The budget I presented for legislative consideration and the budget I sign today reflect those priorities. House Bill 284, as passed by the Legislature, contained appropriations for Fiscal Year 2012 and Fiscal Year 2013 totaling $12.0 billion, of which $6.6 billion is unrestricted general fund. The budget includes special appropriations for tax credits, revenue sharing, and direct deposits to the retirement system costs, and includes funding for public education, the university, public health and safety, transportation, resource development, and funding for State government programs, services, and grants. 2012-09-25 Senate Journal Page 2469 In addition, HB 284 saves for Alaska's future. HB 284 includes appropriations of $2.0 billion to the Statutory Budget Reserve, $1.1 billion to forward fund K-12 education in FY 2014, and $1.5 billion for inflation proofing of Alaska's Permanent Fund and Permanent Fund Dividends. Through line-item vetoes, I have reduced a limited number of appropriations in HB 284, totaling $54.1 million. The following describes the reasons for the vetoes, which are also detailed in the enclosed spreadsheet. Judicial Retirement System (JRS) - Let me be clear that we have met and will continue to meet our obligations to our retirees. The FY 2013 budget includes $613.9 million for the actuarially required payments for all of our systems - JRS, PERS, and TRS. These payments will continue. However, I have vetoed the additional lump sum appropriation to the judicial retirement system to pay down the unfunded liabilities of the system for several reasons. This appropriation would not fully pay down the current unfunded liability for JRS, which has now grown to $58 million. In FY 2008, the Legislature deposited $49 million into the JRS trust fund. Due to market volatility, the liability quickly returned. Unusual volatility continues to be a reality in the investment markets. Additionally, unless good reason exists to the contrary, we should address each of the State's retirement systems consistently. Rather than taking this $50 million off the table at this time for JRS alone, it is in Alaska's interest to further evaluate whether changes are needed with respect to how we address the unfunded liabilities of PERS, TRS, and JRS. We should continue to explore together the best ways of meeting our goals of maintaining the health of the funds and managing the State's costs over time. I am committed to working with you on this endeavor. Early Learning Coordination - This year, I have approved an increase of $3,867,500 for early learning programs - a 38 percent increase in funding over the current year. The enclosed chart illustrates the growth in early learning programs over the past four years. Funding for the line item designated Alaska's Statewide Pre- Kindergarten Program has increased from $1.7 million in the current year to $2.5 million in FY 2013, a 47 percent increase. We are also 2012-09-25 Senate Journal Page 2470 increasing Pre-K efforts by $2 million through the Moore settlement for Alaska's most vulnerable schools. Funding for Parents as Teachers (PAT) has been increased from $300,000 to $1,042,500 in the next fiscal year. I have reduced the fiscal impact for the newly approved pilot project created by passage of SB 182, to reflect a realistic start up for the program. PAT is a new program, and the three year pilot will provide the data needed to evaluate the success of the project, rather than allow explosive growth from the outset. In signing the budget, I also approved one-time funding for the North Slope Borough School District (NSBSD) for curriculum alignment, integration, and mapping. It is unusual for this type of project to be included in the operating budget, and it is not my intention to encourage school districts to seek designated grants. These projects are typically conducted with school district's foundation formula funding. However, I believe this project will provide valuable tools for other Alaska school districts, and I have asked the Department of Education and Early Development to work closely with the NSBSD to make this resource available to other districts as a condition of receiving State funding. Finally, I have deleted Sections 20(f) and 35 regarding implementation funding for the Alaska coastal management program initiative, contingent upon approval by the voters during the August primary election. Prefunding an unpassed initiative is inconsistent with historical practice. The Administration will request funding for program implementation, if necessary. Building on the success we were able to achieve this legislative session on the budget, I look forward to further refining our spending targets for both the operating and capital budget in the future. I was pleased legislators agreed with and stuck to my spending limit on overall capital spending. I also appreciate the detailed legislative consideration of the budget as well as the work of our Administration members on these appropriations. HCS CSSB 160 (FIN) am H, as passed by the Legislature, contains capital appropriations for Fiscal Year 2012 and Fiscal Year 2013, totaling $2.9 billion, including $1.9 billion in general funds. The capital budget will fund many important transportation and infrastructure projects across the state. More than $1.6 billion was appropriated for highways, aviation, the Alaska Marine Highway, harbors, village safe water, and municipal water and sewer projects. Funding is also included for statewide energy projects such as weatherization programs to help Alaskans make their homes more energy efficient, renewable energy projects that target areas with the highest energy costs, and home energy rebates. Through line-item vetoes, I have reduced a limited number of appropriations in SB 160, totaling $12.6 million. The following describes the reason for the vetoes, which are also detailed on the enclosed spreadsheet. Behavioral Health Grants for Substance Abuse Treatment Programs - Even with vetoed amounts, I have approved a $9 million increase to provide programs and services to vulnerable populations 2012-09-25 Senate Journal Page 2473 over a three year period, and an additional $1.3 million in the Department of Corrections operating budget for substance abuse treatment. As a reference point, Alaska spends over $50 million annually on substance abuse programs including detox, residential treatment, outpatient treatment, and opioid treatment for approximately 7,100 individuals. In adding money to this area, the Legislature did not provide detailed backup on how the appropriation was to be spent. After consulting with the Department of Health and Social Services, the Department has outlined specific projects that target treatment and services for pregnant women, families at risk, integration of intervention and screening programs, drug therapy for high risk individuals, and low-cost, effective substance abuse therapy delivered via technology for rural locations. These projects will be part of a three year effort, and will be evaluated on an annual basis, to determine the effectiveness of the efforts. The increased funding remaining after vetoes is sufficient for the Department's three year plan. ASD Pre-Kindergarten Project Expansion - This year, I have approved an increase of $3,867,500 for early learning programs - a 38 percent increase in funding over the current year. The