The bill is unnecessary.  The Board of Game has devoted a great deal           
of effort toward clarifying and implementing the intensive management          
law previously adopted by the Legislature.  The board, with input from         
Alaska citizens and Alaska's wildlife management experts, has long             
been recognized as the best entity to deal with specific management            
concerns and plans, and the board's case-by-case planning approach is          
more appropriate than the type of changes implied by this bill.                
                                                                               
While the definitions, the over-emphasis on predatory control, and the         
disregard for non-game species all present problems for sound wildlife         
management, these provisions represent more a philosophical                    
orientation rather than new prescriptive management mandates. The bill         
adds little to existing laws that already require intensive game               
management in certain circumstances. It is the Administration's reading        
of the bill that the Board of Game, acting on departmental information         
and advice, will retain ultimate authority for making management               
decisions which are in accord with sound science and the large body            
of current law governing fish and wildlife management.                         
                                                                               
For these reasons I have allowed the bill to become law without my

The ultimate responsibility of any dental radiological equipment               
inspection program is to ensure the public's safety, both in the               
condition of the equipment itself and the way it is used.  I am signing        
SB 160 with the expectation that privatization of the inspections will         
improve efficiency and, therefore, better guarantee public safety.             
However, I also realize some provisions of this bill need further              
evaluation and will be refined as deemed necessary in the coming year.         
                                                                               
I am instructing my Board of Dental Examiners to work with the                 
Department of Health and Social Services and the Alaska Dental                 
Society to reexamine the inspector qualifications in this bill and             
determine whether amendments are necessary.  I also want the Board             
and Dental Society to consider how this bill will affect the cost of           
inspections in rural areas of the state and recommend ways to keep this        
necessary program affordable.                                                  
                                                                               
Finally, this bill only addresses inspection of dental radiological            
equipment and removal of that program from the Department of Health            
and Social Services.  It does not address evaluation of how dental             
technicians in the state are using the equipment.  I urge the Board and        
Society to work with the Department of Health and Social Services to

As you know from your work on the bipartisan task force on                     
subsistence, Alaska's challenge is to prevent a federal takeover of fish       
and game management in Alaska and protect the vital importance of              
subsistence to the economy and culture of rural Alaska.  Committee             
Substitute for House Bill 406 (FIN) am (efd fld), (HB 406), fails to           
accomplish either of these goals.  In addition, this bill would create an      
unworkable, intrusive and expensive bureaucracy to manage a needs-             
based system largely opposed by the Alaskans who participate in                
subsistence.                                                                   
                                                                               
An overwhelming majority of Alaskans agree on two key principles for           
a  subsistence  solution: 1) state, rather  than  federal management of

Alaska's fish and game; and 2) a rural subsistence priority.  Securing         
state management of our fish and game resources was one of the                 
fundamental reasons Alaska became a state, and it remains a critical           
imperative as we enter our 40th year of statehood.  HB 406 does not            
help our efforts to secure this management; in fact, it harms them.  It        
is simply an invitation to the federal government to come in and take          
over fish and game management in Alaska.                                       
                                                                               
HB 406 does not bring Alaska into compliance with the Alaska                   
National Interest Lands Conservation Act (ANILCA), as many                     
members of the Legislature have freely admitted.  HB 406 fails to              
provide the fundamental protection for the subsistence way of life             
which was embodied in ANILCA and which has been part of Alaskas                
subsistence laws since 1978.  The bill does not provide a priority for         
subsistence based on rural residence, and it calls for an individual           
qualification system, contrary to the community or area basis central          
to ANILCA.  In addition, HB 406's proposed regional advisory                   
committee system is inconsistent with ANILCA, and the bill requires            
unworkable criteria for the establishment of non-subsistence areas.            
                                                                               
All these provisions, and perhaps others, raise problems with ANILCA           
compliance that will lead to federal management.  In his memorandum            
on HB 406, Interior Department Solicitor John Leshy advises the                
Interior Secretary that the bill is not consistent with ANILCA and, "if        
the approach in CSHB406 is not altered, and a state constitutional             
amendment is not placed before the voters in the November 1998                 
general election, you will be required to assume management of                 
subsistence fisheries on the public lands on December 1, 1998, as              
required by ANILCA and the Federal courts."                                    
                                                                               
In addition, HB 406:                                                           
                                                                               
*Directs the Boards to establish discrete and overlapping                     
subsistence-dependent areas, based on thousands of specific stocks             
and populations, for which individuals would have to be eligible.              
                                                                               
*Establishes an individual qualification system that undermines the           
fundamental nature of subsistence, which is community-based and                
revolves around the efficiencies incumbent in the sharing of gear              
and labor as well as subsistence products.

