HB 336 - ELIGIBILITY FOR POWER COST EQUALIZATION HB 337 - POWER CREEK HYDRO PROJECT IN CORDOVA Number 0042 CHAIRMAN IVAN indicated the committee would hear HB 336, "An Act relating to eligibility for power cost equalization," and HB 337 "An Act making a special appropriation for the Power Creek hydroelectric facility; and providing for an effective date." He stated the committee has already adopted a proposed committee substitute (CS), 0-LS1133\B, for HB 337. He said there is a proposed CS, 0-LS1132\B, for HB 336. He said it incorporates a conceptual amendment that was adopted at the previous meeting on Wednesday, February 4, 1998. The amendment is on page 1, line 10, after "hydroelectric generation facility," the phrase "or other electric generation facility that is not powered by diesel fuel," was added. He said he would entertain a motion to adopt the proposed CS for HB 336, dated February 5, 1998. Number 0136 REPRESENTATIVE JERRY SANDERS moved to adopt the proposed CS for HB 336. CHAIRMAN IVAN asked if there was an objection. Hearing none, CSHB 336, 0-LS1132\B, was adopted. Number 0173 REPRESENTATIVE SANDERS asked if the money will come from the general fund. Number 0199 REPRESENTATIVE GENE KUBINA confirmed that the bill says the money will come out of the general fund. He said his thought was to get an appropriation bill up to the House Finance Committee to debate that issue. He said he assumes the appropriation portion of the bill will never pass. If the body decided to appropriate any money, it would end up in the budget bill. He stated the bill is a vehicle to discuss the legislation. Number 0248 REPRESENTATIVE SANDERS said with that understanding, he intends to vote to move the legislation. He said, "I don't want my vote to be interpreted as supporting this over $100 million worth of other things that the Governor has put in this year. It's going to have to fight its way through and we'll see where it comes towards the top whether I vote on it or not." Number 0287 REPRESENTATIVE KOOKESH said the appropriate place to discuss the money impact is in the Finance Committee and he believes the House Community and Regional Affairs Committee members have done their job by making sure the appropriate amendment is included. Number 0315 CHAIRMAN IVAN said he would entertain a motion to move CSHB 336 from committee. He noted in order to do that, the committee needs to rescind action in failing to move HB 336 out of committee. Number 0341 REPRESENTATIVE SANDERS made a motion to rescind the action in failing to move HB 336 out of committee. There being no objection, it was so ordered. Number 0379 REPRESENTATIVE SANDERS made a motion to move HB 336, as amended, out of committee. CHAIRMAN IVAN asked if there was an objection. There being no objection, CSHB 336(CRA) moved out of the House Community and Regional Affairs Committee. Number 0433 REPRESENTATIVE SANDERS made a motion to move HB 337 out of committee with individual recommendations. REPRESENTATIVE OGAN objected. Number 0468 REPRESENTATIVE KUBINA said, "Representative Ogan wasn't here when we -- when Representative Sanders brought the point before us, so we might just reiterate it for him. The reason that this bill is even in - there is no thought of this bill ever passing. It's just a mechanism to discuss the appropriation and if there would be an appropriation, if the legislature did want to do this, it would be something that would be incorporated in the budget. It would not be something that would be passed as this bill. So it's just a mechanism to put it in front of the legislature or in front of the Finance Committee. The program, because it hasn't been there before as a bill, and then the appropriation bill -- but it's not something that by the committee moving out we'd expect any of you to certainly vote for anything, but it would be part of a overall budget if the legislators decided to put any money towards the program." CHAIRMAN IVAN asked Representative Ogan if he still maintains his objection. REPRESENTATIVE OGAN indicated he still maintains his objection. A roll call vote was taken. Representatives Kookesh, Dyson, Sanders, Joule and Ivan voted in favor of moving the bill. Representative Ogan voted against moving the bill. CHAIRMAN IVAN indicated CSHB 337(CRA) moved out of the House Community and Regional Affairs Standing Committee with the attached fiscal note.
