00 CS FOR SENATE BILL NO. 105(L&C) 01 "An Act relating to the retrospective application and applicability of the overtime 02 compensation exemption for flight crew members; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 05 to read: 06 OVERTIME COMPENSATION EXEMPTION FOR FLIGHT CREW WORK 07 PERFORMED AFTER JANUARY 1, 2000. The provisions of AS 23.10.060(d)(19), as 08 enacted by sec. 1, ch. 11, SLA 2003, apply to work performed on or after January 1, 2000. 09 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 10 read: 11 RETROSPECTIVE APPLICATION. This Act applies retrospectively to all actions 12 and proceedings under AS 23.10.060(b) that are based on a claim for overtime compensation 13 for employment as a flight crew member on or after January 1, 2000, and that are not 14 determined by final court judgment or administrative decision on or before the effective date
01 of this Act. For purposes of this section, "flight crew member" means a person performing 02 work under AS 23.10.060(d)(19), as enacted by sec. 1, ch. 11, SLA 2003. 03 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
