Dear President Pearce:                                                         
                                                                               
Under the authority of art. II, sec. 15 of the Alaska Constitution, I          
have vetoed the following bill:                                                
                                                                               
SENATE BILL NO. 78 am H An Act relating to                                    
the use and prescription of pharmaceutical agents in                           
the practice of optometry.                                                     
                                                                               
This bill grants broad authority for optometrists in Alaska to                 
prescribe pharmaceutical agents relating to treatment of the eye,              
including oral and injectable drugs. This greatly expands optometrists'        
scope of practice regarding pharmaceuticals, which is now limited to           
the use of topical drugs.

I recognize the fact that many states currently allow optometrists to          
prescribe oral drugs. Fewer states have expanded this privilege to             
include the use of injectable drugs. I also recognize that a few states        
have recently rejected this proposed expansion of optometrist                  
privileges, citing concern for enlarging the scope of practice without         
adequate training and education. I share this concern.                         
                                                                               
I have faith that the Alaska State Board of Examiners in Optometry             
would do its best to regulate this new authority and would intend to           
require new testing of its licensees before granting this expanded             
license endorsement. However, the bill does not specifically require           
any new testing. Without a regulation change, under the language of            
this law, a licensee with a current endorsement to administer topical          
drugs would automatically be licensed to prescribe oral drugs and              
administer injected drugs.                                                     
                                                                               
The Legislature never sought the opinion of the medical community              
and, specifically, the Medical Board, when considering this bill. That         
was a failure to recognize this as a medical and health issue.                 
                                                                               
The bill asks the Board of Optometry to solicit the recommendations            
of the State Medical Board in establishing its examination and                 
education requirements for the pharmaceutical license endorsement.             
Despite this effort to involve the medical community in this process,          
members of the Alaska State Medical Board unanimously oppose this              
legislation, stating:                                                          
                                                                               
Optometrists do not have the clinical experience to                           
safely administer eye injections, intravenous and                              
intramuscular injections, and oral medications,                                
including some narcotics. Reading about the effect                             
and side effects of medications, or attending                                  
seminars, does not prepare an optometrist for                                  
complications related to patients' other medical                               
problems and chronic medications. The board's                                  
charge is to protect Alaskan patients; we believe                              
that this legislation would endanger patients.

While I have high regard for the optometry profession in Alaska, I             
must, in the interest of public health and safety, heed the                    
recommendation of the medical community and veto this bill.                    
However, I remain open to the concept of expanding optometrists                
scope of practice regarding pharmaceuticals, provided we can                   
determine the appropriate perimeters of such a law and ensure the              
public safety in granting any expanded privileges.

This bill responds to a recent Alaska Supreme Court decision                   
regarding a Department of Natural Resources right-of-way permit to             
Golden Valley Electric Association for construction of an electric             
transmission  intertie  between  Healy and Fairbanks. The Court held

that because the permit was not functionally revocable, the                    
department should have issued a best interest finding before granting          
the permit. This bill clarifies that a best interest finding is not            
required in the granting of this right-of-way or in other permits              
issued under AS 38.05.850.                                                     
                                                                               
Prior to passage of this bill, the Department of Natural Resources             
proceeded to comply with the court decision and began a best                   
interest finding on the intertie project. This project has generated a         
great deal of public comment. The state is responsible to the public           
to consider these comments and complete the best interest finding.             
                                                                               
Therefore, in signing this bill, I am also asking the commissioner of          
the Department of Natural Resources to complete the best interest              
finding on the Fairbanks-Healy intertie right-of-way.                          
                                                                               
I also want to advise the Legislature and ensure the public that this          
Administration will continue to thoroughly review major projects of            
this nature through a best interest finding or a comparable review

In 1996, the Legislature enacted a four-year moratorium in the                 
Bering Sea Korean Hair Crab fishery, and in 1997, in the                       
Weathervane Scallop fishery. Upon signing HB538, the bill                      
establishing the Hair Crab moratorium, on July 3, 1996, I sent a               
letter to Senate President Pearce and then-Speaker of the House,

signing  the  moratorium  bills   because   I  recognized   important          
pragmatic reasons to implement the provisions of the bills, but that           
I was, concerned about the legislation from a public policy and                
resource management standpoint.                                                
                                                                               
