SB 151-FETAL ALCOHOL SPEC. DISORDER AS MITIGATOR  2:39:08 PM CHAIR FRENCH announced the consideration of SB 151 and asked for a motion to adopt the proposed committee substitute (CS). SENATOR WIELECHOWSKI moved to adopt the CS for SB 151, labeled 27-LS1132\U, as the working document. CHAIR FRENCH announced that without objection, version U was before the committee. 2:39:33 PM CHRISTINE MARASIGAN, Staff to Senator Kevin Meyer, explained that the version U makes two substantive changes. The phrases, "and except as provided by (20) of this subsection," and "as determined by a neuropsychological examination." were deleted from sections 18 and 20 respectively. The first change maintains the intent to apply the mitigater to lessor crimes, and the second change alleviates confusion about who diagnoses fetal alcohol spectrum disorder (FASD). CHAIR FRENCH summarized that the idea was that it should apply to crimes not committed against a person, and that there was no need to place in statute how a judge should determine FASD.
