AS 18.45.025(c) is amended to read: 04 (c) The Department of Environmental Conservation shall adopt regulations 05 governing the issuance of permits required by (a) of this section. However, a permit 06 may not be issued until the municipality with jurisdiction over the proposed facility 07 site has approved the permit or, if the proposed facility site is located in an 08 unorganized borough, until the legislature has approved the permit. 09 * Sec. 2. AS 18.45.025 is amended by adding a new subsection to read: 10 (d) Notwithstanding (b) of this section, a person that is otherwise compliant 11 with this chapter may construct a microreactor on land that has not been designated by 12 the legislature. 13 * Sec. 3. AS 18.45.030 is amended by adding new subsections to read: 14 (b) The requirements set out under (a) of this section do not apply to the 15 presence of microreactors in the state.

01 (c) If the Department of Environmental Conservation receives notice that a 02 person has submitted a Nuclear Regulatory Commission license application for a 03 microreactor located in the state, the Department of Environmental Conservation shall 04 coordinate and submit comments from the departments or agencies under (a) of this 05 section on the Nuclear Regulatory Commission licensing process specific to the 06 microreactor. 07 * Sec. 4. AS 18.45.900 is amended by adding a new paragraph to read: 08 (9) "microreactor" means a nuclear utilization facility that is 09 (A) a nuclear fission reactor consistent with the definition of 10 "advanced nuclear reactor" in 42 U.S.C. 16271; and 11 (B) capable of generating not more than 50 megawatts of 12 electric energy.
