I, therefore, find that the Department of Public Safety can most

appropriately and effectively perform the functions of Section

50-1-4, ACLA 1949, subparagraph (e), items (1), (2), (4), (5), (6),

(7), and (8), as amended; Section 50-1-4, ACLA 1949, subparagraph

(f); Section 50-1-4, ACLA 1949, subparagraph (g), item (1); Section

EXECUTIVE ORDER NO. 016

Pursuant to the provisions of Section 20, Chapter 64, Session Laws of

Alaska, 1959, I hereby create a Governor's Advisory Committee on

Economic Development.

This committee is to be established for purposes of studying State,

regional, and local economic problems and formulating alternative

recommendations for review by the Office of the Governor. It may

publicize its purposes and objectives, enter into agreements to

conduct surveys and studies relating to economic problems of the

State, and may accept services of personnel of public and private

agencies in gathering information thereon. The committee may accept

gifts and grants from the federal government, state government, local

governments, private individuals, foundations and other agencies, if

such gifts and grants are made for furtherance of the study

objectives for which the committee is established. It shall adopt, by

resolution of a majority of its full membership, any recommendations

for submission to the Office of the Governor. It shall make annual

reports to the Governor.

The committee shall have the following objectives:

1. Provide inspiration and coordination in furthering sound State,

regional and local economic growth.

2. Assist in delineating various types of economic regions in the

State and the criteria which underline these regions including

economic problems and economic potentialities which can be visualized

and met primarily on a regional basis, trade characteristics,

existing transportation and communication systems and the general

relationships of these criteria to the natural resource endowment of

the State.

3. Undertake careful deliberation and advance planning to assure

itself of an over-all perspective on the economic potentialities of

the several regions of the State whether they lie in long-term

expansion of industry, diversification of economic activities,

creation of greater self-sufficiency of regional and local economies,

or improving the livability of communities.

4. Point out weak and strong points of the economy of the State,

taking into account the potentials of all regions and communities

whether they be in providing tourist facilities, improving the

transportation system, retraining unemployed workers, creating

opportunities for attracting heavy and light industry or improving

resource utilization and management, or otherwise.

5. Review carefully various economic solutions to economic problems

and recommend state-wide and regional development programs to

overcome problems, realize potentialities and harmonize State and

national economic growth trends.

6. Assist local groups in formulating economic growth objectives and

identifying economic projects.

7. Recommend means by which regions having heavy reliance on military

activity can reach a greater degree of self-sufficiency and balance

in their economies.

8. Suggest all desirable means of harmonizing the State's economic

development program with the Area Redevelopment Program administered

by the U.S. Department of Commerce.

WHEREAS, the Department of Revenue is the Department of the State

Government primarily charged with the duties, powers, and

responsibilities involved in the collection, accounting for, custody,

investment and management of all state funds; and

WHEREAS, the Department of Fish and Game is the Department of the

State Government primarily charged with the regulation and management

of the fish and game resources of the State of Alaska; and

WHEREAS, the Department of Fish and Game is also charged with certain

duties and powers relative to the collection, accounting for and

custody of state revenues which are only incidental to the

Department's regulation and management of the fish and game resources

of the State of Alaska,

THEREFORE IT IS ORDERED

1. All duties, functions and powers relative to the collection,

accounting for and custody of state revenues, which are only

incidental to the regulation and management of the fish and game

resources of the State of Alaska, at present performed by the

Department of Fish and Game, are transferred to the Department of

Revenue.

2. The Department of Revenue shall be deemed and held to constitute a

continuation of the Department of Fish and Game with the same force

and effect, as to the transferred functions, powers and duties as if

the functions, powers and duties had not been transferred.

3. All funds appropriated to the Department of Fish and Game prior to

the transfer of those functions, power and duties attributable to the

transferred functions, power and duties are transferred to

appropriate line items in the appropriation of the Department of

Revenue.

4. This order shall become effective at a date hereafter to be

designated (July 1, 1962).

EXECUTIVE ORDER NO. 018

March 15, 1962

1. Pursuant to Sec. 23, Art. III of the Constitution of the State of

Alaska, there is hereby established a Department of Highways which

shall be a principal department of the state government in addition

to those established pursuant to Sec. 2, Ch. 64, SLA 1959.

2. There shall be a principal executive officer of the Department of

Highways to be known as the Commissioner of Highways.

3. The duties, powers, and responsibilities involved in the

construction, maintenance, and operation of all state highways,

roads, bridges, traffic signs and signals, and other like facilities;

and in the supervision and maintenance of all state equipment,

including automotive and mechanical equipment used in the exercise of

such duties, powers and responsibilities conferred on the Department

of Public Works by virtue of Sec. 19, Ch. 64, SLA 1959, are hereby

transferred from the Department of Public Works to the Department of

Highways.

4. The Division of Highways within the Department of Public Works is

abolished. The Commissioner of Highways, in cooperation with the

Commissioner of Public Works, shall provide for the orderly

conclusion of any outstanding affairs of the Division of Highways and

the transfer of any of the records, property and personnel affected

by this executive order.

