00 HOUSE BILL NO. 34 01 "An Act relating to eligibility to serve on state boards, commissions, and authorities." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 39.05.100 is amended by adding new subsections to read: 04 (c) A person is not eligible to serve on a state board, commission, or authority 05 if the person sought nomination or became a candidate for elective municipal, state, or 06 federal office during the preceding year, unless holding a particular elective municipal, 07 state, or federal office is required by law for appointment. 08 (d) A member of a state board, commission, or authority who seeks 09 nomination or becomes a candidate for elective municipal, state, or federal office 10 terminates membership on the state board, commission, or authority unless the 11 member is standing for reelection to the municipal, state, or federal office, and is 12 serving as an ex officio member of the state board, commission, or authority. 13 (e) In this section, a person seeks nomination or becomes a candidate if the 14 person 15 (1) under regulations adopted by the Alaska Public Offices

01 Commission to implement AS 15.13.100, indicates an intention to become a candidate 02 for elective municipal office, including a seat on a municipal school board, or state 03 executive or legislative office; 04 (2) has filed a nominating petition, declaration of candidacy, or other 05 required filing for elective municipal office, including a seat on a municipal school 06 board, with a municipal clerk or other municipal official designated to receive filings 07 for municipal office; 08 (3) has filed a nominating petition under AS 15.25.140 - 15.25.200, 09 AS 15.30.026, AS 15.40.180, 15.40.190, 15.40.270 - 15.40.290, or 15.40.430 - 10 15.40.450 to become a candidate for elective state or federal executive or legislative 11 office; 12 (4) has filed a declaration of candidacy for elective state or federal 13 office under AS 15.25.030; or 14 (5) campaigns as a write-in candidate for elective municipal, state, or 15 federal executive or legislative office. 16 * Sec. 2. AS 39.25.160(e)(8) is repealed. 17 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 18 read: 19 APPLICABILITY. This Act applies to 20 (1) members of state boards, commissions, or authorities seeking nomination 21 or becoming a candidate for elective municipal, state, or federal office on or after the effective 22 date of this Act; and 23 (2) the eligibility for appointment to state boards, commissions, or authorities 24 of persons seeking nomination or becoming a candidate for elective municipal, state, or 25 federal office on or after the effective date of this Act. 26 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 27 read: 28 REVISOR'S INSTRUCTION. The revisor of statutes is instructed to change the 29 heading of AS 39.05.100 from "Qualifications for appointment" to "Qualifications for 30 appointment and service."
