00 HOUSE BILL NO. 320 01 "An Act relating to medical assistance coverage for women's health services; and 02 providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 47.07.030(b) is amended to read: 05 (b) In addition to the mandatory services specified in (a) of this section and the 06 services provided under (d) and (i) of this section, the department may offer only the 07 following optional services: case management services for traumatic or acquired brain 08 injury; case management and nutrition services for pregnant women; personal care 09 services in a recipient's home; emergency hospital services; long-term care 10 noninstitutional services; medical supplies and equipment; advanced practice 11 registered nurse services; clinic services; rehabilitative services for children eligible 12 for services under AS 47.07.063, substance abusers, and emotionally disturbed or 13 chronically mentally ill adults; targeted case management services; inpatient 14 psychiatric facility services for individuals 65 years of age or older and individuals

01 under 21 years of age; psychologists' services; clinical social workers' services; marital 02 and family therapy services; professional counseling services; midwife services; 03 prescribed drugs; physical therapy; occupational therapy; chiropractic services; low- 04 dose mammography screening, as defined in AS 21.42.375(e); hospice care; treatment 05 of speech, hearing, and language disorders; adult dental services; prosthetic devices 06 and eyeglasses; optometrists' services; intermediate care facility services, including 07 intermediate care facility services for persons with intellectual and developmental 08 disabilities; skilled nursing facility services for individuals under 21 years of age; and 09 reasonable transportation to and from the point of medical care. 10 * Sec. 2. AS 47.07.030(e) is amended to read: 11 (e) The department shall provide the services set out in (a), [AND] (b), and (i) 12 of this section to an eligible person, notwithstanding the person's participation in an 13 approved clinical trial. In this subsection, "approved clinical trial" has the meaning 14 given in AS 21.42.415. 15 * Sec. 3. AS 47.07.030 is amended by adding a new subsection to read: 16 (i) The department shall establish as optional services a program for women's 17 health services that provides family planning services, health screening examinations, 18 and related services. 19 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 20 read: 21 22 MEDICAID STATE PLAN FEDERAL APPROVAL. The Department of Health and 23 Social Services shall, on or before January 1, 2023, amend and submit for federal approval the 24 state plan for medical assistance coverage consistent with AS 47.07.030(b) and (e), as 25 amended by secs. 1 and 2 of this Act, and AS 47.07.030(i), enacted by sec. 3 of this Act. 26 * Sec. 5. The uncodified law of the State of Alaska is amended by adding a new section to 27 read: 28 29 CONDITIONAL EFFECT; NOTIFICATION. (a) Sections 1 - 3 of this Act take effect 30 only if and only to the extent that the United States Department of Health and Human 31 Services approves, on or before January 1, 2023, the amendments to the state plan for medical

01 assistance under AS 47.07.030(b) and (e), as amended by secs. 1 and 2 of this Act, and 02 AS 47.07.030(i), enacted by sec. 3 of this Act. 03 (b) If the United States Department of Health and Human Services approves some or 04 all of the amendments to the state plan submitted under sec. 4 of this Act, the commissioner of 05 health and social services shall notify the revisor of statutes in writing not later than 30 days 06 after receiving notice of the approval. 07 * Sec. 6. If secs. 1 - 3 of this Act take effect, they take effect on the day after the date the 08 revisor of statutes receives notice from the commissioner of health and social services under 09 sec. 5 of this Act.