This bill I have signed today extends the moratoria in the Korean              
Hair Crab and Weathervane Scallop fisheries. I remain concerned                
about this approach and urge passage of legislation next session               
authorizing the tools our state agencies need to manage Alaskas                
fisheries effectively.                                                         
                                                                               
In my 1996 letter, I stated that, Addressing management of specific            
fisheries through legislation is not the ideal approach. Alaskas               
fisheries management system has proven highly effective in                     
maintaining healthy and sustainable resources because it is run by             
scientists, professional fisheries administrators, and boards and              
commissions, rather than through the legislative process. I went on            
to note that I was asking the Commercial Fisheries Entry                       
Commission (CFEC) and the Department of Fish and Game to                       
review existing statutes and to recommend changes to make the                  
fishery moratorium provisions in the law more workable and                     
effective.                                                                     
                                                                               
Additionally, the legislature itself included language in the original         
hair crab moratorium bill directing CFEC to draft and bring before             
the legislature legislation establishing a vessel permit program.              
Clearly, the legislature recognized that without such a program,               
CFEC would not have the tools to implement needed permanent                    
limitation of certain fisheries, such as Korean Hair Crab and scallops.        
                                                                               
Since that time, CFEC did indeed prepare and have introduced a bill            
to create workable provisions for administratively enacting fisheries          
moratoria (HB104), and another bill authorizing the establishment of           
a vessel-based permit program (SB143), which could be used in                  
fisheries where the standard owner-operator model of limited entry             
would not serve the purposes of the Limited Entry Act.

HB104 passed the House unanimously, and there was evidence of                  
support among legislators and the public for SB143. However,                   
neither bill moved from the Senate Resources Committee.                        
                                                                               
Without the tools those bills would have provided, or an extension             
of the current moratoria, the Korean Hair Crab fishery would have              
reverted to open access upon expiration of the moratorium July 1,              
2000, and the scallop fishery would have done the same on July 1,              
2001.                                                                          
                                                                               
Given the failure of the legislature to pass HB104 and SB143, I have           
reluctantly signed HB429 into law. It serves as a stopgap measure              
to avoid the chaos, and probably the complete closure, of these two            
fisheries that would have resulted from a return to open access.               
                                                                               
A long-term solution for these particular fisheries, and the availability      
of good tools and options for managing other evolving fisheries in             
Alaska is critical. This will require the passage of legislation in the        
next two years in order to have a workable program in place prior              
to the new expiration dates under HB429. Repeated moratorium                   
extensions will not provide a solution. Such an approach would                 
create further uncertainty in these fisheries and would eventually             
raise constitutional issues as well.                                           
                                                                               
I urge you to work with the Commercial Fisheries Entry Commission              
and the Department of Fish and Game to ensure legislation is passed            
next session to provide the tools needed for the sound management

This bill amends the rights of certain general law as well as home             
rule municipalities to form, alter, or abolish certain service areas           
within their jurisdiction. In fact, for the first time since statehood, the    
rights of Alaskas home rule municipalities in forming, altering, and           
abolishing service areas are limited by statute. Additionally, this bill       
creates an exemption for which only one general law borough                    
qualifies from the limits imposed in this bill.                                
                                                                               
This legislation imposes unduly restrictive methods on boroughs in             
creating and managing their service areas. It mandates that a majority         
of voters in the areas, and those affected by the changes outside the          
service area, vote to approve the change before it can be                      
implemented. This severely restricts the power of boroughs and will            
diminish the local government's ability to deal effectively and timely         
with needed changes. This bill has the potential of placing                    
substantive power with a minority of voters, thus shifting the                 
governmental power from the borough assembly, whose members are                
elected borough-wide, to service area boards whose members are                 
elected only by residents of the service area or appointed. This is            
contrary to the concept of borough government under art. X, secs.              
1, 3, 4, and 5 of the Alaska Constitution, as well as contrary to the          
concept of liberal home rule powers under art. X, sec. 11 of the               
Alaska Constitution.                                                           
                                                                               