*Requires a government agency to evaluate an individuals food-                
gathering habits using ill-defined criteria that, in many cases, will          
be impossible to verify.  A conservative estimate of the cost of the           
new, large, and intrusive bureaucracy required to handle individual            
eligibility determinations is $4 million.                                      
                                                                               
*Directs the Boards to identify as nonsubsistence areas those                 
communities or areas in which a cash-based economy is a                        
principal characteristic.  Using this standard, most rural parts of            
the state would become nonsubsistence areas.  The North Slope                  
Borough would be a nonsubsistence area, as would the Copper                    
Basin, Southeast Alaska, and Bristol Bay.                                      
                                                                               
*Requires annual determinations on potentially tens of thousands of           
individual people's use of fish and game on an area-specific and               
species-specific basis.  HB 406 would place an impossible burden               
on the Boards, which would have to adjudicate the eligibility of               
subsistence applicants.                                                        
                                                                               
*Calls for the Boards to create separate nonsubsistence areas for             
fish and for game.  There could even be nonsubsistence areas for               
different species of fish and game.  The result would be a hopeless            
tangle of conflicting regulations, making management and                       
enforcement difficult or impossible.                                           
                                                                               
*Establishes presumptions, based upon where Alaskans live, that               
qualify or disqualify them as subsistence users.  The presumptions             
violate the present "equal access" clauses of the Alaska                       
Constitution, but HB 406 is not accompanied by a resolution that               
would amend those clauses.                                                     
                                                                               
In short, this bill does not work.  It is not constitutional, it does not      
comply with ANILCA, and most importantly, it will not return or                
retain state management of fish and game resources on all lands and            
water in our state.                                                            
                                                                               
Ensuring state management of fish and game resources is not                    
complicated.  The proposal of the bipartisan task force would have             
provided a solution.  It would have provided both the constitutional           
framework  and  changes  in  state  law  necessary  to  comply  with

ANILCA, met the objectives of state management of fish and game,               
and recognized the importance of subsistence for rural Alaskans.               
Unfortunately, this proposal did not pass during either the regular or         
special session.                                                               
                                                                               
My Administration worked hard for a compromise solution during the             
first special session.  As this compromise received broad support, I           
urge the Legislature to continue considering this approach to allow the        
people of Alaska to resolve one of the biggest challenges to the basic

expenditure of these receipts at the discretion of the Legislative Budget      
and Audit Committee.  This changes a process agreed to by the                  
legislative and executive branches of the state nearly twenty years ago        
to end a lawsuit over the power of the Legislative Budget and Audit            
Committee to control the expenditure of these receipts.                        
                                                                               
If the Legislature's action disapproving expenditures over the interim         
were the final say without any executive branch power, the following           
could not have been achieved:                                                  
                                                                               
*Distribution of payments in lieu of federal taxes to nearly 100              
communities according to the intent of Congress such as Angoon,                
Bethel, Craig, Cordova, Delta Junction, Dillingham, Nenana,                    
Nome, Shishmaref, and Unalaska.                                                
                                                                               
*Purchase of land on the Homer Spit.                                          
                                                                               
*Payment of vendors who had already provided salmon marketing

The process established in existing law allows adequate oversight by           
the legislative budget and audit committee while affording a reasonable        
opportunity for state agencies to spend unanticipated receipts.  The bill      
makes an excessive delegation of power to an interim committee of the          
Legislature and, by introducing a potentially substantial delay to the         
process of authorization, may jeopardize the state's ability to expend

I expect the Legislature's support for establishing this council is            
indicative of its intent to fully fund the cost of its operations.  I know     
the Legislature did not intend for this important Council to be funded         
at the expense of other Department of Public Safety programs.  I               
anticipate the Legislature will provide the necessary additional funds

As elected officials, we are obligated to promote public health policies       
that will reduce, and hopefully eliminate, communicable diseases.              
America has a long history of public health principles that have been          
successful in controlling the spread of disease.  Integral to those            
principles is encouraging the voluntary cooperation of infected                
individuals with public health officials to stop further transmission.         
Building that trusting, cooperative environment is the very linchpin of        
public health success, without which numerous diseases such as                 
tuberculosis, syphilis, and diphtheria would not have been brought             
under control.                                                                 
                                                                               
