MESSAGES FROM THE GOVERNOR SB 364 The following letter, dated June 5, 2002, was received: "Dear Speaker Porter: Under the authority of art. II, Sec. 15, of the Alaska Constitution, I have vetoed the following bill: SENATE BILL NO. 364 "An Act relating to medical services under the state Medicaid program." This bill is the most recent attempt by the Alaska Legislature to override court decisions and deny women their constitutionally protected right to safe, legal abortions. Those legislators who oppose a woman's right to choice continue to chip away at that right by trying to limit access to abortions. I must, once again, cry foul at this unconstitutional effort. This bill would create two classes of Medicaid-eligible women for whom an abortion is medically necessary: those for whom a doctor is willing to certify the necessity of the abortion based on vague, nonmedical statutory terminology, and those for whom the doctor is unwilling or unable to do so. 2002-06-21 House Journal Page 3952 This legislation flies in the face of the Alaska Supreme Court's 2001 decision in State v. Planned Parenthood and is likely to be found unconstitutional because it: · Selectively denies payment for medically necessary treatment to Medicaid eligible women; · Fails to use neutral criteria in establishing the standards for paying for abortions; and · Creates differential treatment for payment for services under Medicaid provided to pregnant women who do not meet the strict limitations set out in the statute. I also believe the bill could be struck down as unconstitutionally vague. This bill describes the factors to determine medical necessity for payment in terms that are not customarily used in the medical profession nor even possible to calculate. It requires absolute certainty in determining that without an abortion, a woman's physical health would be seriously endangered. The restrictions placed on psychological health are even more vague and limiting to the point of being offensive to the medical profession. Physicians testified that the language in this legislation does not conform to the type of determinations a physician must make and the type of advice a physician usually provides to a patient. It therefore sets out unworkable standards that should not be imposed on the practice of medicine. With this bill, the Alaska Legislature is placing personal views on morality ahead of the Constitution and trying to practice medicine by dictating what procedures and diagnoses doctors may or may not render. Most notably, with this bill the Legislature is trying to insert itself into a decision that is and should be of the utmost privacy-- between a woman and her physician. [Chapter No. 44, SLA 2002 Effective Date: See Chapter] The primary benefit of this bill is to codify important Alaska Coastal Management Program processes, ensuring the State of Alaska can allow for timely development permitting while also protecting the environment. This section of the bill is a response to the Alaska Supreme Court's recent decision in Cook Inlet Keeper v. State of Alaska, a case involving a dispute over discharges of drilling mud from the exploration activities on the Osprey oil platform in Cook Inlet. The Court interpreted the Alaska Coastal Management Program (ACMP) as prohibiting the long-standing practice of excluding general and nationwide permitted activities from ACMP project reviews. This section of the bill clarifies that it is within the coordinating agency's discretion to exclude such activities from a project review. This clarification is necessary because the implications of the Court decision on the state's permitting system go far beyond the subject matter of this particular case. It could jeopardize oil and gas permits as well as other resource development activities. It is also unfortunate the Court decision came at a critical time in the development of the Osprey project. Even though the project no longer involves significant discharges of drilling mud, the uncertainty caused by the Court's decision would subject it to a lengthy procedural process and could jeopardize the project. Having said that, I also believe the Court raised a good point regarding the need in certain circumstances to review generally permitted activities in the context of a particular project. Such a review is not necessary in all instances, but is appropriate when there is a significant project involving multiple state or federal permits. 2002-06-21 House Journal Page 3958 Therefore, in conjunction with signing SB 371 into law, I am requesting the Coastal Policy Council exercise its authority over the ACMP consistency review process by requiring the Division of Governmental Coordination to include activities covered by a general or nationwide permit within the scope of review for projects that require a DGC coordinated review. This action will ensure that the significant projects requiring multiple state or federal permits will consider generally permitted activities during the project review, but that other projects requiring permits from just a single state agency do not have to undergo this additional consideration. This section of the bill also allows permits issued by the Alaska Oil and Gas Conservation Commission (AOGCC) to be excluded from ACMP consistency reviews. I am signing this bill into law with the understanding this discretionary language in the bill will not undermine the current exclusion of AOGCC permits from ACMP review. The first section of SB 371 exempts the use of munitions in training activities on active ranges from the state Department of Environmental Conservation permitting requirements of AS 46.03.100. The Department of Environmental Conservation has consistently interpreted AS 46.03.100 in a manner that has not interfered with or hampered active firing ranges operated by the United States Department of Defense. Further, the Department of Defense facilities in Alaska have frequently committed to environmental stewardship consistent with our standards. Nonetheless the Legislature, with virtually no deliberation, not only granted the Department of Defense exemption but also included non-military firing ranges. I am signing this bill with the following understanding regarding section one: · The Department of Environmental Conservation has full authority to address any pollution problems caused by active range activities; · The Department of Environmental Conservation has full authority, upon closure of a range, to require assessment, remediation, and monitoring of hazardous substances to ensure that the site poses no ongoing risk to health or the 2002-06-21 House Journal Page 3959 environment and may require a permit if solid waste will be abandoned; · The Department of Environmental Conservation has full authority to seek compensation for natural resource or other damages caused by hazardous substances on a range; · The term "ranges" will be applied only to formally designated ranges and not applied to other locations where munitions are used. This legislation purporting to fine tune Alaska's campaign finance law was introduced on April 18, barely a month before the end of the 2002-06-21 House Journal Page 3995 regular 121-day legislative session. While it makes some modest worthwhile improvements, overall the bill falls far short of providing Alaskans the progressive regulation of campaign finance they desire. The most important provision of the bill is designed to give the appearance of regulating so-called "soft money." These difficult-to- trace and rarely disclosed funds are contributed by special interests below the radar of conventional campaign finance laws. Soft money has had an insidious impact on political campaigns across our country. Front groups, who apparently are accountable to no one, finance and produce some of the most vicious television advertisements ever witnessed. Fortunately, at least until this year, Alaska has been largely immune from such soft money negative campaigns. In the spirit of the national McCain-Feingold campaign reform law and our own 1996 campaign finance act measure, Senate Bill 363 could have constituted genuine political reform. Instead, it was watered down in the last two days of the legislative session to dupe the public into believing it reduces soft money advertising in Alaska elections. In early versions, this measure adopted strict language from a 1987 Ninth Circuit Court decision (Federal Election Commission v. Furgatch, 807 F.2d 857) which said that when read as a whole, advertisements urging a vote for or against a particular candidate were subject to regulation. That language was diluted on the second to last day of the regular session in the House Rules Committee to require that ads must "explicitly advocate election or defeat of a candidate" to be subject to regulation. Within days after this weakened and overly permissive bill passed the Legislature, an out-of-state group generously funded with unaccounted-for money, "Americans for Job Security," launched an onslaught of negative television advertising across Alaska that conveniently would not be subject to regulation under Senate Bill 363. By targeting the Knowles-Ulmer Administration, these ads are clearly designed to benefit one gubernatorial candidate over another. 2002-06-21 House Journal Page 3996 We Alaskans pride ourselves on our independence, preferring our way instead of blindly following outside practices. I believe most Alaskans are offended by the sleazy, gutless and inaccurate soft money ads now blanketing our airwaves. The Twenty-Second Alaska Legislature had an opportunity to set high standards for Alaska political campaigns. It failed. By vetoing this bill, I am giving a future Legislature the opportunity to do it right.