This bill also raises serious constitutional concerns by imposing              
limitations on home rule boroughs and unified municipalities. Home             
rule municipalities have a constitutional grant of authority that gives        
them liberal control over matters purely of local concern. How                 
service areas are established and governed has historically been dealt         
with in home rule charters as part of the organic law of a particular          
home rule municipality. And where a home rule municipality is                  
concerned with a matter of purely local concern, the charter and not           
a legislative act is looked to in order to determine whether a                 
particular power has been conferred upon the municipality. It would            
be incongruous to recognize the constitutional provision that a home           
rule municipality may exercise all legislative powers not prohibited           
by law or by charter, and then to say that the power of a home rule            
city is measured by a legislative act. Lien v. City of Ketchikan,              
383P.2d 721, 723 (Alaska 1963).

In addition, the exemption from the provisions of this bill provided           
to only one borough in the state may violate the constitutional                
prohibition against special and local legislation. Such a specific             
classification of borough (particularly a general law borough of               
which there are six others in the state of the same class), coupled            
with the specific population limitation, makes it questionable whether         
there is a rational basis to exempt one general law borough from the           
requirements for the municipal service areas addressed in this bill.           
This exemption is doubly troublesome considering the limitations of            
this bill are applied to all home rule boroughs and unified                    
municipalities while one general law borough qualifies for the                 
exemption. This specialized treatment does not appear to have a                
rational basis stated in the legislative history, and it is incongruous        
with the constitutional powers granted home rule municipalities.               
                                                                               
This bill raises serious constitutional violations and, for that reason,

awarded the contract.  The timelines for FY 01 are, essentially,               
meaningless because the deadlines have either already passed or are            
easily being met by the Department of Community and Economic                   
Development (DCED).                                                            
                                                                               
In terms of the substance of the contract under negotiation, I am              
instructing the commissioner of DCED to proceed with due diligence.            
This bill in no way diminishes her responsibility to negotiate a               
contract to the level of detail necessary to provide administrative

In December 1995, sponsors of a campaign finance reform initiative             
submitted petitions with valid signatures of 22,764 Alaska voters,             
more than enough to place their proposed law on the 1996 general               
election ballot. The Legislature, under the threat of this citizen             
initiative, responded by passing a campaign finance bill in 1996 that          
significantly curbed the effect of big money donors on Alaska                  
campaigns. Only two legislators voted against the bill. Lt. Governor           
Ulmer ruled that the Legislatures bill was substantially similar to            
the citizen initiative, which eliminated the necessity of placing it on        
the ballot.                                                                    
                                                                               
This campaign finance reform measure is widely supported by                    
Alaskans and our state proudly leads the nation in curtailing the role         
of large campaign contributions. Now, only four years later, the               
Legislature has passed this bill which significantly reverses some             
provisions, and certainly violates the spirit, of the 1996 law and             
initiative.                                                                    
                                                                               
This legislation extends the period a candidate can raise money for            
a gubernatorial race or a lieutenant governors campaign from two               
to four years. This change increases the total amount an individual            
donor can give to these candidates from $1,000 to $2,000. It opens             
the door once again for soft money contributions to political                  
parties from businesses, labor unions, and other interests. It                 
encourages candidates to raise more campaign funds than they really            
need by boosting the amount of leftover funds that winners can                 
transfer into expense accounts (from $20,000 to $40,000 for senators           
and from $10,000 to $16,000 for House members) for their offices.              
                                                                               
After reviewing these and other provisions of House Bill 225, it is            
easy to see why legislative opponents termed this bill the                     
Incumbents Protection Act. Theres virtually no benefit to the                  
citizens. There are significant benefits for incumbent legislators.