Senate Bill 17 (SB 17) flies in the face of sound, proven public health        
practice.  It offers little to gain in establishing a crime that prosecutors   
would be hard pressed to use.   Alaska already has criminal laws on            
the books that address the issue targeted by this bill.  More                  
importantly, it offers much to lose by creating a disincentive for             
people, out of fear of prosecution as a criminal, to come forward, be          
tested, and work with public health officials to identify others who           
may be at risk.  The bill would cause this harm while reinforcing a            
climate of stigma, fear and misinformation about the human                     
immunodeficiency virus (HIV).  Other diseases are highly infectious,           
even more so than HIV, and are deadly.  Yet no other disease is                
named in Alaska law as criminal, nor should be.                                
                                                                               
Alaska law currently contains the crime of reckless endangerment,              
which addresses any type of reckless conduct creating a risk of serious        
injury to others, whether recklessly using firearms or recklessly              
exposing others to HIV or other deadly diseases.

As you know, this was the last bill passed by the Senate, and a                
question has been raised whether this bill was passed within the               
constitutionally limited 120-day legislative session.  The clocks most         
people rely on in determining when the session ends showed the                 
motion to concur in the House amendments, and the vote, both                   
occurred after midnight.  That may end up a question for future                
litigation, but my veto addresses only the merits of this bill.                
                                                                               
HIV is a public health problem and should not be treated as a criminal         
justice problem.  Public health officials, when necessary, have                
authority to exercise public health powers which would allow a range           
of actions, up to and including isolation or quarantine of persons who         
pose a threat of spreading diseases, in those rare instances when an           
infected person refuses or is incapable of responsible action.  The State      
of Alaska is firmly committed to protecting the health of its citizens.        
In so doing, we must appropriately balance public health needs with            
rights and responsibilities. SB 17 dangerously upsets that balance.

The final operating budget for Fiscal Year 1999 reflects the significant       
progress we made together this year on the major goals of the budget           
I proposed last December -- safe, healthy children and communities,            
quality education, good jobs for Alaskans and budget discipline.               
Among the highlights of our bipartisan effort:                                 
                                                                               
*An historic increase in funds for our schools and partial restoration        
of money for the University of Alaska;

*A major step toward zero tolerance for the abuse and neglect of              
Alaska's children through my Smart Start initiative, including                 
adding 28 more child protection workers;                                       
                                                                               
*Improving public safety with 15 more state Troopers and sorely               
needed pay raises for Village Public Safety Officers;                          
                                                                               
*Continuing our partnerships with industry to "do it right" when it           
comes to responsible development of Alaskas resources by hiring                
Alaskans and protecting and conserving our air, water and habitat;             
and                                                                            
                                                                               
*Ensuring efficient government services and demonstrable results.             
                                                                               
This budget makes these major new commitments to children,                     
education and economic development without severely undermining                
other important services provided by our departments.  In the end, the         
Legislature generally adopted a hold the line approach to state                
services and avoided the massive cuts that worried many Alaskans. I            
believe theres broad consensus in Alaska that even in a time of lower          
oil prices, we can ill afford to ignore the needs of our children and          
public schools.  Nevertheless, since Fiscal Year 1995, the general fund        
budget has been cut $237.5 million. It is now $1,605 less per person           
in todays dollars than it was in 1979, the last pre-oil boom budget            
year.                                                                          
                                                                               
I have opted against vetoing any funds proposed in this budget bill.           
I did, however, follow a long-standing practice of Alaska governors by         
vetoing all intent language unless it specifically addresses funding,          
such as recommending that a department pursue program receipt                  
authorization during the year.  Governors have routinely vetoed intent         
language because it is not consistent with the limitations our state           
Constitution places on appropriations bills.  I note that in many cases        
I wholeheartedly agree with the expressed intent, such as increasing           
Alaska National Guard recruitment efforts in rural Alaska.                     
                                                                               
You will also see that I have lined out the "missions and measures"            
language inserted into the budget bill during the Finance Committee            
process.  Again, this does not signal my disagreement with either the          
concept of performance  budgeting  or having  written  missions and

measures.  Although missions and measures have been in state budget            
documents for years, they were largely ignored.  My administration has         
worked to turn them from a rote exercise into a more effective focus           
on state government goals and strategies, and how the budget can               
support them.                                                                  
                                                                               
This effort began with our first Executive Budget Summary which                
completely changed the way the governors office presented its budget           
to the public.  First, I outlined my statewide goals and strategies.  Then     
each department did the same, plus highlighted its key performance             
measures.  The next year, our Budget Summary told people what                  
progress we were making on those measures.                                     
                                                                               
