ACTION NARRATIVE TAPE 99-15 , SIDE A CHAIRMAN KELLY called the Senate Rules Committee meeting to order at 8:49 a.m. All members were present. HJR202-CONST.AM: SUBSISTENCE SENATOR PEARCE moved to calendar CSHJR 202(FIN)am. SENATOR LEMAN objected for the purpose of commenting on the legislation. After hearing testimony on the bill in the Senate Resources Committee yesterday, it is his opinion that the bill is not worded as well as it should be. The Assistant Attorney General acknowledged that the second sentence in the first section of CSHJR 202(FIN)am is unnecessary, and Senator Leman expressed concern that its inclusion will cause problems. In addition, the bill contains three different terms that pertain to fish and wildlife resources. SENATOR LEMAN cautioned against using different terms to identify the same thing in a constitutional amendment. SENATOR LEMAN said his last concern is that if it is the intent of the state to pursue litigation to resolve the constitutional issues surrounding subsistence, he believes the last provision under the purpose section of CSHJR 202(FIN)am will cause trouble. CHAIRMAN KELLY announced that without further objection, CSHJR 202(FIN) am will be calendared. There being no further business to come before the committee, CHAIRMAN KELLY adjourned the meeting at 8:52 a.m.