Theres no evidence that Alaskans feel differently today about the              
effect of money on politics than they did in 1996. Like voters across          
the nation, Alaskans want shorter, cheaper campaigns. National                 
polling shows the electorate is convinced most politicians are                 
corrupted by large contributions, and skeptical of arguments that              
campaign finance reform threatens free speech.                                 
                                                                               
I agree with all of those Alaskans and their fellow Americans who              
are speaking out for campaign reform with clear voices and                     
determination. I cannot and will not sign this bill simply because the

An Act relating to victims rights; relating to                                 
establishing an office of victims rights; relating to                          
compensation of victims of violent crimes; relating                            
to eligibility for a permanent fund dividend for                               
persons convicted of and incarcerated for certain                              
offenses; relating to notice of appropriations                                 
concerning victims rights; amending Rule 16,                                   
Alaska Rules of Criminal Procedure, Rule 9, Alaska                             
Delinquency Rules, and Rule 501, Alaska Rules of                               
Evidence; and providing for an effective date.                                 
                                                                               
Although described as an offer to assist crime victims, the approach           
taken in this bill is inefficient and will only serve to create more           
bureaucracy rather than put money and resources into direct aid to             
crime victims.                                                                 
                                                                               
Crime victim advocacy groups, including Victims for Justice, MADD,             
and the Alaska Network on Domestic Violence and Sexual Assault                 
also oppose this legislation for the reasons I stated above. In its            
letter requesting I veto this bill, Victims for Justice wrote,  . . . the      
funding necessary to establish and maintain a rather large, expensive          
state bureaucracy would be better spent on direct victims services.            
In its letter of opposition to the bill, the Network wrote, We do not          
support establishing an office that attempts to address these issues           
only  after  someone's rights have been violated. The Network goes

on to explain that the money and efforts to support crime victims              
needs to be spent at the front end of the system, and not as an                
after-the-fact investigation of problems in the system, as this bill           
proposes.                                                                      
                                                                               
Several state and private programs already address victim concerns.            
We need to explore how to improve those existing services and                  
provide them at a local level, where the victims are. One centralized          
office with minimal staff as called for in this bill cannot possibly           
offer victims statewide the support and assistance they need.                  
                                                                               
Victims have long been overlooked in our criminal justice system.              
But Alaska has made great strides in repairing this injustice. Central         
to the increasing sensitivity we have toward crime victims are the             
tireless efforts of the victim advocacy groups. The public service             
they do for people in times of great trauma and grief is priceless. I          
look forward to working with these groups, state agencies, and the             
Legislature on forging improved grass-roots efforts to aid victims of

I am signing this bill because it authorizes many vitally needed               
projects throughout the state and uses appropriate and available               
bonding mechanisms to pay for them. However, there are several                 
issues not addressed in the bill, or that are raised by the approach           
used in the bill, which merit mention and which will require

Most of the projects cited by the state Board of Education as                  
critically needed new school construction or major maintenance are             
not funded in this bill. I had proposed a funding method to address            
the 40 top-ranked new school construction projects and all of the              
major maintenance projects throughout the state. This bill authorizes          
funding for only the first five new school construction projects plus          
the 24th ranked project and skips through the major maintenance                
projects, ignoring most of the list, particularly in rural Alaska.             
                                                                               
In the case of projects authorized for bond debt reimbursement, there          
appears to be no rational basis for the amounts allocated to various           
districts. Some districts which still have an allocation for debt              
reimbursement from two years ago are authorized further                        
reimbursement for no specified or prioritized projects. Others, notably        
Juneau, were not authorized sufficient reimbursement to cover                  
projects already ranked by the board and approved by voters.                   
                                                                               
There are also problems with the specific approaches used in the bill.         
Although some districts were authorized debt reimbursement                     
retroactively for projects already approved by voters, there was no            
language in the bill to exempt those districts from the approval and           
ballot disclosure requirements of current law. Without further                 
legislation, a new vote for bond approval will be required in those            
districts. Some maintenance projects were also authorized for debt             
reimbursement which may not be eligible for bonding under current              
statutory definitions. In addition, the authorization for debt                 
reimbursement for local ports and harbors could present financial              
problems for small municipalities, despite the promised 100% state             
reimbursement.                                                                 
                                                                               
