regents on a step- down approach to reduce their general fund spending by $70 million over three years starting in FY 2020. More work will need to be done in the months ahead and during the next legislative session. Finally, this bill appropriates $1 billion from the Earnings Reserve Account and funds an estimated $1,600 Permanent Fund Dividend. Again, this is one step in the right direction, and I look forward to working with the Legislature to ensure Alaskans receive a full statutory dividend. I am committed to working with the Legislature to address state spending, to eliminate our deficit over time, and to put Alaska on a path to a long-term sustainable, predictable, and affordable fiscal plan. Chapter No. 28, SLA 2019 Effective Date: December 26, 2019 SB 2002 The following letter dated August 8 was received at 10:07 a.m.: "Dear Speaker Edgmon: On this date, I have signed, with line-item vetoes, the following bill passed during the Second Special Session of the Thirty-First Alaska State Legislature and am transmitting the engrossed and enrolled copies to the Lieutenant Governor's Office for permanent filing: 2019-10-23 House Journal Page 1381 CS FOR SENATE BILL NO. 2002(FIN) "An Act making appropriations, including capital appropriations, supplemental appropriations, reappropriations, and other appropriations; amending appropriations; making appropriations to capitalize funds; making appropriations for the capital expenses of the state's integrated comprehensive mental health program; making appropriations under art. IX, sec. 17(c), Constitution of the State of Alaska, from the constitutional budget reserve fund; and providing for an effective date." Chapter No. 1, SSSLA 2019 [Effective Date: See Chapter] Senate Bill 2002 (SB 2002) as passed by the legislature, contained operating and capital appropriations totaling nearly $183 million, including $176.6 million in funding directly from the Constitutional Budget Reserve Fund (CBR). Through line-item vetoes to SB 2002, I have reduced the proposed draw on the CBR by $30.5 million. These vetoes represent a balance between protecting our reserves while maintaining a minimum level of capital budget funding. This budget supports jobs and families; ensures federal funds are not forfeited; and advances critical road, infrastructure, and life, health, and safety projects in communities across Alaska. Mischel, Revisor of Statutes, was received: "The repeal of AS 47.07.076(c) under sec. 53, ch. 25, SLA 2016, has taken effect August 15, 2019. Under sec. 61(f), ch. 25, SLA 2016, this repeal would only take effect if the Commissioner of Health and Social Services certifies to the revisor of statutes that the United States 2019-10-23 House Journal Page 1383 Department of Health and Human Services certified the Medicaid Management Information System. Under sec. 66, ch. 25, SLA 2016, if the certification is made, the repeal of AS 47.07.076(c) takes effect the day after the certification to the revisor is made. On August 14, 2019, this certification was sent to me. Therefore, the effective date of the repeal of AS 47.07.076(c) is August 15, 2019. Please publish this in the journal to provide notice of this effective date."
