Introduction and Reference of Senate Bills SB 248 SENATE BILL NO. 248 BY THE SENATE RULES COMMITTEE BY REQUEST OF THE GOVERNOR, entitled: An Act relating to the financing authority, payment in lieu of tax agreements, and tax exemption for assets and projects of the Alaska Industrial Development and Export Authority; relating to renaming and contingently repealing the rural 2000-02-08 Senate Journal Page 2217 SB 248 development initiative fund within the Department of Community and Economic Development, and establishing the rural development initiative fund within the Alaska Industrial Development and Export Authority; and providing for an effective date. was read the first time and referred to the Community and Regional Affairs, Labor and Commerce and Finance Committees. Governors transmittal letter dated February 3: Dear President Pearce: The Alaska Industrial Development and Export Authority (AIDEA) has been a key player in many of Alaska's economic successes through the years. AIDEA programs have financed smaller projects, such as the Unalaska Marine Center dock, and the multi-million dollar Red Dog mine and Federal Express aircraft maintenance facility. This bill I transmit today continues AIDEA's role in boosting economic development and creating jobs in the state by extending its bonding authority for development projects of up to $10 million and for conduit bond financing that does not involve the assets or credit of AIDEA or the state. Under the bill, AIDEA's general bonding authority for projects up to $10 million would be extended for three years, until June 30, 2003. The bill also clarifies that the sunset provision does not apply to conduit revenue financing transactions. Projects larger than $10 million would still require specific legislative authorization. In addition, this bill clarifies the procedures available to municipalities to grant tax exemptions for privately held interests in AIDEA-owned assets and projects, and instead enter into agreements and receive payments in lieu of taxes. 2000-02-08 Senate Journal Page 2218 SB 248 The bill also provides for the transfer of the rural development initiative fund (RDIF) program from the Department of Community and Economic Development (DCED) to AIDEA. This makes formal the program transfers authorized in last year's departmental merger bill. Transferring the RDIF program would enable AIDEA to further its economic development mission in communities of 5,000 or less. The state is fortunate to have a financially healthy agency like the AIDEA to forge public-private partnerships that can strengthen Alaska's economic base. This bill will enhance the tools available to the AIDEA to further this mission. The Final Exchange Agreement, Independence Mine SHP Exchange with Alaska Hardrock, Inc., was attached and is on file in the Office of the Secretary of the Senate. Governors transmittal letter dated February 3: 2000-02-08 Senate Journal Page 2219 SB 249 Dear President Pearce: This bill I transmit today would provide legislative approval of a land exchange agreement between the state Department of Natural Resources, and Alaska Hardrock, Inc. The purpose of the land exchange is for the state to acquire private land located within and adjacent to Independence Mine State Historical Park, near Hatcher Pass. The land to be acquired would be developed to enhance the interpretive and recreational uses of the park. The land the state is exchanging is also located in the Hatcher Pass area and is presently under permit to Alaska Hardrock, Inc., which is interested in receiving title. State law requires legislative approval of land exchanges involving lands of unequal appraised value. In this proposed exchange, the state will receive land appraised at $87,000 while conveying land appraised at $66,500. Alaska Hardrock, Inc. is agreeable to this unequal exchange and will be receiving a federal tax credit for the difference. Adding this land to the Independence Mine State Historical Park, particularly the underground mine tunnels, will greatly add to the tourism potential of the park. The DNR expects to contract with a private concession to run tours and maintain the historic buildings in the park, saving a part of Alaska's history while increasing economic activity in the area. A copy of the land exchange agreement between the DNR and Hardrock, Inc., is being provided to the legislature. The DNR has available a report that explains the proposed exchange in more detail. IX, sec. 17(c), Constitution of the State of Alaska, from the constitutional budget reserve fund; making appropriations to capitalize funds; ratifying certain expenditures; and providing for an effective date. was read the first time and referred to the Finance Committee. Governors transmittal letter dated February 7: Dear President Pearce: Today I transmit to you the FY2000 supplemental appropriation bill. As you know, several formula programs such as the Longevity Bonus, Foster Care and Medicaid were significantly underfunded in the budget passed by the legislature last May. Since these are statutory obligations, we must fulfill them in this supplemental. I want to express my concern that the legislature is returning to a pattern of initially underfunding certain state obligations such as formula programs and lease payments, and not providing any up- front deposits to the fire suppression and disaster relief funds. Over the past few years, we made considerable progress together toward more complete budgeting up front and less reliance on supplementals. I regret seeing the return to old habits. Despite the need to fully fund these obligations, the general fund amount in this bill is within the $16.5 million supplemental place holder. This is in part due to a sizeable reduction in the general fund needed to meet the statutory commitment for full funding of the K-12 foundation formula and use of excess Y2K funds. 