Thus, there are a number of issues that must be addressed next year.           
I will once again pledge my best efforts to work with the legislature

This bill is well intentioned and could be an innovative approach to           
enhance cost-effective design, construction, and maintenance                   
techniques in public school construction. However, as it would be              
applied in this very limited way, it would actually delay the                  
construction of critically needed school facilities and contribute to          
higher costs.                                                                  
                                                                               
When the bill was introduced it was hoped by many that there                   
would be a number of new school construction projects funded by                
the legislature to meet the growing list of statewide prioritized              
projects by the Board of Education. A pilot project incorporating              
design/build/maintenance concepts from the beginning could have                
merit. However, in the end only six new school construction projects           
were funded by the legislature.                                                
                                                                               
Of these six projects only five are within REAAs and would come                
under the bills pilot program. And of these five, four are already             
designed and will be bid ready in the coming months. It will take              
the Department an additional 4-6 months to implement the RFP                   
required by the bill. The Department and the school districts all              
believe that this will delay the projects by a full construction season        
causing significant additional costs.

Furthermore, it is not at all clear that the designs already paid for          
through grants to the districts would be available to a successful             
bidder of the RFP due to proprietary interests by other contractors            
and entities. If designs had to be redone, it would involve an                 
additional 4-6 months and even further costs.                                  
                                                                               
The district for the school for which a design has not been                    
completed ironically is planning to follow a design/build approach to          
expedite the project. However, removing this project from district             
control and placing it under the state RFP process called for in this          
bill will negate any of these time savings.

The operating budget for FY2001 continues fulfilling the commitment            
I made to protect Alaskas children, improve schools and keep                   
Alaskans working. Taking all funds into account, the $6.97 billion             
budget is $137.5 million more than in FY2000 and $1.1 billion more             
than in FY1995. Permanent Fund dividends and inflation proofing are            
the largest factor in the states budget increases. They will go up             
$256 million next year and have increased nearly one billion dollars           
- $973 million - since FY1995.                                                 
                                                                               
I called this years budget the Childrens Budget because it                     
continues the advances made in recent years to improve childrens               
services and programs through Smart Start. The public will be well             
served by the legislatures approval of 72 percent of my proposed               
increases for childrens health and protection and 76 percent of the            
funds I sought to improve Alaskas schools and the University of                
Alaska. There are no more important investments we can make than               
protecting our children, making sure they attend the best schools              
possible and providing job opportunities for their families.

The operating budget for next year will go up $108.7 million in all            
funds. Federal operating funds are expected to increase by $54.5               
million and general purpose funds to decline by $29.3 million.                 
General purpose funded agency operations dropped $3.4 million and              
formula programs dropped $25.9 million, largely because the                    
Legislature replaced state general fund dollars with federal and other         
funds in many formula programs. Some of the general fund                       
difference is simply a result of recategorizing what used to be called         
general funds. For example, occupational licensing fees are no longer          
treated as general purpose revenues since they are used only to                
support the licensing function. In the combined operating and capital          
budgets, more than $37 million of the reduction in general purpose             
funds is attributable to this switch to the other funds category.              
                                                                               
Except for the initiatives to improve the status of children and               
education, the FY2001 operating budget generally takes a hold-the-             
line approach for state agencies. Agencies will be forced to absorb            
the costs of inflation and providing services to more citizens. In             
upcoming budgets, we will have to deal with the ramifications of the           
Legislatures decision to switch many ongoing services such as child            
care assistance and domestic violence shelters to fund sources that            
will last only one or two years.                                               
                                                                               
