LEGISLATIVE COUNCIL  July 13, 2005 1. ROLL CALL  The Legislative Council meeting was called to order at 10:19 am by Representative Kott, Chairman, Legislative Council, in the Butrovich Committee Room, Anchorage LIO Second Floor Conference Room and via teleconference. The roll was taken. In attendance were Council members: Representatives Kott, Harris (via teleconference), Coghill, Gatto, Rokeberg, Weyhrauch (via teleconference), Berkowitz, Senators Cowdery (via teleconference), Ben Stevens, Gary Stevens (via teleconference), Wagoner (via teleconference) and Davis (via teleconference). Members absent: Senators Therriault and Wilken. Staff present: Ohmer, O'Hare (via teleconference), Varni, Bannister, Clothier, Finley, Gullufsen, Hard, Ibesate, Johnston, Price and Schofield. Guest: Wayne Jensen, with Jensen Yorba Lott, Inc. (via teleconference). 2. APPROVAL OF JUNE 29, 2005 MINUTES  Senator Cowdery moved the minutes of the June 29, 2005 meeting be approved. YEAS: Kott, Coghill, Gatto, Rokeberg, Weyhrauch, Berkowitz, Cowdery, Ben Stevens, Gary Stevens, Wagoner and Davis NAYS: None ABSENT: Harris, Therriault and Wilken There was no objection the motion was approved. 3. ITB 415 REMODEL OF HOUSE AND SENATE CHAMBERS    Ms. Varni, Executive Director, Legislative Affairs Agency, updated Legislative Council on the remodel of the House and Senate Chambers. Upgrades being made in the aisles for ADA compliance for handicapped access, individual desks will have electrical upgrades, heating panels added for each desk and new desks and counter tops replacing the old and chipped ones. The front podium area will be lowered and new counter tops added along with additional storage for the Senate Secretary and Chief Clerk. The low bidder is North Pacific Erectors, Inc. for $720,700. Existing capital funds will be used for this expenditure. Discussion followed. Senator Wagoner requested that trash containers be placed in desk cabinets hidden from view instead of being placed under the desks. Discussion followed. Ms. Varni stated Ms. Price would issue a notice of intent to award. Ms. Price received two bids that were faxed to members of the Council on July 12, 2005. Ms. Varni further stated the completion date is scheduled for the end of November. Senator Cowdery moved that Legislative Council accept the design plans as presented and accept the low bidder for completion of the work. Representative Gatto objected; requesting a vote be taken. Speaker Harris joined the meeting. YEAS: Kott, Coghill, Harris, Weyhrauch, Cowdery, Ben Stevens, Gary Stevens, Wagoner and Davis NAYS: Gatto, Rokeberg and Berkowitz ABSENT: Therriault and Wilken The motion passed 9 - 3. Senator Gary Stevens left the meeting. 4. ITB 417 CARPET FOR SECOND FLOOR CAPITOL  Ms. Varni stated that the low bidder was Textures from Seattle, but because of the Alaska bidder preference the bid was awarded to Commercial Contractors, Inc. from Anchorage. Don Johnston, Building Manager, calculated the sq. yd. footages for the bid process. Commercial Contractors, Inc. recalculated the sq. yd. footages of the four different carpet patterns to insure appropriate quantities were ordered. The total price from the successful bidder was $120,453. Ms. Varni further stated that the carpet was last replaced in 1993. Discussion followed. Senator Ben Stevens moved that Legislative Council accept the low bidder for ITB 417 for carpet on the second floor of the Capitol. Senator Ben Stevens requested that Legislative Council call the question. Speaker Harris left the meeting. Representative Rokeberg objected to the motion and would like to amend the motion so that the Legislative Affairs Agency can solicit requests from all bidders on the new figures for the pattern match adjustment. Representative Rokeberg also requested that the Legislative Affairs Agency be able to make the award based on their best determination without returning to Legislative Council. This would expedite the situation so Legislative Council doesn't lose any more time than necessary. YEAS: Coghill, Gatto, Rokeberg, Berkowitz and Wagoner NAYS: Kott, Weyhrauch, Cowdery, Ben Stevens and Davis ABSENT: Harris, Therriault and Wilken The motion failed 5 - 5. Representative Kott moved for a vote on the motion made by Senator Ben Stevens that Legislative Council accepts the low bidder for ITB 417 for carpet on the second floor of the Capitol. YEAS: Kott, Coghill, Rokeberg, Weyhrauch, Cowdery, Ben Stevens and Davis NAYS: Gatto, Berkowitz and Wagoner ABSENT: Harris, Therriault and Wilken Motion failed 7 - 3. Senator Wagoner requested notice of reconsideration by vote of last item. Discussion followed. Senator Wagoner moved to remove his motion for reconsideration. Senator Wagoner moved to rescind the previous action on ITB 417 carpet for the second floor of the Capitol. YEAS: Kott, Coghill, Gatto, Rokeberg, Weyhrauch, Cowdery, Ben Stevens, Wagoner and Davis NAYS: Berkowitz ABSENT: Harris, Therriault and Wilken Motion passed 9 - 1. Senator Ben Stevens moved that Legislative Council approve the solicitation, expenditure and award to the low bidder for ITB 417 for carpet on the second floor of the Capitol. YEAS: Kott, Coghill, Rokeberg, Weyhrauch, Cowdery, Ben Stevens, Wagoner and Davis NAYS: Berkowitz and Gatto ABSENT: Harris, Therriault and Wilken Motion passed 8 - 2. 5. FY 06 PRINT SHOP PAPER PURCHASE Representative Weyhruach moved that Legislative Council approve the solicitation, expenditure and award of Printshop paper in the amount of $90,500 from Legislative Affairs Agency FY06 funds. YEAS: Kott, Coghill, Gatto, Rokeberg, Weyhrauch, Berkowitz, Cowdery, Ben Stevens, Wagoner and Davis NAYS: None ABSENT: Harris, Therriault and Wilken Motion passed 10 - 0. 6. KENAI OFFICE SPACE RENEWAL APPROVAL  Ms. Varni informed Legislative Council that the Kenai LIO and Legislators are in a state- owned facility. The State Facility Lease Agreement is up for renewal for this fiscal year. The price per sq. foot was $.56 from July 1, 2004 - June 30, 2005. Ms. Varni stated that the costs have gone up and the Agency occupies approximately 34% of the building. The lease exceeds the $25,000 yearly threshold requiring Legislative Council approval. Ms. Varni further stated that the lease is for $37,609.88 from July 1, 2005 - June 30, 2006. Discussion followed. Senator Wagoner requested that Legislative Council look into extending the lease from year-to-year to a multiple-year lease. Discussion followed. Senator Ben Stevens moved that Legislative Council approve the FY06 lease renewal for the existing lease space in Kenai; as reflected in the memo from Pam Varni dated July 8, 2005. YEAS: Kott, Coghill, Gatto, Rokeberg, Weyhrauch, Berkowitz, Cowdery, Ben Stevens, Wagoner and Davis NAYS: None ABSENT: Harris, Therriault and Wilken Motion passed 10 - 0.   7.
