[Chapter No. 20, SLA 2008 Effective Date: July 18, 2008] The people of the state of Alaska have expressed to me their serious concerns about any fostering of gambling in Alaska and the social ills that may result to Alaska's families and communities. I agree with those concerns. However, I recognize that state law currently permits the activity of charitable gaming in Alaska. Charitable gaming provides valuable financial support to our schools, law enforcement organizations, and even youth sports activities. I consider this bill as making tailored changes to improve the operations of charitable gaming in this state. The bill does not further for-profit gambling, which I do not support. For these reasons I have not signed this bill and have allowed it to become law without my signature. This letter (with enclosed reports) meets that requirement. 2008-05-30 House Journal Page 3021 Thanks to the hard work the Authority put into presenting its recommendations as transactions in the state's budget system, the process of identifying differences between recommendations and appropriations is far more efficient and accurate than in the past. For reporting purposes, we have added salary adjustments associated with bargaining agreements to the Authority's recommendations. Although the adjustments could not be included in the Authority's recommendations because they were not known until after the recommendations were approved, we consider the $2.4 million in adjustments to be a technical issue without policy implications. The $29,200 difference in the enclosed report on salary adjustments is attributable to Labor Trades and Crafts increases that were approved too late to include in the mental health bill (they were added to the capital bill). Operating Appropriations This letter and enclosures describe changes made by the Governor and the legislature to the FY09 Mental Health Trust Authority's budget recommendations for operating expenditures. Recommendations affect four fund sources: 1. Administrative funds (MHT Admin), which cover Authority operations; 2. Authority receipts (MHTAAR), which the Authority provides to state agencies at the option of the Authority; 3. Alcohol and other drug abuse treatment funds (A/D T&P), which are classified in the mental health fund group; and 4. General funds for programs that support Trust beneficiaries (GF/MH). Although providing information on the first three of the above four fund sources is not a legal requirement, the Authority expressed interest in receiving reports showing differences all mental health funds. The Authority's recommendations for administrative and alcohol/drug abuse funds were accepted as submitted. The legislature authorized expenditure of $1.6 million more in Trust Receipts than recommended by the Authority and appropriated $11.9 million more in GF/MH than recommended by the Authority. 2008-05-30 House Journal Page 3022 Detailed changes appear in the attached component and transaction reports. Allocation reports (one for each fund source in the mental health group and one for the group as a whole) can be used to identify where changes occurred; the transaction detail report provides more specific information. Highlights include Increases · ProShare replacement of federal receipts with GF: $9.3 million; · FMAP replacement of federal receipts with GF: $5.3 million; · Health care provider rate increases $4.2 million; · Health care program $3.3 million; · Medicaid growth $3.0 million; · SCHIP (Denali KidCare) $900,000 Reductions The Legislature did not accept (and the Governor did not request) the Authority's recommendations for the following programs: · $2,080,000 for Behavioral Health Provider grant increases; · $2,000,000 for Enhanced Behavioral Health Services. Capital Appropriations General Fund Mental Health Funds The Governor's request was $2.1 million less than the Authority's $6.7 million Mental Health capital request. The legislature reduced the capital budget by an additional $2.5 million. The major difference- $4.6 million-is attributable to items that were not included in the Governor's budget and not considered by the legislature. Those projects include the Family and Community Elder Supports (FACES) $2.0 million, Deferred maintenance and ADA improvements grants $2.0 million, and Detox, Enhanced Detox and Residential Treatment service in Anchorage (Clithroe) $500,000. The Essential Program Equipment to Service Providers capital request was reduced by $100,000 in the capital budget. All Funds (MHTAAR, GF/MH, AHFC Dividends) 2008-05-30 House Journal Page 3023 The Authority recommended a $12.4 million capital budget. The Governor increased the capital budget to $17.6 million, and the legislature reduced the request to $13.6 million. Details are in the attached capital project report. Future Reporting FY09 marks the first year the Authority used the budget system to record its recommendations. Our goal is not only to use the budget system to comply with statutory reporting requirements, but also to provide status reports as the budget moves through the legislature. There is a great deal of room for improvement; we had some difficulties with the transactions entered by the Authority, which precluded reporting as the bill moved through the budget process. The situation meant the legislature may not have been aware of Authority recommendations that were not forwarded by the Governor; recommendations not considered by the legislature cannot be funded. The budget includes a $1 billion deposit into the Constitutional Budget Reserve, over $1 billion to the public