PRESENT Co-Chair Hanley Representative Kelly Co-Chair Therriault Representative Kohring Representative J. Davies Representative Martin Representative Grussendorf Representative Mulder Representatives Foster, Moses and G. Davis were not present for the meeting. ALSO PRESENT Senator Dave Donley SUMMARY SB 63 An Act providing for automatic waiver of juvenile jurisdiction and prosecution of minors as adults for certain violations of laws by minors who use deadly weapons to commit offenses that are crimes against a person, and relating to the sealing of the records of those minors. HCS SB 63 (FIN) was reported out of Committee with a "do pass" recommendation and with fiscal notes by the Alaska Court System, the Department of Corrections and two by the Department of Administration; zero fiscal notes by the Department of Public Safety and the Department of Health and Social Services. SENATE BILL NO. 63 "An Act providing for automatic waiver of juvenile jurisdiction and prosecution of minors as adults for certain violations of laws by minors who use deadly weapons to commit offenses that are crimes against a person, and relating to the sealing of the records of those minors." Representative J. Davies MOVED TO WITHDRAW the motion taken to adopt Amendment #2. There being NO OBJECTION, it was WITHDRAWN. Co-Chair Therriault MOVED to ADOPT committee substitute, work draft version 0-LS0295\H, Glover, dated 1/26/98, instead of version 0-LS0295\B as previously adopted 1/27/98. There being NO OBJECTION, it was adopted. Representative J. Davies commented that the language on Page 2, Line 6, in the "H' version was constructive and in align with what he had intended it to be. He read from the Conference Committee notes information, which clarified the proper interpretation. SENATOR DAVE DONLEY voiced support with the language as recommended in the version adopted. Representative Mulder MOVED to report HCS SB 63 (FIN) out of Committee with individual recommendations and with the accompanying fiscal notes. There being NO OBJECTION, it was adopted.
