Senators Adams, Zharoff were excused from a call of the Senate. Senators Frank, Pearce, Rieger were absent. The prayer was offered by the Chaplain, Pastor David Snyder of the Lighthouse Baptist Church. Senator Duncan moved and asked unanimous consent that the prayer be spread. Without objection, it was so ordered. Dear Heavenly Father, I thank You for today and for Your many blessings. I pray for the Senate as they meet again today, that You would be with all of the activities of the day. THIRD READING OF SENATE BILLS SB 210 CS FOR SENATE BILL NO. 210(FIN) "An Act relating to disposals of state land within five miles of the right-of-way of the Dalton Highway to a licensed public utility or a licensed common carrier; relating to disposals of state land for nonresidential development in nodes of development along the Dalton Highway; and allowing state leases and materials sales for reconstruction and maintenance of state highways and construction or maintenance of airports" was read the third time. Senator Kerttula moved that CS FOR SENATE BILL NO. 210(FIN) be returned to second reading for the purpose of a specific amendment, that being Amendment No. 1. Senator Kelly objected, then withdrew his objection. There being no further objections, the bill was returned to second reading. AS 19.40.200 is amended by adding a new subsection to read: (d) Notwithstanding another provision of law, when the department determines and orders that a utility facility located across, along, over, under, or within the highway right-of-way must be changed, relocated, or removed, the licensed public utility owning or maintaining the facility shall change, relocate, or remove it in accordance with the order and is responsible for the cost of the change, relocation, or removal." Senator Kerttula moved and asked unanimous consent for the adoption of Amendment No. 1. Senator Frank objected, then withdrew his objection.