5. The Commissioner of Administration shall provide for the transfer

of unexpended balances of appropriations, allocations and other funds

of the Department of Public Works available or to be made available

for use in connection with any function affected by this order as he

deems necessary to carry out the provisions of this order and to

implement Alaska's highway program.

6. The Commissioner of Highways shall be paid an annual salary of

$17,000.00, until otherwise provided by law.

7. Steps necessary to carry out this order shall be initiated

immediately and shall continue as rapidly as possible consistent with

the orderly development of Alaska's highway program. In any case,

this reorganization shall be effective no later than June 30, 1963.

May 14, 1962

Pursuant to Section 29, Chapter 64, SLA 1959, the Department of

Natural Resources is charged with the duties, powers, and

responsibilities involved in the enforcement of laws, and in the

promulgation of rules and regulations under such laws, concerned with

industrial safety of all oil and gas exploratory, drilling and

production operations within the State of Alaska.

EDITOR'S NOTE. - Former Executive Order No. 20, dated June 1962, read

as follows: "WHEREAS the increasing growth and complexity of

government functions require that the fiscal procedures of the State

keep pace with that growth and,

"WHEREAS the performance of programs outlined in the Executive Budget

within the limits established by the Legislature is a fundamental

requirement of effective budget management and execution, and

"WHEREAS the relationship of the disbursement of funds from the

treasury to receipts into the treasury requires increased fiscal

management and executive control, and

"WHEREAS all disbursements from the treasury are subject to prior

authorization.

"NOW THEREFORE by virtue of the authority vested in me by Article

III, Section 24 of the Constitution of the State of Alaska, I hereby

order that all Departments adhere to the programs and expenditure

limitations outlined in the Executive Budget and relied upon by the

Legislature in enacting various statutes.

"1. Review and executive approval by the Governor is required before

any action is taken to:

"a. Allocate or re-allocate lump sum appropriations.

"b. Increase the number of positions above the number authorized for

any program.

"c. Expand any program beyond the authorized level.

"2. Any program which has an initial expenditure authorization based

upon estimated federal and/or other receipts shall not exceed the

actual receipts, including known accounts receivable at the end of

the fiscal year.

"3. Any new program, expansion of an existing program or other

program which has not been reviewed by the Legislature will require

the submission of a budget estimate to the Department of

Administration for review and executive approval by the Governor.

"4. All Departments will provide estimates of their disbursement

rates at the level authorized by the appropriation for the program,

in accordance with instructions issued by the Department of

Administration.

"5. All Departments will provide estimates of their federal and/or

other program receipts, in accordance with instructions issued by the

Department of Administration.

"6. The expenses of terminal leave and pay increases will be paid

from regular program appropriations and authorizations. Any

allotments required from the special appropriations made for these

purposes will be made during the last quarter of the fiscal year

1962-1963.

"7. The Commissioner of Administration is directed to issue the

necessary instructions for the execution and administration of this

Order.

By virtue of the authority vested in me by Article III, Section 23 of

the Constitution of the State of Alaska, I transfer authority and

duties relating to the operation of motor vehicle weighing stations

and the enforcement of the laws necessary thereto from the Department

of Public Works to the Department of Commerce, Public Service

Commission, Division of Motor Transportation.

I find that this assignment of function is necessary for efficient

administration.

transfer documents agreed upon by the Department of Highways and the

Department of Public Works.

I, William A. Egan, Governor of Alaska, do hereby order and direct

that all State employees, other than those required to perform

emergency and essential duties, may be excused from duty, beginning

at 8:30 A.M., on December 24, 1962, without loss of leave or

compensation for that day.

The heads of departments and agencies of the State government shall

arrange to grant other time off during the holiday season for those

employees who may be required to work on December 24, and shall, to

the extent consistent with the requirements of their respective

departments or agencies, adopt a liberal policy for the granting of

annual leave to all employees desiring to take such leave during this

holiday season.

member may be reimbursed for actual and necessary expenses at the

rate established in AS 39.20.180 .

3. The Board shall confer with the Commissioners of Administration

and Revenue regarding the administration and the investment policies

of the Teachers' Retirement Fund and may make such recommendations to

them as they deem necessary.

4. The Board shall be furnished reports relating to the condition and

administration of the retirement fund which shall be distributed for

the information of the members of the system.

5. The Board shall meet at the call of the Commissioner of

Administration.

