Full Journal pdf2005-05-11 House Journal Page 1961 HOUSE JOURNAL ALASKA STATE LEGISLATURE TWENTY-FOURTH LEGISLATURE FIRST SPECIAL SESSION Juneau, Alaska Wednesday May 11, 2005 First Day The House was called to order by Speaker Harris at 3:22 p.m. for the First Special Session of the Twenty-Fourth Legislature. Roll call showed 28 members present. Representatives Berkowitz, Gardner, Joule, Kerttula, and LeDoux were absent and their presence was noted later. Representatives Anderson, Croft, Guttenberg, Kapsner, Kott, McGuire, and Weyhrauch were absent. The invocation was offered by the Chaplain, Representative Dahlstrom. Representative Coghill moved and asked unanimous consent that the invocation be spread on the journal. There being no objection, it was so ordered. With respect for everyone's beliefs, I offer this prayer. Our Father in heaven, please watch over us this day as we meet and go about our legislative business. Bless us with a spirit of calm, with a spirit of compromise and good decision making. Bless us, heavenly Father, with the mental health, strength and physical health and strength that we need to complete our assignments here. Please bless our support staff that are so willing to accommodate us and help us in the things that we are trying to accomplish - that they will have the things that they need also. We are grateful for the many blessings that we have, especially this great country and this great state that we live in. And we ask thee, Father, to bless us with thy spirit this day and to be over us that we will be safe - protected from harm and accident - and that our families 2005-05-11 House Journal Page 1962 will all be watched over also as we are away from them. This is our prayer in the name of Jesus Christ, Amen. The Pledge of Allegiance was led by Representative Kohring. CERTIFICATION OF THE JOURNAL Representative Coghill moved and asked unanimous consent that the journal for the 119th legislative day be approved as certified by the Chief Clerk. There being no objection, it was so ordered. MESSAGES FROM THE SENATE HB 130 A message dated May 10, 2005, was read stating the Senate has passed CSHB 130(FIN) am with the following amendment and it is transmitted for consideration: SENATE CS FOR CS FOR HOUSE BILL NO. 130(FIN) "An Act relating to the grant of certain state land to the University of Alaska; relating to the duties of the Board of Regents; establishing the university research forest; and providing for an effective date." The Senate adopted a Legislative letter of intent (page 1015). CSHB 130(FIN) am is under Unfinished Business. The House reverted to: MESSAGES FROM THE GOVERNOR The following Governor's supplemental proclamation dated May 11, 2005, which amends the proclamation dated May 9, 2005 (page 1854), was read: "Under the authority of art. II, sec. 9, and art. III, sec. 17, of the Alaska Constitution, and in the public interest, I am amending my May 9, 2005, proclamation calling the Twenty-Fourth Legislature of the State of Alaska into its first special session in Juneau, Alaska, on May 11, 2005, as follows: 2005-05-11 House Journal Page 1963 I am supplementing the call with the addition of subjects germane to the titles of the following bills under consideration by the Senate and House of Representatives during the first regular session: 1. House Bill 130 - University land grant; 2. House Bill 147/Senate Bill 108 - insurance regulation; 3. Senate Bill 73 - state virology laboratory; and 4. House Bill 94 - elections, voters, political parties. This proclamation supplements my proclamation of May 9, 2005. Done by, /s/ Frank H. Murkowski Governor" **The presence of Representatives LeDoux, Joule, Gardner, and Kerttula was noted. CONCUR IN SENATE AMENDMENTS HB 130 Representative Coghill moved and asked unanimous consent that the House consider the Senate message (page 1962) on the following: CS FOR HOUSE BILL NO. 130(FIN) am "An Act relating to the grant of certain state land to the University of Alaska; relating to the duties of the Board of Regents; establishing the university research forest; and providing for an effective date." and SENATE CS FOR CS FOR HOUSE BILL NO. 130(FIN) (same title) There being no objection, it was so ordered. 2005-05-11 House Journal Page 1964 Representative Coghill moved that the House concur in the Senate amendment to CSHB 130(FIN) am, thus adopting SCS CSHB 130(FIN), and recommended that the members vote no. The question being: "Shall the House concur in the Senate amendment to CSHB 130(FIN) am?" The roll was taken with the following result: SCS CSHB 130(FIN) Concur YEAS: 0 NAYS: 30 EXCUSED: 0 ABSENT: 10 Nays: Chenault, Cissna, Coghill, Dahlstrom, Elkins, Foster, Gara, Gardner, Gatto, Gruenberg, Harris, Hawker, Holm, Joule, Kelly, Kerttula, Kohring, LeDoux, Lynn, Meyer, Moses, Neuman, Olson, Ramras, Rokeberg, Salmon, Seaton, Stoltze, Thomas, Wilson Absent: Anderson, Berkowitz, Crawford, Croft, Guttenberg, Kapsner, Kott, McGuire, Samuels, Weyhrauch And so, the House failed to concur in the Senate amendment, thus failing to adopt SCS CSHB 130(FIN). The Chief Clerk notified the Senate and respectfully requested it to recede. In the event the Senate fails to recede from its amendment, the Speaker appointed the following members to a Conference Committee to meet with a like committee from the Senate to consider the above bills: Representative Ramras, Chair Representative Weyhrauch Representative Salmon The Speaker stated that, without objection, the House would recess to a call of the Chair; and so, the House recessed at 3:48 p.m. 2005-05-11 House Journal Page 1965 AFTER RECESS The Speaker called the House back to order at 5:29 p.m. **The presence of Representative Berkowitz was noted. ANNOUNCEMENTS House committee schedules are published daily under separate cover. ADJOURNMENT Representative Berkowitz moved and asked unanimous consent that the House adjourn until 11:00 a.m., May 12, 2005.
