00HOUSE BILL NO. 112 01 "An Act relating to unemployment compensation for persons employed by 02 educational institutions in other than educational, research, or principal 03 administrative capacities." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 23.20.354(b) is amended to read: 06  (b) An individual who has otherwise satisfied the requirements of this chapter 07 for the receipt of regular benefits is eligible for state interim benefits if 08  [(1) THE INDIVIDUAL'S WEEKLY BENEFIT AMOUNT PAYABLE 09 UNDER THIS CHAPTER IS REDUCED OR DENIED UNDER AS 23.20.381(h); OR 10  (2)] the individual is a noncertificated individual who provides 11 compensated service to a school district for teaching indigenous languages and the 12 individual's weekly benefit amount payable under this chapter is reduced or denied 13 under AS 23.20.381(e). 14 * Sec. 2. AS 23.20.354(c) is amended to read:

01  (c) The amount of state interim benefits payable to an individual for a week 02 is equal to the difference between the individual's weekly benefit amount, including 03 the dependents allowance, established under AS 23.20.350 and the individual's weekly 04 benefit amount, including the dependents allowance, payable for that week under 05 AS 23.20.381(e) [OR 23.20.381(h)]. The total amount of state interim benefits paid 06 may not exceed the total amount of regular benefits denied solely under 07 AS 23.20.381(e) [OR 23.20.381(h)]. 08 * Sec. 3. AS 23.20.381(i) is amended to read: 09  (i) Benefits based on services described in (e) [AND (h)] of this section may 10 not be paid to an individual for a week that begins during an established and 11 customary vacation period or holiday recess if the individual performs those services 12 in the period immediately before the vacation period recess and there is a reasonable 13 assurance that the individual will perform those services in the period immediately 14 following the vacation period or holiday recess. 15 * Sec. 4. AS 23.20.381(j) is amended to read: 16  (j) Benefits based on services described in (e) [AND (h)] of this section shall 17 be denied under (e) [, (h),] and (i) of this section to an individual who performed those 18 services in an educational institution while in the employ of an educational service 19 agency. In this subsection, "educational service agency" means a governmental agency 20 or governmental entity that is established and operated exclusively for the purpose of 21 providing services to one or more educational institution. 22 * Sec. 5. AS 23.20.381(h) is repealed.
