This legislation would adversely affect the state's ability to manage the Anchorage Coastal Wildlife Refuge and would circumvent an ongoing public planning process by requiring an act of the Legislature before any right-of-way could be created in the refuge. By statute, the Department of Fish and Game and the Department of Natural Resources are charged as the stewards of this unique and important public resource. Our land managers should be guided by sound science and public input in weighing the public need to access the refuge against the habitat needs of those many species of wildlife inhabiting this unique area. The state and the Municipality of Anchorage are currently evaluating the transportation and recreational needs of the community and a variety of different alternatives to meet those important needs. By law we have wisely delegated local planning functions to the local government with input from involved state agencies. It is inappropriate for the legislature to insert itself in this process. There is no other instance in which legislative approval of this type of management action is required for such lands. For these reasons, I have vetoed this bill. As legislators, department staff, and others who struggled through this years budget process know first hand, the combination of specific service cuts and additional non-specific reductions on top of that will require noticeable changes in services available to the public. Effects of the cuts range from reducing the number of troopers to increasing response times for snow removal. There will have to be some layoffs, although the hiring freeze, retirement incentive program, and new federally funded jobs in some areas will help reduce the number. Following the practice of governors before me, I vetoed certain intent language whether or not I agree with its content because budget bills are constitutionally limited to the subject of appropriations. Alaska voters made it clear in 1996 that any predator control program to shoot wolves from the air could only be done as a last resort when a biological emergency existed and no alternative method for rebuilding the population was possible. This bill guts that citizens initiative by lowering the standards to allow bear and wolf control while weakening public oversight in that decision. There is no evidence these changes are needed; the state's professional game managers have not requested this derailment of strict standards to allow aerial predator control. The public has not asked for it; on the contrary, this bill defies public sentiment. 1999-07-28 Senate Journal Page 1816 SB 74 We have come a long way since the disgraceful and indiscriminate wolf killings of 1994, which were done in the name of predator control. Since then, we have initiated a new approach based on sound science and management under standards defined by the National Academy of Sciences, cost effectiveness, and enhanced public involvement. This bill undermines this process and would only serve to lose public confidence in the state's overall wildlife management. II, sec. 15 of the Alaska Constitution, I have vetoed the following bill: HOUSE CS FOR SENATE BILL NO. 130(JUD) An Act relating to immunity for sale or transfer of a firearm; relating to administrative functions performed by and fees charged by the Department of Public Safety for transfer of a firearm. The primary statutory functions of the Department of Public Safety are currently listed in AS 44.41.020(a) as those "relative to the protection of life and property." This bill adds to that statute the duty to administer "functions relating to transfer of a firearm," which is intended specifically for selling and trading fully automatic weapons. These are weapons designed to kill people and are prohibited by Alaska law, but permitted under federal law with proper certification. I do not wish to expend state resources to perform federal functions that allow lethal weapons in our state. 1999-07-28 Senate Journal Page 1817 SB 130 The transfer authorization forms require a chief law enforcement officer to certify he or she has no reason to believe that a person who wishes to purchase such a weapon will use it illegally. The Department of Public Safety (DPS) has refused to sign these transfer forms for years, as have most local law enforcement agencies. They refuse to do so for good reason. To authorize a person to own such a weapon requires extensive and time consuming background investigation and a leap of faith which responsible peace officers do not take. Alaska's policy to not sign these transfer forms is in line with other states as well. Among those states that refuse to sign the forms are Washington, Oregon, Colorado, Wyoming, Arizona, Montana, and Texas. Even federal agencies in Alaska, such as the Federal Bureau of Investigation and the U.S. Marshal, have refused to sign these forms and have passed the duty on to state and local law enforcement creating, essentially, an unfunded mandate. Local police departments rarely will complete these forms. To encourage them and the state to do so, SB 130 offers them liability immunity if the gun owner does end up using the weapon illegally. I veto this bill for several reasons: Currently the statutory core mission of DPS is to protect life and property. SB 130 would amend this core mission to include transfer of weapons. I cannot agree that the transfer of weapons, even if performed under a carefully planned program, should be statutorily elevated to the importance of life and safety. To do so trivializes and diminishes the agency's primary function. It arguably requires state and local law enforcement agencies to endorse ownership of weapons that are illegal in Alaska. It arguably requires state and local law enforcement agencies to perform a federal function. 1999-07-28 Senate Journal Page 1818 SB 130 It allows ownership of these weapons by people who, although they may have qualified for a concealed handgun permit, have not been screened by the extensive and costly background checks such ownership demands. It is poorly drafted, leading to ambiguity as to its practical effect. It was not given the thoughtful attention and probing analysis legislation of this importance requires. Events in our state and throughout the country show us that careless attention to weapon ownership is deadly. It could encourage weapon transfers without thorough background investigation because of the liability immunity provided. It threatens public safety because people other than the legal owner may gain access to the weapon. Supporters of this bill claim its intent is merely to assist gun collectors who want to trade their automatic weapons. But we must weigh the desires of an honest collector with the overall public safety. I cannot endorse legislation intended to facilitate ownership of these weapons. While $3 million of the reduction is in general funds, most of the difference is because FY1999 included $200 million in Alaska Housing Finance Corporation bonds for state projects, and nearly that much in airport bonds for Anchorage International Airport's Gateway Alaska project. 1999-07-28 Senate Journal Page 1820 SB 32 Even though the capital budget will be over $1 billion, it leaves many unmet capital needs, including deferred maintenance and schools. A balanced budget plan for Alaska is essential if we are to responsibly finance our statewide capital needs in the future. In the meantime, Alaska is extremely fortunate to receive increased federal aid to improve our transportation networks and eliminate the honey bucket. I have not vetoed any of the projects funded in this bill. However, I did follow the practice of other governors in vetoing any intent language that does not directly relate to appropriation amounts, whether or not I agree with the policy expressed in the intent language. State employees voted in 1980 to opt out of the federal Social Security system, in exchange for the Supplemental Annuity Plan (a component of the Supplemental Benefit System). This bill would set up another tier of benefits for some employees by reducing the states contribution to the Annuity Plan by half for all new employees. The State already has three tiers of employees receiving differing benefits resulting from retirement program changes in 1986 and most recently in 1996. 1999-07-28 Senate Journal Page 1821 HB 199 When compared to other states, Alaskan municipalities, the federal government and larger private companies in Alaska, the State of Alaska retirement benefits are not out-of-line or overly generous. In fact, Alaska currently ranks 27th among other states for employer retirement costs as a percentage of employee salary. Most municipalities in Alaska participate in either Social Security or the state Annuity Plan in addition to participating in the Public Employees' Retirement System (PERS). Participation in the Annuity Plan is actually less costly than the employers social security contribution. The costs of retirement benefits paid by the federal government and many larger private employers in Alaska also exceed retirement and Annuity costs currently paid by the state. Reducing state employee benefits legislatively to a level substantially below most other Alaskan public and larger private employers, without offering mitigation through improved wages or other monetary offsets, will seriously jeopardize the states ability to attract and retain qualified individuals to state service. It will also hamper the states ability to reach negotiated agreements with employee unions through collective bargaining. While the administration has and continues to support the amendments to the geographic pay differential proposed in this legislation to create parity among state employees, I find the changes to the Supplemental Annuity Plan to be so significant as to require a veto of this bill.
