CHAIRMAN KELLY brought HB 11 - DRIVERS LICENSE REQUIREMENTS FOR MINORS before the committee as the next order of business, and directed attention to a proposed Rules SCS. JUANITA HENSLEY, Division of Motor Vehicles, Department of Administration, noted that Sections 4 through 14 are were the new sections in the Rules SCS. She said several years ago when minor consuming was decriminalized, it basically took away the ability for the court to order in an individual into alcohol treatment if he or she was determined to have an alcohol problem. The new provisions in the Rules SCS will allow the individual to be sent to an alcohol screening, and, if there is a problem, then complete a course through the Alcohol Safety Action Program, which is run through the Division of Alcohol and Drug Abuse in the Department of Health and Social Services. It also allows those courses to approved and designated for those individuals who are under the age of 21. Currently, the Division of Motor Vehicles approves alcohol information schools, however, they do not have the expertise to be approving these types of courses. If an individual receives a drivers' license revocation under the use it, lose it provisions of the minor consuming, then before the individual can get the drivers' license back, he or she must go through a screening, evaluation and treatment. SENATOR TAYLOR commented this is something they have been trying to accomplish for a long time, and he expressed his appreciation for all the work done on this issue by Loren Jones, Director of the Division of Alcoholism and Drug Abuse, and Don Dapcevich, Executive Director of the Governor's Advisory Board on Alcoholism and Drug Abuse. SENATOR LEMAN moved the adoption of SCS HB 11(RLS), and hearing no objection, CHAIRMAN KELLY stated the motion carried. SENATOR LEMAN moved and asked unanimous consent SCS HB 11(RLS) be approved for calendaring at the discretion of the Chair. Hearing no objection, it was so ordered.