education fund for the public school funding formula and pupil transportation costs in FY2010, special appropriations for tax credits, revenue sharing, and direct deposits to the retirement system costs, and includes funding for public education, the university, public health and safety, transportation, resource development, and funding for state government programs, services, and grants. I appreciate that the Legislature shares the administration's concern about the size and growth of the budget, particularly the operating budget. Through line-item vetoes, I have reduced the appropriations in HB 310 by $2.6 million general fund. In addition to signing the bill, I have committed to saving at least $20 million in state agencies' operating budgets in FY2009. Chapter No. 29, SLA 2008 [Effective Date: See Chapter] The budget goals for this administration have been very clear: to slow the growth of government, live within our means, and save for the future. The capital budget presented for legislative consideration this past session was designed to meet these goals. I appreciate the careful consideration and support from the Legislature of this request. Senate Bill 221 as passed by the Legislature contained operating and capital appropriations for Fiscal Year 2008 and FY2009, totaling $3.9 billion. The capital budget totals nearly $3.0 billion, including $1.2 billion in general funds. Through line-item vetoes, I have reduced the operating and capital appropriations in SB 221 by $268.2 million of which $152 million is general funds. Making these reductions now means that this revenue will be available for additional savings and vital services for Alaskans in the future. I appreciate the increased level of communication between my administration and the Legislature before, during, and following completion of the first 90-day session. I believe we share similar priorities for funding including basic government services for life, health, public safety, transportation, infrastructure development, and 2008-05-30 House Journal Page 3041 education. Alaska is blessed with the unique opportunity through this time of extraordinary revenue to invest in our communities and citizens and also be able to put a significant amount of surplus revenues into savings. We conducted a comprehensive review of the operating and capital items included in SB 221. I asked our departments to look closely at items we included in our operating and capital budgets as well as legislative changes to the budget. I also instructed the Office of Management and Budget to contact each legislator and ask for a prioritized list of projects within each district and to ensure that we had complete backup for each project. We also contacted communities to confirm that we had correct information and understanding of the community priorities. There are some broad areas that are important to note in the overall approach to the budget. SB 256 Supplemental Capital Projects - We had very positive and productive meetings with legislators during the regular session to discuss specific projects that were inserted into the supplemental bill. As a result, there were 155 projects totaling $35.4 million that I recommended be moved from SB 256 for consideration in the capital budget. The SB 256 "moved" and some of the vetoed projects were included in SB 221 in sections 7, 10, and 13. In some cases the amount of the projects increased from what was originally requested in SB 256. There were 162 projects totaling $59.8 million. Of the 162 projects, 102 projects are funded entirely for a total of $45.8 million, 22 projects are reduced by $4.2 million, and 36 projects are vetoed for a total $5.4 million. Individual reasons for those reductions are noted on the enclosed spreadsheet. SB 221 includes a number of legislative designated grants to schools and education organizations in support of operating programs, books, and materials at local schools. While I have let a number of these appropriations remain, I believe that this is not a fair way to address the needs of schools. All schools need supplies, books, laptops, and ongoing repairs that are not typically funded through the state's major maintenance program. 2008-05-30 House Journal Page 3042 The Anchorage School District implemented a process at the school building level to identify projects by priority and to have those projects approved by the Anchorage School Board. I appreciate the efforts of the district to develop a public process for these projects. However, I am concerned that these additions create an unfair advantage to some schools. The education funding formula is designed to create parity between school districts. Elected school boards are authorized to make funding decisions for schools within their districts. We also have a statewide school construction and major maintenance grant and debt reimbursement program to help districts pay for significant capital costs. I would encourage school districts to address their building needs through the state funding already provided and local community funding in the future. Inclusion of operating funds to various organizations through the capital budget is also an area of concern. I have retained some of these grants, particularly where there are extraordinary circumstances or transitional funding needs. These appropriations should be considered as one-time to help the organization secure other operating funds for the future. Many of the appropriations that remain in the budget are also flagged with the caveat that these state funds are one- time and other funds should be