00 SENATE BILL NO. 205 01 "An Act relating to control of nuisance wild animals; and providing for an effective 02 date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 16.05.255(a) is amended to read: 05 (a) The Board of Game may adopt regulations it considers advisable in 06 accordance with AS 44.62 (Administrative Procedure Act) for 07 (1) setting apart game reserve areas, refuges, and sanctuaries in the 08 water or on the land of the state over which it has jurisdiction, subject to the approval 09 of the legislature; 10 (2) establishing open and closed seasons and areas for the taking of 11 game; 12 (3) establishing the means and methods employed in the pursuit, 13 capture, taking, and transport of game, including regulations, consistent with resource 14 conservation and development goals, establishing means and methods that may be
01 employed by persons with physical disabilities; 02 (4) setting quotas, bag limits, harvest levels, and sex, age, and size 03 limitations on the taking of game; 04 (5) classifying game as game birds, song birds, big game animals, fur 05 bearing animals, predators, or other categories; 06 (6) methods, means, and harvest levels necessary to control predation 07 and competition among game in the state; 08 (7) watershed and habitat improvement, and management, 09 conservation, protection, use, disposal, propagation, and stocking of game; 10 (8) prohibiting the live capture, possession, transport, or release of 11 native or exotic game or their eggs; 12 (9) establishing the times and dates during which the issuance of game 13 licenses, permits, and registrations and the transfer of permits and registrations 14 between registration areas and game management units or subunits is allowed; 15 (10) regulating sport hunting and subsistence hunting as needed for the 16 conservation, development, and utilization of game; 17 (11) taking game to ensure public safety; 18 (12) regulating the activities of persons licensed to control nuisance 19 wild birds and small mammals. 20 * Sec. 2. AS 16.05.330(a) is amended to read: 21 (a) Except as otherwise permitted in this chapter, without having the 22 appropriate license or tag in actual possession, a person may not engage in 23 (1) sport fishing, including the taking of razor clams; 24 (2) hunting, trapping, or fur dealing; 25 (3) the farming of fish, fur, or game; [OR] 26 (4) taxidermy; 27 (5) control of nuisance wild birds and small mammals for 28 compensation. 29 * Sec. 3. AS 16.05.340(a) is amended by adding a new paragraph to read: 30 (25) nuisance wild animal control license...............................$100. 31 * Sec. 4. AS 16.05.340 is amended by adding a new subsection to read:
01 (h) Subject to regulations adopted by the Board of Game, a person who holds 02 a nuisance wild animal control license may engage in the control of nuisance wild 03 birds and small mammals for compensation. 04 * Sec. 5. The uncodified law of the State of Alaska is amended by adding a new section to 05 read: 06 ADOPTION OF REGULATIONS. The Board of Game shall adopt regulations under 07 AS 16.05.255(a)(12), added by sec. 1 of this Act, governing the activities of a person who is 08 licensed to control nuisance wild birds and small mammals. The regulations shall take effect 09 January 1, 2002. 10 * Sec. 6. Sections 2 - 4 of this Act take effect January 1, 2002. 11 * Sec. 7. Sections 1 and 5 of this Act take effect immediately under AS 01.10.070(c).
