01 "An Act relating to eligibility for permanent fund dividends; and providing for                                         
02 an effective date."                                                                                                     
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 43.23.015(a) is amended  to read:                                                                   
05  (a)  The commissioner shall adopt regulations under AS 44.62 ( [THE]                                                
06 Administrative Procedure Act) [(AS 44.62)]  for determining the eligibility of                                        
07 individuals for permanent fund dividends. The commissioner may require an individual                                    
08 to provide proof of eligibility, and the commissioner may use other information                                         
09 available from other state departments or agencies to determine the eligibility of an                                   
10 individual. The commissioner shall consider all relevant circumstances in determining                                   
11 the eligibility of an individual. However, [THE RESIDENCY OF AN INDIVIDUAL'S                                            
12 SPOUSE MAY NOT BE THE PRINCIPAL FACTOR RELIED UPON BY] the                                                              
13 commissioner in determining the residency of the individual may not consider as a                                      
14 factor the                                                                                                              

01   (1)  residency of an individual's spouse; or                                                                         
02   (2)  duration of an individual's military service if this state was the                                              
03 home of record for that individual filed with the military upon entry into military                                     
04 service.                                                                                                               
05    * Sec. 2.  This Act takes effect January 1, 1996.
