The minutes were constructed from the committee secretary's log notes.] CHAIR JAMES announced that the only order of business would be HOUSE BILL NO. 297, "An Act relating to the certificate of need program; and providing for an effective date." [Before the committee was a proposed committee substitute (CS), version 1- LS1303\M, Lauterbach, 3/15/00.] CHAIR JAMES commented that Medicaid would affect recovery of capital costs if a certificate of need (CON) is not obtained. Nevertheless, the Department of Health and Social Services would not require a CON under the proposed CS. Therefore, Amendment 1, requested by Representative Kerttula, was drafted to clarify language in the proposed CS. Amendment 1, dated 3/15/00, read as follows: Page 1, line 14: After "facility" delete [OTHER THAN A NURSING HOME] Page 1, line 14: After "facility" insert "that is an ambulatory surgical facility" Page 2, lines 7-8: Delete all material and renumber remaining sections accordingly. REPRESENTATIVE HUDSON made a motion to adopt Amendment 1. There being no objection, Amendment 1 was adopted. REPRESENTATIVE HUDSON made a motion to move CSHB 297 [version 1- LS1303\M, Lauterbach, 3/15/00, as amended] out of committee with individual recommendations and the attached fiscal note.
