CHAIRMAN HALFORD brought HB 445 am (DWI LAWS) before the committee e as the next order of business. He stated Senator Robin Taylor was present to speak to a proposed Rules SCS, which incorporates a number of items contained in other pieces of legislation. SENATOR ROBIN TAYLOR distributed a letter from the Canadian Mothers Against Drunk Driving and noted Canada has had 0.08 legislation in place for many years. The letter states that over 0.08 legislation may well distract from putting law enforcement efforts where they will be most effective, namely on repeat offenders and those with a very high blood alcohol count. He pointed out that the Finance SCS changes the level from 0.10 to 0.08. Senator Taylor advocates that a felony be imposed on third time offenders and for the seizure and forfeiture of vehicles on repeat offenders. Both of those provisions were removed from the Finance SCS. The Rules SCS places the seizure and forfeiture provision back in, as well as it provides that the court may order as a condition of probation that the person take antabuse or a similar drug intended to prevent consumption of alcoholic beverages. SENATOR RIEGER moved that SCS HB 445(RLS) be adopted. Hearing no objection, the motion carried. SENATOR RIEGER moved that SCS HB 445(RLS) be passed out of committee with individual recommendations. Hearing no objection, it was so ordered. SENATOR RIEGER moved and asked unanimous consent that SCS HB 445(RLS) be approved for calendaring at the Chair's discretion.