sought for future costs. In many cases, I have vetoed funds for new programs or facilities that would require additional state funds in the future. In reviewing the budget, I found that many of the requests included matching funds or the ability to leverage additional funds based on the state's contribution. The presence of matching funds was an important element of our decision to retain projects in the budget. A number of projects were reduced to demonstrate the state's commitment to be a partner in the project but to also encourage the recipient to seek other funds for the project. The enclosed spreadsheet lists the projects I have vetoed including the appropriation cite, funding source, and the reason I have vetoed the appropriation. The reasons for veto fall into several categories: 1. Fund at reduced level There are many services where the state has some responsibility and has a proper role in providing some 2008-05-30 House Journal Page 3043 funding. Several projects that were reduced are also flagged as one-time items. 2. Lower priority for funding Projects that address life, health, safety, transportation, infrastructure, and education are funding priorities. Many projects included in the budget were reduced or vetoed because they were a lower funding priority. 3. Consider in future budget Many projects met the funding criteria and may be considered in a future budget. 4. Other funding options available There are numerous state programs and other sources of funding that make grants and other resources available. In some instances, it may be possible to perform the work within existing agency resources. 5. Legal concerns The Department of Law provides a review of all expenditures for compliance with state laws and regulations. Each appropriation must clearly be for services and programs that meet public funding requirements. 6. Duplicate funding Funding for some projects was included more than once in error. 7. Request reduced or withdrawn Recipients of funding or their legislative sponsors indicated that they no longer were requesting approval or could move forward with the project at a reduced amount. 8. Inadequate funding provided Some projects and programs were provided insufficient amounts of money in order to provide meaningful achievement. 2008-05-30 House Journal Page 3044 9. Creation of new facilities and programs Given current funding shortfalls for existing programs and the ongoing need to address a backlog of deferred maintenance of public facilities, few projects for new facilities or programs were approved. Our process for evaluating these projects attempted to review each appropriation based on a policy applied consistently and even- handedly. No one region, community, or legislative district was singled out at any time. I have vetoed two appropriations from the Railbelt Energy Fund. These projects will be considered under the efforts of the Alaska Energy Authority on the unified plan to serve all the consumers in the region in a cost effective and efficient manner. The unified system plan will be a key component of the Statewide Energy Plan that will be completed later this year. It is premature to fund these distinct projects without the benefit of the unified plan. Education is a top priority for legislators and this administration. Alaska's public schools will receive nearly $1 billion in FY2009. SB 221 contains $20.7 million in supplemental funds for energy relief grants to schools in addition to an increase of $112.5 million for changes approved in the public school funding formula under HB 273. This budget focuses on the state's basic responsibilities, schools, public safety, and needed transportation improvements that are essential to getting Alaska's infrastructure ready for the state's economic future, especially the gas pipeline. [Chapter No. 44, SLA 2008 Effective Date: August 26, 2008] SB 202 addresses a very serious concern of many Alaskans: that the federal government is forcing Alaska and other states to implement certain provisions of the REAL ID Act of 2005, and is not picking up the high price tag of the implementation. In the near future, Alaska and other states must upgrade their driver's license and state identification card systems to meet the standards of the REAL ID Act. If we do not, we risk that our citizens may not have the identification needed to board airplanes, enter federal offices, or visit federal hospitals. Most Alaskans have serious privacy concerns about the development of a national database and about the ready access to personal information that this database would give the federal government and others through the technology envisioned by the REAL ID Act. I agree with those concerns. It especially troubles me that the state of Alaska is forced to use its money to implement this ill-considered policy. Nonetheless, I want to be sure that the state of Alaska can continue to improve its driver's license and identification card system to further secure its licenses and cards against fraud. Because some of these improvements may coincidentally match or advance changes required by the REAL ID Act, SB 202 could be viewed as restricting these improvements. SB 202 does not resolve the dilemma that Alaskans will face if their driver's licenses and state identification cards are not 2008-05-30 House Journal Page 3056 accepted for federal purposes and they do not possess a passport or other federally-accepted identification. Failure to comply with these federal requirements may restrict Alaskans' freedom of travel and prevent their access to federal facilities.