EXECUTIVE ORDER NO. 025

WHEREAS, under Ch. 109, SLA 1955 (AS 18.60.030 ) the Department of

Labor was charged with functions relating to planning and executing

safety programs designed to reduce accidents in every field of

activity; and

WHEREAS, Executive Order No. 19 transferred part of these functions,

i.e., those relating to industrial safety of all oil and gas

exploration, drilling and production operations within the State of

Alaska to the Department of Natural Resources; and

WHEREAS, the Department of Natural Resources promulgated regulations

pursuant to Executive Order No. 19 entitled "Petroleum Safety

Regulations" (11 Alaska Administrative Code 2401); and

WHEREAS, traditional functions and position classification

requirements of the Department of Labor are established to further

industrial safety; and

WHEREAS, because such functions and personnel requirements exist

within the Department of Labor, the said regulations relating to

industrial safety of oil and gas exploration, drilling and

production, and any future rules and regulations, will be

efficiently, effectively and economically administered and enforced

by the Department of Labor; therefore

Under the authority of Sec. 23, Art. III, Constitution of the State

of Alaska, I order that Executive Order No. 19 be and hereby is

withdrawn and that the functions relating to industrial safety of all

oil and gas exploration, drilling and production operations within

the State of Alaska be and hereby are reassigned to the Department of

Labor as originally provided for in Sec. 5, Ch. 109, SLA 1955 (now AS

18.60.030).

EXECUTIVE ORDER NO. 027

WHEREAS, the people of the State of Alaska have experienced death,

injury and property loss, and damage of great proportions as a result

of the earthquake of March 27, 1964; and

WHEREAS, the President has declared a major disaster in those areas

of Alaska adversely affected by the earthquake beginning on March 27,

1964; and

WHEREAS, the State of Alaska and the Federal government desire to

co-operate in the prompt reconstruction in those areas of Alaska

where damage has occurred; and

WHEREAS, the State and Federal governments have a common interest in

assuring the most effective use of federal and state programs and

funds in advancing reconstruction and the long-range development of

the State; and

WHEREAS, such effective use is dependent upon co-ordination of

federal and state programs including emergency reconstruction

activities, which affect general economic development of the State;

and

WHEREAS, the President of the United States has established a Federal

Reconstruction and Development Planning Commission for Alaska:

NOW, THEREFORE, by virtue of the authority vested in me as Governor

of the State of Alaska, it is ordered as follows:

Section 1.Establishment of State Commission

A. There is hereby established the State of Alaska Reconstruction and

Development Planning Commission.

B. The Commission shall be composed of the Governor of Alaska, who

shall act as chairman, and (1) the Secretary of State; (2) the

Attorney General; (3) the Adjutant General; (4) and the Commissioners

of the principal departments of the executive branch of the

Government.

C. Any State agency may be directed by the Governor to participate in

meetings of the Commission where the Governor determines it to be in

the best interest of the State.

D. The Governor may appoint to the Commission such other

representatives as he determines is necessary to provide advice and

assistance in carrying out the purposes of the Commission.

Section 2.Functions of the Commission

A. The Commission shall co-ordinate the State programs established to

assist in the restoration and development of the State and shall

present its recommendations to the Governor.

B. The Commission shall co-operate with representatives of the

Federal Government in accomplishing programs of restoration and

development.

EXECUTIVE ORDER NO. 028

Under the authority of AS 44.17.060 , I order that:

(1) the Department of Economic Development and Planning, Division of

Economic Opportunity, administer the technical assistance program

authorized by Section 209(b) of Title II-A, Economic Opportunity Act

of 1964.

(2) Jefferson Barry, Executive Assistant to the Governor and Acting

Commissioner of the Department of Economic Development and Planning,

act as my authorized representative to the Office of Economic

Opportunity with regard to the technical assistance program.

This Executive Order takes effect on January 5, 1965.

EXECUTIVE ORDER NO. 029

Under the authority of Section 23, Article III, Constitution of the

State of Alaska, I order that:

(1) AS 44.45.050 (a) be amended to read:

(a) The department consists of two divisions;

(1) the division of industrial development;

(2) the Alaska travel division.

(2) AS 44.45.090 is repealed.

(3) AS 44.19 is amended by adding the following new sections:

Sec. 44.19.450 Alaska planning and research division in office of

governor.There is in the office of the governor the Alaska planning

and research division.

Sec. 44.19.460 The Alaska planning and research division.The Alaska

planning and research division shall

(1) gather, analyze, and compile basic data on population trends,

economic development, resources, income, employment, and related

factors in the state economy;

(2) review the capital improvement plans and requests of all

departments and agencies and prepare the related financial analyses;

(3) plan and make programs for state capital improvements including

preparation of annual and long-range capital improvement programs;

(4) assist the operating departments and agencies with professional

planning aid when requested or as directed by the governor;

(5) provide research assistance to any state or private development

bank authorized by the legislature;

(6) maintain a current index of economic activity by major sectors of

the economy of the state;

(7) cooperate with the Alaska State Housing Authority in providing

general assistance to units of local government in the preparation of

comprehensive community plans, the studying of planning and zoning

problems, and related matters;

(8) provide necessary assistance to the governor and the legislature

for achieving balanced and coordinated state policies and programs.

Sec. 44.19.470 Division may accept grants and other aid.The division

may apply for and receive from the federal government, its agencies,

or from other public or private sources, gifts, grants, or other aids

available for its purposes. The division may use a gift, grant, or

other aid subject to reasonable limitations imposed by the grantor.

This Executive Order takes effect on April 1, 1966.