I am pleased the Legislature headed in the direction of performance            
budgeting this year.  However, because of the state constitutional limit       
on the content of budget bills, we suggested that missions and                 
measures be adopted in another form, not the appropriations bill.  I           
look forward to working with the Legislature to implement effective            
results-based budgeting and to finding the most appropriate way to             
present it to the public.                                                      
                                                                               
                                                                               
As we close out this year's work on the Fiscal 1999 budget,  we face           
even greater challenges next year to sustain the important initiatives         
begun in this budget. For instance, in FY2000 we must provide                  
childrens health coverage for a full 12 months, make the second                
installment on our financial commitment to Quality Education and               
begin paying debt service on the new AHFC bond-funded projects.                
Some of these investments will pay future dividends in the form of             
lower costs and healthier, better educated children.                           
                                                                               
                                                                               
The Legislature also will have to address some unfilled FY1999 needs,          
such as adequate funding for the Catastrophic and Chronic Illness              
Assistance program (the replacement for General Relief Medical),               
disaster relief, continued compliance with the court order on prison           
conditions in the Cleary case and increased courtroom security.                
(Interagency receipts for more security were authorized in the Trooper         
budget but the court did not get additional funds to pay them.)

The comprehensive mental health budget required by law brings                  
together all operating and capital appropriations for programs and             
projects serving beneficiaries of the Mental Health Trust Authority.           
Considerable progress has been made in the few short years since this          
new budget process was put into place despite the difficulty of                
working in a period of budget cuts. I would like to express my sincere         
appreciation to the trustees and staff of the Mental Health Trust              
Authority for the work they do on behalf of Trust beneficiaries.  I            
particularly commend the Mental Health Trust Authority for its fine            
work this year to incorporate thoughtful results-based budgeting in its        
process and presentation.                                                      
                                                                               
I did not veto any funds from this bill.  I did, however, follow a long-

I am pleased to transmit the Fiscal Year 1999 capital budget to you.           
Along with the school debt reimbursement bill I signed earlier this            
month, it funds most of the projects I proposed last December. The             
new capital budget adds jobs with upgrades to the Anchorage and                
Fairbanks International Airports, roads and harbors. It improves public        
health by investing in rural water and sewer systems. It addresses             
sorely needed deferred maintenance at public schools and state                 
facilities, including the University of Alaska and Pioneers Homes. And         
it improves Alaska's transportation infrastructure which is so key to our      
economic well-being.                                                           
                                                                               
The capital budget shows my Administration and the Legislature have            
similar views about where Alaska needs to invest its public capital            
dollars, although there are  differences in some of the financing              
arrangements used for these projects.  Even with the large dollar              
amounts committed in this bill and the new school debt reimbursement           
program, we still have a long way to go to bring all our schools and           
state facilities into good working order and meet the need for new             
classrooms.  I commend the Legislatures Deferred Maintenance Task              
Force for its work to bring the problem to the forefront of public             
attention.

A few issues raised in this budget require mention. I have followed a          
long-standing practice of Alaska governors by vetoing the intent               
language on pages 42, 48 and a separate letter of intent inserted in the       
bill.  Whether they agree with the content or not, governors have              
routinely vetoed intent language because it is not consistent with the         
limitations our state Constitution places on appropriations bills.             
                                                                               
Some federal demonstration projects were also added even though only           
a small percentage of the funds for them will be available in the states       
Fiscal Year 1999 budget and the match requirements have not been               
fully funded.  Again, this raises expectations in the communities which        
cannot be met in this budget year.                                             
                                                                               
Many have wondered if the budget approved by the Legislature will              
require more than the $700 million from the Constitutional Budget              
Reserve Fund  (CBR), which was the limit established in this bill. The         
budget was based on the Department of Revenue Spring Revenue                   
Forecast price of $15.32 per barrel and the Administration and                 
Legislature agreed the public would be ill served by making major              
decisions based on changing week-to-week prices.  One of the reasons           
Alaskans voted to establish the CBR was to save money in years of              
high oil prices so public services can continue without undue                  
disruption when prices are low.  We have already accomplished the              
savings side of the equation, building our CBR up to $3.47 billion over        
the past three years.  If prices remain low and more than $700 million         
in reserves would be needed to complete next fiscal year, the                  
Legislature will have to reevaluate the limit in January.  That will also      
be the time to provide supplemental funding from the CBR or the                
general fund to fix critical, time-sensitive Year 2000 problems.               
                                                                               
In summary, this Fiscal Year 1999 capital budget will be good for              
Alaskans, good for Alaskan businesses and good for Alaska's economy.
