"Dear Speaker Chenault:                                                                                                         
                                                                                                                                
Under the authority of Article III, Section 18, of the Alaska                                                                   
Constitution, I am transmitting a bill establishing a tax credit against                                                        
Alaska income taxes for qualified research and development                                                                      
conducted by corporate taxpayers.                                                                                               
                                                                                                                                
Innovation can be an expensive, intricate, and time-intensive                                                                   
enterprise. However, it also can spark a chain of investments in capital                                                        
equipment, workers, and spillover activities into multiple economic                                                             
sectors. In effect, the research and development tax credit would                                                               
stimulate private-sector investment, entrepreneurial activity, and                                                              
business expansion in Alaska that will bring opportunity and                                                                    
sustainable long-term benefits to our economy.                                                                                  
                                                                                                                                
The credit would be 20 percent of qualified research and development                                                            
expenditures that exceed the average qualified research and                                                                     
development expenditures as defined in 26 U.S.C 41(d) (Internal                                                                 
Revenue Code) for the three years immediately preceding the year in                                                             
which the credit is claimed. Unused credits may be carried forward for                                                          
up to seven years after the expenditure for which the credit is claimed.                                                        
The bill also would impose a reporting requirement so that the                                                                  
Legislature and the public are aware of the fiscal impact and economic                                                          
benefits of the research and development credit to the state.                                                                   
                                                                                                                                
The credit would induce corporations to conduct independent research                                                            
in Alaska. For this reason and others, the credit is supported by the                                                           
Department of Commerce, Community, and Economic Development                                                                     
Advisory Council, which has been directed to identify means to induce                                                           
investment and help increase the viability of business. Other                                                                   
supporters of the tax credit include Alaska businesses and chambers of                                                          
commerce, as well as municipalities and economic development                                                                    
councils. This initiative also parallels efforts by the Anchorage                                                               
Economic Development Corporation to establish relationships with                                                                
corporations looking to relocate to favorable locations in Alaska.

"Dear Speaker Chenault:                                                                                                         
                                                                                                                                
Under the authority of Article III, Section 18, of the Alaska                                                                   
Constitution, I am transmitting a bill to provide the Alaska Industrial                                                         
Development and Export Authority (AIDEA) with more flexibility to                                                               
encourage greater investment and Alaska resource development. This                                                              
bill would amend AS 44.88.172(a) to enable AIDEA to invest directly                                                             
in a corporation or limited liability company which holds a                                                                     
development project as its sole asset. Under its strategic plan, AIDEA                                                          
works to encourage other investors to join in financing development                                                             
projects, and to do so, must establish working relationships with those                                                         
other investors. The proposed legislation will accomplish that goal by                                                          
providing greater flexibility in how AIDEA and other investors may                                                              
jointly invest in development projects.                                                                                         
                                                                                                                                
This bill would expand the types of development projects for which                                                              
AIDEA may own and operate. Under existing law, development                                                                      
projects are basically limited to projects related to making, processing,

or transporting goods or products; developing or transporting natural                                                           
resources; generating or transmitting energy; and infrastructure for                                                            
tourism destination facilities. This bill would expand the definition of                                                        
"project" to include projects which enhance or promote economic                                                                 
development. The project must also be associated with transportation,                                                           
communications, community public purposes, technical innovations,                                                               
prototype commercial applications of intellectual property, or                                                                  
research. Second, the definition of "project" would expand to include                                                           
federal facilities, including a United States military, National Guard,                                                         
or Coast Guard facility, and would also clarify that a component of a                                                           
project may be a road.                                                                                                          
                                                                                                                                
In addition, this bill amends the procurement code (AS 36.30.015(f))                                                            
to empower AIDEA to adopt regulations to govern AIDEA's                                                                         
procurement of supplies, services, professional services, and                                                                   
construction.