enclosed chart illustrates the growth in early learning programs over the past four years. After accepting these increases, I vetoed the Anchorage School District's request to be the sole recipient of a Pre-K grant in the capital budget. This project is more appropriately funded in the Department of Education and Early Development's Pre-K statewide program, and considered in the context of all the districts in the state. Simply put, we need not open the floodgates in the coming years to individual districts seeking designated grants in this statewide program. Alaska Moose Federation (AMF) Moose Rescue and Relocation Program - I have supported and continue to support the AMF's work in the statewide moose salvage program and its orphaned calf rescue efforts. I cannot at this time, however, support AMF's desire to relocate adult moose between various game management units. Additional evaluation and coordination is needed between AMF and the Department of Fish and Game to determine if a large-scale 2012-09-25 Senate Journal Page 2474 relocation program can be conducted in a scientifically sound manner and achieve the desired result of supplementing low-density moose populations in rural Alaska. This appropriation has been reduced to $500,000 to cover orphaned calf rescue efforts. World Trade Center Alaska (WTC) - International Trade Partnership Project - The WTC has received previous State appropriations, and still has a sufficient balance on hand of existing funds to continue its efforts in the next fiscal year without additional grant funds. Additionally, with respect to State funding currently in the WTC's hands, the State has been unable to obtain adequate information sufficient to assure appropriate accountability. The WTC will need to develop a more detailed business plan and provide more information before requesting additional funding in a future budget. These capital dollars will create jobs and opportunity for Alaskans, meet the State's constitutional responsibilities of resource development, education, public safety, and infrastructure essential to Alaska's economic future, and address high-priority projects in districts across the state. Existing Alaska law provides for a mitigating factor in sentencing a defendant who suffers from a "mental disease or defect" if other circumstances are present. Some courts have found that fetal alcohol spectrum disorder falls within the term "mental disease or defect," but other courts have found to the contrary, thereby creating disparity. Shorter sentences may not deter further offenses without additional treatment. The bill does not change the primary statutory duties, enforcement responsibilities, or focus of the ABC Board from regulating this industry. Some testimony during legislative hearings expressed concern that moving the ABC Board could decrease its enforcement abilities. However, law enforcement agencies, both State and local, will continue to enforce Alaska liquor laws, and the legislative record contains testimony that the ABC Board will continue to perform enforcement and oversight duties wherever it is housed. The laws being enforced by the ABC Board are virtually unchanged by the move - the ABC Board would merely be organized in a different department for administrative purposes only. I am not convinced that merely moving an independent board for administrative purposes will be detrimental to law enforcement. Nor am I convinced that this move will cure all ills identified by the legislation's supporters. On balance, however, I am deferring to the Legislature's judgment. I assume the ABC Board and law enforcement will work together effectively, ensuring enforcement and oversight will not be diminished, and the Department of Public Safety will continue its mission to vigorously enforce all of Alaska's public safety laws. If our underlying information and facts turn out to be different from the reality of regulating this industry in the public interest, then I will remain open to revisiting the placement, organization, and structure of the ABC Board. Chapter No. 63, SLA 2012 [Effective Date: See Chapter] Autism spectrum disorders (ASD) are far too common, and these disorders pose significant health and economic challenges for those with ASD and their family members. Additionally, if not diagnosed and treated from an early age, ASD place a significant financial burden on the State for education, medical, and other personal costs. In Alaska, when insurance companies offer health care policies for sale, they are currently required to provide coverage for about 15 procedures and conditions, including mammograms and treatment for diabetes. Statutory coverage requirements for insurance products are designed to avoid costs and suffering that can otherwise be avoided. This legislation exempts approximately 20,000 small Alaska businesses from its impacts, and that is where the complexity begins. For while the legislation exempted many of Alaska's small businesses, the legislation does require insurance companies to provide ASD 2012-09-25 Senate Journal Page 2496 coverage in health care policies purchased by larger employers in the private market. In that context, most of the legislative committee testimony and record focused on the estimated costs and benefits of requiring coverage for autism spectrum disorders. No independent, peer reviewed actuarial analysis of SB 74 was conducted. However, estimated premium cost increases ranged from 0.1 percent to three percent, depending on coverage definitions and assumptions used. The only objective, peer-reviewed study related to costs of this new policy was conducted by Oliver Wyman, an actuary. Wyman concluded the estimated increase in premium (in California) for requiring ASD coverage would range from 0.1 percent to 0.75 1 percent in the first five years. Perhaps even more persuasively, the Wyman study discussed the long term benefits of early diagnosis, intervention, and treatment of ASD. It noted an oft-cited report saying that the incremental societal cost of autism is $3.2 million per capita in 2 2003 dollars. Opponents of SB 74 testified that premium costs could go up by three percent annually, but they made the assertion without detailed analysis or justification for that number. Moreover, the legislation's opponents failed to present any analysis debunking the proponents' arguments of societal cost savings under the legislation. In the future, I will remain open to amending this law upon more compelling evidence that the proponents' assumptions were misplaced. However, without substantiated evidence on the record to the contrary, I defer to the weight of testimony and analysis, as well as the Legislature's judgment, to conclude that the long-term cost savings of discovering and intervening in ASD early in a person's life justify letting this legislation become law. Research has given these families much hope because the disorder, while not curable, is treatable; many children can make significant progress by early intervention with essential services. This will likely diminish the education costs, medical costs, and increase lifelong productivity of many individuals, including family members, all interests beneficial to the State. Few today would dispute that mandatory coverage in Alaska for mammograms has staved off suffering and societal costs. The same argument has won the day here for ASD.