2000-02-08 Senate Journal Page 2221 SB 250 This supplemental bill includes a section for the ongoing Central Gulf Coast storm disaster even though, as I noted in my transmittal of the disaster declaration, we do not yet have an idea of how much will be required to address it. Since I am optimistic that a federal disaster will be declared, federal financial support is included in that section. As soon as we have disaster cost estimates, we will forward them to you immediately. Governors transmittal letter dated February 4: Dear President Pearce: I am transmitting a bill that would allow the State of Alaska to prosecute and punish an offender for a crime that has been prosecuted by the federal government or by another state or territory. Since early statehood, the State of Alaska has had statutory prohibitions on the state prosecuting and punishing a person, including a corporation, for an act that another jurisdiction has already prosecuted. This policy is not based on constitutional law; 2000-02-08 Senate Journal Page 2222 SB 251 the state and federal constitutional prohibitions against being placed twice in jeopardy for the same act do not prohibit separate jurisdictions from separately prosecuting, and punishing, the same act under different bodies of law. Recent events have suggested a reconsideration of this policy. The federal prosecution of a cruise ship company for illegally discharging water polluted with oil and hazardous waste into our pristine Alaska waters demonstrates that the harm suffered by our state should have been addressed in a separate state prosecution. This bill will allow the State of Alaska to prosecute an offender if a similar situation should arise again. I urge your prompt and favorable consideration of this bill. Governors transmittal letter dated February 4: 2000-02-08 Senate Journal Page 2223 SB 252 Dear President Pearce: I am transmitting a bill amending the list and recording requirements as prescribed by a 1998 state law for state rights-of-way, commonly known as RS 2477. The need to correct the list and recording requirements results from further Department of Natural Resources (DNR) land research and recent experience in trying to record the routes. The state was required to have had every listed right-of-way recorded by January 1, 1999. Most of the 602 routes listed in the 1998 law are unsurveyed. Experience has shown recording unsurveyed routes clouds the title of landowners whose property is not necessarily subject to the historical RS2477 trail or route. Many affected private landowners objected when DNR notified them that it was required to record all the routes, particularly unsurveyed trails, noting they often reflect inaccurate routings. This proposed bill requires that most RS2477 routes be recorded only if surveyed, and within one year of the survey. Those unsurveyed trails still subject to recording would be limited to routes crossing larger privately owned parcels (at least 160 acres), or that cross public lands. Those routes would be recorded within two years of listing. In addition, this bill deletes 12 routes from the current list. Examination of early land records indicates these 12 trails were constructed after the land was reserved or appropriated, making RS 2477 inapplicable. Based on what is now known, they do not qualify as valid RS 2477 rights-of-way. This bill simplifies the recording process for RS2477 trails and removes the concern many private landowners may have with the current law. I urge your support of this measure. Governors transmittal letter dated February 4: Dear President Pearce: As part of the Administration's efforts to operate efficiently and responsibly meet budget constraints, I am transmitting this bill to change the requirement for state publication of the five-year timber sale schedule from annual to biennial. This change will increase the efficiency of state government without diminishing the quality of the schedule or the public's opportunity to comment. Before a timber sale on state land may currently proceed, the Department of Natural Resources (DNR) is required to list the sale in two separate five-year sale schedules. Although this bill provides that a sale would only be listed on one schedule, it would still be required to appear for two years. The timber schedules are scoping documents, not decision documents, and no change is proposed to the decision documents issued for every proposed sale. These Forest Land Use Plan/final best interest findings will still be published for every proposed sale and subject to public and agency review. 2000-02-08 Senate Journal Page 2225 SB 253 Publishing the five-year timber schedule is a time-intensive task. The change proposed in this bill, to publish the schedule every other year instead of every year, will continue to provide the public notice that interested parties have come to rely on when scrutinizing Alaska's timber sale program. But it will also allow DNR greater ability to direct its efforts toward other management concerns during years in which the schedule need not be produced. Governors transmittal letter dated February 4: Dear President Pearce: One of the efforts in which the Administration and the Legislature can take great pride is the revitalization of the Alaska Children's Trust. Alaskans have responded with overwhelming support to help build the principal of the trust to more than $9 million. Proceeds from the trust provide grants to communities and agencies statewide to prevent child abuse and neglect and create healthier lives for children. 2000-02-08 Senate Journal Page 2226 SB 254 One fundraising effort for the trust is the sale of heirloom birth certificates. The sales raised more than $50,000 for the Children's Trust last year and is the most successful fundraising program of its type nationwide. This bill I transmit today expands the birth certificate program by establishing an heirloom marriage certificate suitable for display. Hopefully $25 from the sale proceeds for each certificate would be appropriated by the legislature to the Alaska Children's Trust. This program offers an excellent and appealing way to continue the worthwhile work of the Children's Trust. I urge your favorable consideration of this bill.
