Representative Weyhrauch arrived as the meeting was in progress. HB 493-LONG TERM FISCAL PLAN  Number 0129 CHAIR HAWKER announced that the only order of business would be HOUSE BILL NO. 493, "An Act relating to adoption and revision of a long-term fiscal plan for the State of Alaska." CHAIR HAWKER explained that the purpose of the meeting is to solve a parliamentary dilemma from the last meeting when a vote was taken to move the committee substitute (CS) for HB 493 from committee. Five members were present and the motion carried by a vote of 4 to 1. However, the chair originally ruled that it would take the full five members to move the bill out, a parliamentary issue was raised challenging that point, and the chair acquiesced with the intention of getting a parliamentary ruling, he related. Though there is some latitude within Mason's Rules for a minority of the committee to move a bill, the long-standing procedure in the body here, and a procedure Chair Hawker said he wishes to endorse is that it does require a majority of the committee to report a bill out of committee. CHAIR HAWKER noted the arrival of Representative Weyhrauch. He asked for a motion to rescind the earlier vote to report CSHB 493 out of committee. Number 0228 REPRESENTATIVE SAMUELS moved [to rescind the motion from April 16 to report the CS for HB 493, Version 23-LS1765\H, Utermohle, 3/18/04, out of committee]. There being no objection, the motion to report CSHB 493 out of committee was rescinded. REPRESENTATIVE GRUENBERG asked if a new motion is needed to adopt the proposed CS, or if there were enough members present at the last meeting to do that. CHAIR SAMUELS replied that the CS was legitimately adopted. Number 0304 REPRESENTATIVE GRUENBERG moved to report CSHB 493, Version 23- LS1765\H, Utermohle, 3/18/04, out of committee with individual recommendations. REPRESENTATIVE OGG objected. He said he thinks a fiscal plan is needed, but he said the elements of the plan should be included. He said he would vote for a plan that contained the elements of a plan. REPRESENTATIVE GRUENBERG replied that he has nothing to add and that the bill speaks for itself. CHAIR HAWKER noted that he has grave concerns about the inability to achieve the objectives stated in the bill. Number 0500 A roll call vote was taken. Representatives Weyhrauch, Kohring, Moses, Wilson, Samuels, and Gruenberg voted in favor of the motion to report CSHB 493 out of committee. Representatives Ogg and Hawker voted against it. Therefore, CSHB 493(W&M) was reported out of the House Special Committee on Ways and Means by a vote of 6-2.  ADJOURNMENT  There being no further business before the committee, the House Special Committee on Ways and Means meeting was adjourned at 7:51 a.m.