Under the authority of Article III, Section 18, of the Alaska                                                                   
Constitution, I am transmitting a bill creating a new markets tax credit                                                        
assistance guarantee and loan program within the Alaska Industrial                                                              
Development and Export Authority (AIDEA).                                                                                       
                                                                                                                                
This legislation will enable AIDEA to foster more economic                                                                      
development in Alaska, especially in areas with great need for new                                                              
investment. Under this legislation, AIDEA could issue guarantees and                                                            
make loans to help finance projects funded through a federal new                                                                
markets tax credit program. This federal program offers a competitive                                                           
process by which federal new markets tax credits are allocated to                                                               
support the nationwide financing of projects located in low income                                                              
areas or otherwise serving low income populations. The federal                                                                  
program arises under Section 45D of the Internal Revenue Code, and                                                              
provides for the allocation of new markets tax credits equal to 39                                                              
percent of total qualifying investments, payable over seven years. The                                                          
tax credits provide a present value investment return of approximately                                                          
30 percent of the amount of the qualifying investment, and can                                                                  
substantially reduce the financing costs for a project.                                                                         
                                                                                                                                
Investments made under the federal new markets tax credit program                                                               
generally would fund only a portion of total project costs. The balance                                                         
of the funding must come from other loans or financing. There is a                                                              
scarcity of capital available and this legislation would enable AIDEA                                                           
to issue guarantees and make loans to assist in funding amounts not                                                             
covered by investments made under the federal program.                                                                          
                                                                                                                                
The proposed legislation requires AIDEA to evaluate the commercial                                                              
reasonableness of the underlying loan AIDEA would guarantee to                                                                  
determine that the project will promote economic development and                                                                
requires the financial institution to service the guaranteed loan.

Constitution, I am transmitting a bill establishing the Alaska microloan                                                        
revolving loan fund, the mariculture revolving loan fund, and the                                                               
commercial charter fisheries revolving loan fund, and relating to those                                                         
funds.                                                                                                                          
                                                                                                                                
This bill would create the Alaska microloan revolving loan fund, the                                                            
mariculture revolving loan fund, and the commercial charter fisheries                                                           
revolving loan fund, within the Department of Commerce,                                                                         
Community, and Economic Development. Structured as revolving                                                                    
loan funds, all earnings and loan payments would be retained by the                                                             
funds for future loans. All operating expenses would also be paid from                                                          
earnings of the fund.                                                                                                           
                                                                                                                                
This legislation will promote economic development in Alaska by                                                                 
helping small businesses access critical capital. The Alaska                                                                    
Microloans are modeled after a program currently operated through                                                               
the federal Small Business Administration (SBA) and available in                                                                
almost every other state to provide small, short term loans to small                                                            
businesses. This federal program, however, is currently unavailable in

Alaska because an intermediary lender is required. To date no lenders                                                           
meeting the SBA's qualifications have been identified in Alaska.                                                                
                                                                                                                                
A critical sector of Alaska's coastal economy is mariculture. Currently,                                                        
access to start-up capital by Alaska's mariculturists is extremely                                                              
limited because of the time needed for crop development and market                                                              
readiness. Due to the unique cash flow characteristics inherent in the                                                          
industry, access to capital with flexible terms is essential. This                                                              
legislation will promote economic development, allow the industry to                                                            
expand, and successfully compete in world seafood markets.                                                                      
                                                                                                                                
On January 5, 2010, the North Pacific Fisheries Management Council                                                              
published a final rule implementing a halibut charter fisheries limited                                                         
entry program. Based on past fishing history, it is expected that 40                                                            
percent of those applying for the permit, will be denied under NOAA's                                                           
restrictions, escalating permit prices. In an effort to make financing                                                          
available to Alaskans for the purchase of halibut charter permits, a                                                            
new loan fund has been developed that is similar to the highly                                                                  
successful commercial fishing revolving loan fund (AS 16.10.340).                                                               
This will ensure those valuable permits remain in Alaskans' hands.