Following a precedent of Alaska governors before me, I made                    
technical vetoes of intent language inserted in the bill since that            
language does not meet the constitutional requirement that budget              
bills be limited to appropriations. Governors routinely do this though         
they may plan to implement some of the suggestions. For instance,              
despite the technical intent language veto, my administration has              
already ensured that domestic violence shelters do not have to                 
divulge confidential information or determine the income levels of             
women who seek shelter. Also, new funds for a special parole                   
program will be used to train VPSOs and pay them for work on                   
parole cases as suggested in the intent language. (It is unfortunate           
that the Legislature turned down my recommendation to add                      
$600,000   for   VPSO   salaries   to   recognize   their   important

responsibilities and help reduce severe turnover rates.) The only              
exceptions to these routine technical vetoes are where the intent              
language clarifies the appropriation itself such as the explanation of         
the Medicaid ProShare financing arrangement.                                   
                                                                               
To avoid confusion, I have also made a technical veto of section 18            
of the bill (Four Dam Pool Transfer Fund) which appropriates Four              
Dam Pool revenues according to a prior statute. I have already                 
signed new legislation which repeals that statute and therefore makes          
the appropriations in this budget bill inoperative. The newly signed           
legislation authorizes the sale of the dams in the Four Dam Pool and           
appropriates the sale revenues to a new Power Cost Equalization                
(PCE) Endowment. The PCE program continues to be funded in                     
section 1 of the operating budget with revenues from the new                   
endowment instead of the old Four Dam Pool Transfer Fund.

The capital budget for FY2001 will be $1.176 billion which is $100             
million more than the current years budget. This amount includes               
the projects in this bill and $164.9 million of bonds appropriated in          
separate legislation. Between the FY2000 and FY2001 capital                    
budgets, there is a $9.4 million reduction in general purpose                  
expenditures, a $40.2 million reduction in federal funds and a $149.7          
increase in other funds.                                                       
                                                                               
The capital budget will help fuel one of the healthiest construction           
seasons in recent years, particularly for transportation improvements          
across the state. It makes continued investments in the $350 million           
Gateway Alaska project, which includes the major reconstruction of             
the Ted Stevens Anchorage International Airport and the                        
transportation links serving it.                                               
                                                                               
The capital budget also includes some $90 million worth of water               
and sewer projects, which will bring to 84 percent the number of               
rural households served by piped or enclosed haul water and sewer              
systems. This funding level will serve rural Alaska well in meeting            
a very basic infrastructure need. Schools are also clearly part of any         
communitys essential infrastructure, but in this case much work                
remains to meet the needs in rural Alaska. Although the bond                   
projects are not part of this bill, I would note my disappointment             
that the Legislature funded only 10 of the 86 statewide priority               
school maintenance projects - only one of which is in rural Alaska -           
and only six new rural schools.

bills since they do not meet the constitutional requirement that               
budget bills be limited to appropriations. Governors have routinely            
done this even if they are planning to implement some of the                   
legislative suggestions. Ironically, two of the intent provisions in this      
bill suggest shifting operating-type expenditures from the capital             
budget back into the operating budget, something I proposed several

I also did a technical veto of language on pages 15-16 which                   
attempted to make the Tudor Road maintenance site clean-up                     
appropriation contingent on entering into a memorandum of                      
agreement with the Municipality of Anchorage for shared use of the             
site. This language attempts to incorporate a substantive requirement          
in an appropriation, thus violating the confinement clause of article          
II, section 13 of the state constitution. I would point out that the site      
has friable asbestos and peeling lead paint which are health and               
safety hazards and should be removed whether or not the state and              
municipality enter into such an agreement.                                     
                                                                               
This spring I announced that we would not pursue the Juneau access             
road at this time. We must turn our attention to meeting todays                
transportation needs which communities have expressed in the                   
Southeast Transportation Plan and pursuing the opportunities that fast         
ferries provide. The federal Highway Administration has confirmed              
in writing that we are not in danger of losing the value of                    
environmental impact work that has been done to date. For these                
reasons, I vetoed the allocation titled Juneau Access Environmental            
Impact Statement Completion by July 1, 2002 on pages 32-33. This               
will in no way reduce the total amount of federal transportation               
dollars in Alaska next year.                                                   
                                                                               
Two identical modifications to a prior year reappropriation were               
inadvertently included in the bill. To avoid duplication and possible          
confusion, I retained section 11 and made a technical veto of section          
58(a) on page 90.
